Medicaid is a joint federal and state program meaning the federal government has general rules that all state Medicaid programs must follow, but each state runs its own program. Therefore it is best to consult an Elder Law attorney in your state.
My issue is that I am renting a house and my landlord died almost 2 years ago. (His wife is still living) but they did not have any children together. However, the son of the deceased became administrator, but he is claiming he is both the executor and administrator but the dad HAD NO WILL, why he would claim this I don't know. He only became administrator because the lawyer of the wife never responded to anything from the courts. Now, if I have lease with the deceased and his wife, by law is the son supposed to honor the lease? The wife's name is also on signed in the lease which doesn't end until June of 2023.

My mother went into a nursing home in Aug 2019. She has not been recertified since her initial enrollment. We were told she would need to be recertified yearly. Is this common during COVID19...that required recertifications are not being done or is the nursing home/Medicaid not doing what they are required to do?

My mother is now at this stage where we are investigating different avenues for her. I don't know if she would agree to a pooled income trust. My mother resides in NYC but I live in another state. She requires in home care but I don't know if it would be better to have her qualify for Medicaid and receive home aid in NYC or just have her sell the house and move in with me and my husband. It is a big decision.
