@dewayne kimble I went to my knee c& p exams yesterday & I had a nurse practitioner. She did use the tool to measure range of motion;she told me to lift my legs as high as I could without pain. I think my exam went pretty good.

Got one for ya. I’m service connected; I’m 100% Permanent; whoever, in the 90’s my retired medical evaluation, ℹ claimed disability from Oil Smoke Inhalation from Desert Shield/ Storm. And I got (denied). Can I go back and fight for that denial? Thank you, Regards!

I have a question, I served on the USS NIMITZ CVN-68 aircraft carrier. I filed a claim for tinnitus and ptsd, after I did a session with mental health clinician and scored severe on PCH9, GAD7, and PCL5 I noticed that the Va changed my claim status to this: 1. Tinnitus(ringing and hissing in ear) NEW 2. PTSD 3. Combat-related New What does this mean

My VA Doctor diagnosed me with neuropathy in both legs from the knees down. She also stated on my VA medical record that it's just as likely from exposure to agent orange as not..(Vietnam vet). Do you think this will be sufficient? The D&B examiner previously told the VA (from an earlier claim) that it was unlikely my issues were related to chemicals. The current D&B exam was with the same examiner who was visibly upset with me what I responded to her question: When did you first begin to experience these issues? My response was "for as long as I can remember".... She told me "we are getting nowhere... I have no trust in the examiner... your thoughts?
You can try but a C & P examiner would have to provide the same opinion. Many examiners that see you for the second time gives me bad vibes. I often question, if they will say something different the second time around. I just realized that when I review my va treatment record I see that the consultations are copied and pasted and nothing appears in the conversation about the symptoms that I mentioned last appointment. What I can do?
You can send your examiner an email in myhealthy vet informing them they left out your symptom's you discussed. the email should be part of your record. Then look to see if you can see what you wrote in your records. It's worth a try. All Veterans. The DVA does not pay their workers to tell you how to file a claim for compensation or how to get a higher to a much higher rating number for more money monthly. You have to figure it out for yourself. Awareness Intelligence, Persistence and Determination and Self Research are the keys to get the results you seek from the DVA. Time Period as of 2011: 29 to 39 years. Believe it or not. You have to be smarter than them! Period.

He is using 2 different situations here. First he explains how to get more money monthly based on being in the hospital and needing continued medical help over time. He does not state the time period. Then he talks about loss of hearing, deafness and blindness. This is a different way to qualify for more money monthly from the DVA. They cannot be the same. The 2 situations have zero to do with an extended hospital stay where you need them to care for you. He is not going to fast, he is using 2 different situations. His rating code sheet has ZERO to do with a compensation board approving a veterans monthly compensation number and percentage or the veterans monthly dollar entitlement amount. He cut and pasted alright because your in service connection is determined by your local areas compensation psychologist who submits 1 or 2 letters to the compensation board explaining your disability and WHY you should be rated at 70%-100% or higher. The compensation board has an assigned, REAL psychologist to do what he says he does or did for veterans. That's not who rated me for me to get my claim rated from 70% to 100%. The local area compensation board appointed psychologist is your BEST/ONLY friend to help you get your claim board approved. Ask him if he is a certified real DVA Compensation board psychologist? If he isn't then simply ask to see your areas C&P, Board Psychologist for him to write a letter to the compensation board to further strengthen your chances to get a higher rating number for your disability claim. The board ignores physical claims unless you have a loss of limbs or the conditions he mentioned in his video talk. For these types of injuries, a veteran gets rated at 100%+ which starts at 6k to 7k upwards monthly. Ok. For a 😮much FASTER claim processing take your claim to your local STATE office of Veteran Services. They assign you your own personal rep and advocate who does 90% of your claim filing for you and meets with you every time the DVA sends you more forms or bull poop to fill out. This IS the FASTEST ways to get a claim through and within 2 or 3 years completed. Good Luck Veterans. I did this for anxiety and they paid me over $369k and still pay me now for LIFE!✌🏾👍🏿
Mental and emotionally affected DVA claims get you the 70% to the 100% ratings higher numbers, not physical injury claims. Link the physical injury to a mental or emotional injury and you're more likely to get a higher to much higher % rating number. Common Sense! They pay most veterans off of mental & emotional, injuries A LIFETIME INJURY is what you want a certified DVA board psychologist to put in writing in a letter or 2 to the compensation board. These 2 words got me my claim approved written by my Honolulu Hi., claims board psychologist. The board members paid him to determine your injury status via an actual one on one interview with you and the shrink in private. Afterwards, before you leave the room, the shrink will ask the veteran, ask you, what do you want me to write and tell the board on your behalf to get your claim approved. This is, HOW I got my claim approved by the compensation board, all by MYSELF. The DVA didn't tell me to ask to see a board compensation psychologist. I thought of it all by MYSELF and yes, they had one and it worked for me. ALOHA!

From my experience the Agent that is helping you I my case the VFW can look at the C and p exams and see what the doctor said and what he put on the DBQ's and Nexus letters stating more than likely or less than likely. In my case I had a C and P exam with 7 conditions 5 were less than likely and 2 were more than likely. Point being the person that is helping a veteran is from an accredited agency such as VFW, DAV , American Legion can see what the examiner created you for or if the condition is service connected . I know the outcome before it even gets adhjucated. Now I can have battle plan what's to do next because the Va takes their time with processing claims. So when I get the bad news in the mail could be months I can go back to the doctor get so more medical evidence in the mean time. When the denial comes I can immediately file a supplemental claim with new medical evidence. Speeds the process up.

C&P exam for general medical, examiner just kept lecturing me about not having my STR, not enough pages of evidence in the file (I had like 350, and she was used to 1500+). I came with copy of medical record from hospitalization during service, she just kept asking for my other evidence. She even pretended to not see the scars on my face, and I insisted she call someone else into the room who then questioned how she couldn't see them -- pretty crazy. I didn't come as prepared as I could have, didn't have current diagnosis or my private medical records in hand -- learning a lot from this experience that I'd do differently next time. Was able to look up a few records using online portals. I'd say that appointment went horrible. So I went out that same day and got everything I could and submitted it. Now getting at least two private doctors to fill out DBQ and nexus letters for me. Likely will have to do supplemental claims for some other items that are taking longer to get appointments for with specialists.
It only takes one time to go through what you went through to see the path is not always easy. Sounds like you are being pro-active just in case she decides to give a negative opinion. You can go in for an increase and possibly get a higher percentage. Put in a FOIA request for the exam and if it shows you should be higher, as long as it is one year from notification, you can appeal to point that out. Have to know the system to make it work in your favor. Been denied 3 times already. Met all criteria but they keep denying on “ continued assistance for 6 months or longer “…. I’m 100% P&T with SMC S and SMC k. They totally dismiss my severe ptsd symptoms and only care about physical disability. I’m 100% on ptsd alone.

about 6 months ago a buddy of mine and his wife were denied the caregiver program because he does not require nursing home level care, and has SMC (S) already... i know none of that is a disqualifier but they used it to deny. now they are trying to figure out how they will fight it

GM Dewayne. My question is off topic. I discharged in 2003 and just filed a claim for conditions that were documented while I was active duty. The VA is requesting additional evidence. Should I submit all medical evidence after discharge until now, to show ongoing issues?
Can I claim my daughter as a dependent she is legally blind and she depends on us to take her shopping taking her to work and appointments pretty much everything. she does not live with us.
The VA considers a child to be helpless if they meet the following criteria: The child is the biological, adopted, stepchild, or supported child of a veteran The child became permanently incapable of self-support before age 18 due to a mental or physical disability The veteran is entitled to compensation and is rated as 30% or more disabled
I live in MS, and my co-worker claims his elderly mother in AL as a dependent (both houses are his). Your daughter meets the criteria. It should be granted as long as you meet the criteria to claim a dependent.

5:26 Yes they do continuous re-evaluations and have wrongfully dismissed caregivers from the program for years. The congressional over site committee brought a lot of this to light. I hope they fix it
I’ve been keeping up with this program, and the over site hearings about it. It’s been a mess for the last several years but I sincerely hope it gets better as the new program director has promised the last couple of years. I’m several people who’ve been denied with horrible criteria (not following the actual regs) and issues getting approved, which is why I’ve not yet applied. Thank you for sharing this info! I truly hope the attention it’s getting makes it really help. We NEED this program!!!
@@Haikuone thank you. I’m not ready to apply yet, I just have a feeling the horror stories are continuing. But I’m hopeful it will improve soon, we need it to!! Aid and Attendance has stricter requirements than the care giver program is supposed to, if I’m not mistaken, regarding particular percentages etc. I’ll keep remaining hopeful they do the right thing and extend this program rightfully to those of us who sincerely need help, but not to the humiliating extent they require (& re-evaluate every 6 months!) to have a shred of chance at approval.
I have a co-worker who submitted a new claim for GURD, they denied it, then cut him 10% on his sciatic saying his condition improved even though there was no examination to determine that. They are looking to make cuts. They may give you a % for a new claim but chances are they are going to cut you somewhere else.

Hey Mr Kimble that’s what I thought also recently months ago I file for sleep apnea to PTSD and got denied for it. Guess they look at your BMI according to their regulations if your aboved 24-29 you consider obese and won’t service connected you. It’s crazy I’m already diagnosed with sleep apnea still get denied for it. But I’m seeing more veteran obtain MD Nexus to proved it link to PTSD. Heard of ACE exam are screwing Vet over with ACE like myself and notice most vet get regular C&P exam things go smoother and get services connected for sleep apnea wonder why is that. I believe ACE exam are trash and not fair to Vet. I had provided VA with Lay statement and buddy statement along with Doctor statement still get denied.

Dewayne, My situation is almost a carbon copy to one of your posters that recently left a comment...Appropriately 18 months ago I filed a claim in March of 2023 for Migraines secondary to major Depressive Disorder, 5 months go by and I finally got a C&P exam in August. Three month later in November I get a decision letter that said my claim for Migraines secondary to Degenerative Arthritis Lumbar Spine has been denied. I was in total shock that not only was I denied, they denied me for something totally different from what I claimed. I had to file a higher level review in December and wait another 4 months before my informal conference call can in April, and fortunately I had a very good DRO and she was even confused herself of how they messed up my claim in that manner. So then the Duty to Assist process started to fix all of that mess. So fast forward another 3 months to July 2024 and they set up me another C&P exam that I thought I was sure I would have to attend, but then they notify me I would not have to attend. Two months later to now (September 2024) they completed another DBQ and with nothing else for them to do, it looks as if I should get a decision very soon. I did get favorable findings on the diagnosis, and they even went back in my medical records and found several incidences while on active duty of complaints of headaches. So everything looks favorable for this denied claim to be approved this time, but who knows....I wonder in my situation was it necessary for me to in addition to everything they did to correct this mistake, should I have filed a supplement claim with this?....Also, since this original migraine claim was filed back in March 2023, I have already reached 100% P&T in February 2024 from another claim that pushed me over, if this HLR migraine claim is approved, will I still get back pay for this claim? and if so, will it be for the entire 18 months?

Submitted more claims went from step 1 to step 6 September 24 then got decision letter claims got deferred and rolled me back to step 3 again on September 25 so they gave me cp exam for disability claim saying cp exam rework and I’m lost now… any tips

Dewayne, please do a video explaining 38 CFR 3.655 FAILURE TO REPORT FOR DEPARTMENT OF VETERANS AFFAIRS EXAMINATION (b). (b) ORIGINAL or SUPPLEMENTAL CLAIM, or CLAIM FOR INCREASE states: “When a claimant fails to report for an examination scheduled in conjunction with an original compensation claim, the claim shall be rated based on the evidence of record. When the examination was scheduled in conjunction with any other original claim, a supplemental claim for a benefit which was previously disallowed, or a claim for increase, the claim shall be denied”. The 2nd part of (b) seems to imply any failure to report for any claim other than an original claim will be denied. Please reference M21-1 IV.i.2.F.1.a also.
