It would be extremely difficult to prove sufficient ties if one has only spent the required seven days per year in Portugal; that's just a short annual vacation! The Golden Visa DOES NOT GUARANTEE citizenship. Staying in a hotel or Air BnB for a week each year isn't going to convince any Portuguese official to grant you citizenship. Good luck with that.
Hi Kelly, thanks for your comment. You are quite right that any GV applicants looking to transition to citizenship should be looking to demonstrate ties to the country. Our lawyers work with our clients to do just that, during the 5 years prior to the citizenship application. This can involve activities such as joining clubs linked to Portuguese culture, for example. We do a full review of this with our clients during our onboarding process.

Great video Jonathan. Had a question. If i include my mother in the golden visa application, will she need to pass the language test too. She's 70. I had heard that parents over 60 are exempt from the language requirement. Wasn't sure. Cheers.
Portugalist cites the ordinance that states those over 60 "who also cannot read or write" are exempt from the language test. Not everyone over 60 is exempt. The language test is a requirement only for citizenship, not for the Visa. Also, A2 is a pretty easy level to reach, especially if one has five years to do so.
@@FrozenSkyy Kelly is correct; being over 60 does not exempt you from the language requirement. If an applicant is having difficulty with the CIPLE test, it may be worth pursuing the language course alternative.

Yes, the closure has been proposed. It is not yet law. We anticipate being able to process applications for a little longer, as Spain does not have a history of moving quickly with such legislation, but it might be wise to advance any plans now to avoid disappointment.

Please note these are not real estate investments. Depending on the structure used, these are either investments into a regulated fund or into a Portuguese company. Real estate may be used as a security collateral to protect the investor, but under a separate agreement only to be exercised once the Golden Visa is no longer required.
With the $350K Golden Visa option, is the credited $150K upfront return considered taxable and are you instantly a "tax citizen" if you choose this option?
The return is indeed taxable (there is a withholding tax in Spain and you will likely also be taxed in your country of residence - check that a double taxation treaty exists between Spain and your country of residence before making an investment such as this - a good advisor will help you understand the liability before proceeding). No, you are not tax resident if making this investment - legal residency and tax residency are two very different concepts. Hope that helps
Hey Jonathan, appreciate these videos you make, I will be seeking your services once I make the decision to get the GV. I one question which is important to me, have you seen one of your clients get their Portuguese citizenship without living in the country full time? I understand the rules should allow for this but I am concerned that my application may get rejected since I don’t plan to move full time to Portugal. Another question that is also important is how long after the five year time should one expect the citizenship? Is less than two year a fair expectation or can it be more, so what is the real length of time until you get the citizenship from the start of the application. Apologies for the late reply! Email will always be a much quicker way of getting a response from me. To address your questions: citizenship applications usually take anywhere from 6-24 months to process. I would therefore suggest planning for a 7-year timeline to citizenship (although, of course, this can vary). We are expecting our first citizenships to be granted in 2025. Note that there is now precedence for Golden Visa holders to be granted full citizenship without residing in the country full-time (provided the physical stay requirement for the GV is met during the 5 consecutive qualifying years). This is also made clear in the surrounding legislation. I hope that helps
The government has announced a loose plan, but nothing formal. There is still some road to run, and we don't know what any potential new law will look like yet (or the timeline for implementation). For now, the program remains open as normal.
I’d rather not give a firm answer here as there can be some flexibility. If they’re financially dependent on you, unmarried and under 21 (or even older in certain cases) then there’s unlikely to be any issue. Best to speak to an advisor first
Great video and option for the Portugal Golden Visa. However, we plan to relocate to Maderia as a semi-retired couple. One on a pension and the other still working remote for a US based global company. What would be the recommended route for us to take? This option seems very attractive and would give us a place to stay for a few weeks each year as we make that transition. Are there other GV options for Maderia that may not be available for mainland Portugal, e.g., property investment? TIA

It is not optimistic to maintain the golden visa status. It is a trick or scam. Unless you have visa-free access to the Schengen states, you won't be able to come to Portugal to attend the biometric appointment for, let's say, card renewal. Now, nobody can renew their resident cards on time due to the delay in the system. Hence, unless you enter Portugal before the card expires and stay without leaving, just to wait until an appointment is open for you, but then the very purpose of having a golden visa is lost, because the minimum requirement to maintaining golden visa status is only 14 days per two years. Or, you will have to apply for some sort of visa to come back to Portugal to attend the biometric appointment. And it is unclear what kind of visa that will be; Portugal has no answer to that. Plus, the embassy and consulate of Portugal are not available everywhere; some of them simply don't work and are unreachable. For many people, they cannot even attend the first biometric appointment because they are unable to obtain a Schengen visa. As a result, the investment sits in Portugal to benefit the relevant entities only.
@@musaabadi7648 online renewals are only possible if the residence card has less than 3 months’ remaining validity, but has not yet expired. Outside that date window, online renewal is not possible. Once expired, you’ll need an in-person appointment.
the renewal of golden Visa card that expired in 2024 is not opened at all. that said, the cards that are expired in the period from Jan to March cannot be renewed, neither online nor in person appointment. The online renewal for golden Visa card is not available ever since Jan 2024, thus, the cards that are expired in the period from Jan 2024 to March 2024 cannot be renewal on time. in-person appointment is also not available for anyone to book it on the platform of AIMA.
