It depends on the project. For straight lines I like the traditional way (the ladders) for curves and such, the closed loops keep you from getting holes.

@@EandVEntertainment It wouldn't be a bad idea. It's not the cheapest thing, and you have to keep it up (I think there's an every 6 year thing?). You don't have to keep a lawyer on retainer. I do, I choose a monitoring plan with my TM lawyer. Every quarter they send me a report so I can see if anyone is getting close to or crossing any lines, and then if we need to move forward from there we can. Even if you don't trademark it, make sure you have proof of when you started with it and such. If someone else manages to trademark it first, you can still contest it and get their tm removed and then get it yourself if you can show that you have more rights to it (you'd have to talk to a lawyer to figure out exactly what would prove that). Also - I'm so proud of you and all you and E have built together. I always knew you were amazing. <3

I agree. I didn't want to have to call any attention to this at all, but her followers started going after me and I didn't want you all to think I was doing what they were claiming (taking her name from her, as though she had it first).

Thank you. I doubt she would have gotten the TM if she had tried, because I would have shown up as having the brand name first. My TM lawyer did tell me (for any future TMs I may want) that even if someone else gets the trademark, if you can prove you have greater rights (or some legal terms here) then the TM can be taken from the first person and granted to you. I had no idea about that before!

Her name was simply Jessie at Home, yours was not. Your "blog" isn't simply Jessie at Home, Jessica . She still has five years to appeal your trademark. She has made substantial more money than you by using the name, she's in a different genre than you on YT and your YT URL is different. Which YT does allow btw. You were mad that your lonely lil crochet channel was getting the traffic you needed , so you thought I'm gonna stick it to someone with a higher following. The letter you sent her, she should have just threw it in the trash where it belonged. It would have cost you $$$$ in litigation, she could afford you, could you? But sense you put that little circle by your name , that you're so proud of, let's see how big it helps your channel grow now... Jessie, which isn't even your legal name, her channel will continue to grow and the reaction channels will have a field day.. I may change my channel name to Jesse @home

My birth name is Jessica, but I've gone by Jessie since middle school. Though, honestly, my legal name could be Samantha and it wouldn't matter for the TM. The thing I do regret is that I didn't do this 6 years ago. It would have been so much easier and less upsetting for her. However, I gave her the benefit of the doubt and hoped she wouldn't continue to use my name throughout other social channels. Unfortunately, she did. Then, she had Amazon change her default store name to MY brand name, because she got there before I did, and that was the last straw. She got the C&D because of her continued actions that have caused confusion with my followers and sponsors across social media. This goes far beyond than RU-vid, as my brand is across many social channels, and in print around the world. As for the C&D - it is a kindness to send one first. I would have been completely in my rights to start off with a $150K law suit. I choose to go the kinder way. I did not talk to her "woman to woman" as she put it, because I didn't know her and wanted to be sure I was protected. That's what lawyers are for. I had no reason to believe she would be reasonable about it, based on her continued use of whatever variation of my name she could get every time she joined a new social media channel. When you choose a business name, if someone else is already using it, this is the chance you take by not choosing a different name.

Actually, it is working. I'm getting my brand name back, and that's what I wanted. I hope her channel continues to grow. RU-vid seems to be her main channel, while for me it's just on of many eggs in my basket. So I hope her RU-vid channels grows in ways that she ends up with many of those nifty plaques they send. As long as she does it in such a way that doesn't use my brand name that I've had since 2008.
