What if I don't want to register the vehicle with the state? There's no law that says I need permission to use personal property
@LegalAidSNV
@LegalAidSNV 2 месяца назад
Nevada law requires the registration of vehicles intended to be driven in this state. See NRS 482.205 (“Except as otherwise provided in this chapter and NRS 706.188, every owner of a motor vehicle, trailer or semitrailer intended to be operated upon any highway in this State shall, before the motor vehicle, trailer or semitrailer can be operated, apply to the Department [of Motor Vehicles] or a registered dealer for and obtain the registration thereof.”).

Went through a Nevada Bar Mediation meeting, April 2022. The Mediator literally refused to look at the paperwork both side had brought. The defendant later threatened me with litigation that would go beyond Small Claims Court, at which point I withdrew. However, am actively pursuing this and moving forward this date. Question: Confused as to herein states Mediator reviews documents and our experience, that did not happen, why? Also, there was no option for a Hearing afterwards, why?

Before you can complete the paperwork to collect from the judgment debtor, you will need to decide what money or property of the judgment debtor’s you are going to instruct the sheriff or constable to take. Some types of money and property you should try to identify include wages, bank accounts and cash, real property, and bonds or recovery funds. We recommend reviewing our Civil Law Self-Help Center website, specifically this page: www.civillawselfhelpcenter.org/self-help/judgments-for-money/how-to-collect-a-judgment/167-garnishing-wages-or-attaching-bank-accounts

The real truth about small claims, they don't follow evidentriary rules, the Justicial Criminal and Civil Court Systems are two tiered, one for the wealthy and one for the poor. If you had the evidence, it should be an open and shut case. Here in Los Angeles, you have to pay 75 dollars to open a small claims court, you must be correct on the names you are suing, if you are suing a corporation you must go on line to find the owner of said corp or LLC and submit his name as the agent and owner correct address. If you failed to do this, your case will be thrown out. You must submit a letter to both defendants, which is called a demand letter why you are suing and how much you are suing for. upon getting your court papers, you must serve the defendants either by the sheriff's or some who is over 18 years of age or a friend, you can not serve the supeona your self. upon completing this task, you must serve the courts proof you served the defendants. Which is called proof of service. Upon submitting all of this to the court clerk, he will give you copies of your intent to suit papers and a case number, and the date of the trial. Let it be noted, we have in America a two tierd Justicial and civil trial courts. One for the rich and one for the poor, as shown on television everyday how the rich with money and their lawyers have cases dismiss or constant delay after delay. How Corporations used their money and power to avoid penalties on criminal and civil lawsuits. You can see this when oil spills happen in our harbors and beaches. On March 29, 2024 was my trial date, What a nighmare, As I watched people who were suing car dealers, HOA, banks, towing companies, rental companies, Home Depot, lose their cases one by one. The court made specifically clear you can't have a lawyers, yet several lawyers appeared in small claims represent these corporations. Finally my case was the last one to be heard. Again the judge stated she was not a real certified appointed judge. She was hire by the Los Angeles County department to work as a Judge protem, who fills in for real judges. As the plaintiff I had to go first, I stated the HOA violated their fiducaiary responsibility, it took them a year to fix my plumbing problem which cause my tenant to move out and not being able to rent unit I loss 7 months of rents income loss of 11,000 due to their failures. In California you can sue up to 12,500 is the limit. I asked both Judge and defendants to go to page one of my evidence, a communication between the HOA and me. It states and shows I filed on their (HOA Portal) the date and time I wrote for them to fix their in-wall plumbing a broken drain pipe causing a massive flooding of my unit. The judge stated she did not have my evidence, I showed her my evidence was given the clerk upon filing my case. She asked the defendant about my evidence I sent them, they stated they did not bring it. Of course not I told the judge, my evidence is not hearsay, but facts comming from the HOA portal from the defendant. They would not bring cause it would show the truth and would be detrimental to their case. It was the plaintiff time to talk, the HOA said they tried to fix my unit but had no phone or key to my unit. They said I only sent them three complaints I sent one every month and I had copies of my converstion I sent them via a portal lie after lie. My turn again, I said page four your honor of my evidence, a letter from the HOA they did not have my keys to the unit. Let it be noted I submitted a maintenace report on the HOA portal telling them of the flooding and broken in-wall pipe on March 31, 2023. Two days before my trial a year later on March 26 2024, they sent a team of plumbers. who went into my unit and fixed the broken in-wall pipe and connected it back to the sink. Me again, talking with the judge, your honor turn to page nine and their you will find a letter from the HOA they did not have my keys to fix my unit, a year later when they fixed my unit they sent me a letter stating that they had keys to my condo. I submitted this evidence to the defendants and they jugde looked at the evidence. A week later I get a letter from the Long Beach Courts, stating and I quote "the palntiff's does not owe money to te plaintiff's" She said I lost. Moral of the story, their or good judge and their are bad judges, Good Lawyers bad Lawyers. Our courts are political

Why is it not recommended to buy a car private sale? Never heard of something like that in my life. You’d rather me go to a stealership and get scammed?
@LegalAidSNV
@LegalAidSNV 4 месяца назад
There are many risks to purchasing a car in a private sale. For example, the supposed seller may not actually own the vehicle, they may dispute later on whether you actually paid for everything, and the DMV may not be able to register it without the proper paperwork. If you have any questions about a potential scam (either through a private seller or a dealership) you can reach out to our office for help.

Why do you help people squat on peoples houses?
@LegalAidSNV
@LegalAidSNV 7 месяцев назад
We're assisting people with filing their Tenant Answers and recommending they request mediation. Mediation will provide the landlord and the tenant the opportunity to work out an agreement, including connecting the tenant to available rental assistance programs if the tenant has not already applied. We suggest landlords make tenants aware of rental assistance if they haven’t heard of it so that tenants can apply for funds to pay off arrears. Landlords can get legal assistance on our Civil Law Self-Help Center site or by signing up for one of our weekly Landlord-Tenant Ask-A-Lawyer events over the phone.

No, small claims court is only for money damages in the amount of $10,000 or less. Any other actions, like declaratory relief or injunctions (to stop a company's bad behavior) would have to be filed in state or federal district court. If it is a big company, you can file a complaint with the company itself (probably a complaint procedure), file a Better Business Bureau complaint, or file a complaint with Nevada Consumer Affairs by phone (844-594-7275) or online (consumeraffairs.nv.gov/About/File_a_complaint).
