First Comment! This video is very well put together, but was posted in March 2023 after the FHDA weas updated and the FAAA added. The RPA was updated in June 2023, with some changes to section 14. I have a few concerns when it comes to condominiums. In a condominium, the owner typically owns from the walls, floors and ceilings out, while the HOA is responsible for the insides of walls, below the floors, above the ceiling and all of the common areas. But there are certainly some exceptions. Some condos are 'build to suit' and many allow interior remodels which are the responsibility of the owner. Some condos have exclusive exterior yards or internal courtyards which are the responsibility of the unit owner. The seller's agent really should have these documents from the seller before the listing is in the MLS so it can be in the disclosure package for potential buyers to review before making an offer. I am also concerned about the discussion about arbitration and no mention of mediation.
Hey there @946towguy2 thank you so much for your comment! This is a general overview that I share with my clients prior to us sitting down in person and going over their actual purchase agreement when they make an offer. You are right, there are case by case specifics for each property type.
