I recently resigned without serving the notice period. I was on probation at the time. I feel that the appointment letter I signed heavily favors the employer, especially because of one clause regarding the probation period. The clause is as follows: 5. Probation, Confirmation & Termination a) You will be on probation for a period of 6 (Six) months from the date of your appointment, whereafter, if your services are found satisfactory, you will be confirmed by means of a written intimation. The management reserves the right to reduce, dispense with, or extend your probation period at its absolute discretion. Your Confirmation will only be communicated to you by way of issuing a Letter of confirmation. b) During the probation period or the extended period of probation, an Employee will be liable to be discharged from the company's services at any time with no notice and without assigning any reason. c) In case of voluntary resignation during probation, you will be bound to provide a notice period of 30 days from the date of your resignation or payment of basic salary for 30 days in lieu thereof. d) Upon successful confirmation of your services, you will be bound to provide a notice period of 45 days or payment of basic salary for 45 days in lieu thereof.
