Quite some time ago. It never was 7+1. The law said 7rds in a 10rd magazine was the limit. Everyone wants to lump in the "+1" but its not 'the gun' that matters, it's the magazine itself. Current NY CPL (265.36 & 265.37) When passed in 2013, the law originally said 7rds is the legal limit and any magazine over 10rds is illegal Later in 2013: US Western District Court (Judge Skretny) ruled that 7rd limit was unconstitutional. 2015: 2nd Circuit Court of US Court of Appeals made the ruling that 10rds was legally binding throughout the state. Since then, even though the law still said anything over 7rds, case law and the 2nd Circuit Court said 10 was legal so the 7rd part of the law was not enforceable. 7 years later, this was updated and cleared up in the July 2022 law passage. 10rds in a 10rd magazine is fully legal.
@@MatchGradePodcast well when the law changed I confirmed with state police that 7 in the magazine and 1in the chamber. When law changed it allowed 10rds residents but not on the street.
Excellent show. Ammo is always an interesting subject. I was shooting .22lr when it was $7.50/500 rounds. I shot in my to-be father in law's gravel pit so nothing escaped down range. I was really good in those days.
So basically anywhere a sicko is going to mass murder, got ya 🤦🏻♂️. A sign without a penal code # or something to the effect of that isnt a lawful sign, merely a suggestion. Or at least that what my ccw/article 34 coarse told me.
Understandable you'd feel that way but a sign is only required by NY law for a 'place normally open to the public' that does not want a (normally) law abiding person to CCW there. The sign does not have to list a penal code section as other states require. It can be printed or even hand written. Either way, that sign now carries the weight of law. Prior to 2022, it was 'merely a suggestion'. Not now. And your 'Article 34' course is actually 'Article 35' in NY state. I'm in the 'legal/not legal information' role, not the 'like it/not like it' role. That means, we provide the info, you use it as you wish - or don't. That's up to you. ( I also wouldn't be commenting on social media if you intend to violate a law as that is discoverable evidence that would prove character negatively)
Albany native here. Albany county had the worst and longest wait times when it comes to the permitting process. There is an ongoing joking that if your in Albany county you shouldn’t even bother. It takes so long to get it.
THESE SO CALLED LAW IS A CRIMINAL ACT AGAINST EVERY AMERICAN. ALL THEY WANT TO DO IS TAKE GUNS AWAY FROM HONEST AMERICANS. THAT A BULL CRAP LAW. YOUR WRONG
Sorry I missed the part where you specified any “updates” to the CCIA. Was it amended by NY Legislature to double down after Rahimi (the way CCIA was passed to thumb their noses at Bruen)? Was there some state police memo about enforcement policy? Or are you parsing out what’s left of the 2nd Circuit Stay? BTW 2nd Circuit is not a New York Court its a federal appeals court that has a courthouse here.
Our information comes directly from those involved int he cases. The 2nd Circuit Court holds jurisdiction over NY State so we are within their purview.
@@MatchGradePodcast A better understanding of the organization of State and federal court system would help make your message more accurate. You still have not answered what the "updates" were at the NY State level. Were you referring to "updates" on the status of Federal appeals on cases challenging the State statute?
Not all LE are gun people nor friendly to the 2A and fully believe that only cops should have firearms. To some, it's just a job and they wish to keep their jobs.
With Oregon &California handing out subsidies of up to $30k on a new home with one requirement NO USA CITIZENSHIP!!! are blue states like nyc ALLOW 2A rights?
Good info. Have carried since 76 and frankly over the past few yrs. I get confused as to where and where not I may leagally carry. This clarifies perfectly the new laws. My question is can I legally carry in my vehicle or on my scoot does the firearm have to be unloaded etc. thanks
Follow the cases, the attorneys involved, Firearms Policy Coalition, Gun Owners of America, etc. They are the organizations that are in the fight and delivering up to date information
@@MatchGradePodcast I do. 6 different channels including the 4 boxes diner which is run by US Attorney on the Supreme Court Bar. Never seen or heard some of the claims in this video.
I just picked up a pistol permit application in Steuben County. It is so clear that the only aim of the process is to frustrate people from ever being able to even own a gun in their own home, let alone carry a firearm.
Nice to see more local 2A folks making content. The problem is it doesn't matter what the Supreme Court eventually rules if NY isn't forced to comply. The sensitive location thing hasn't changed that I am aware of. The return to the second circuit didn't specifically vacate the order and the Attorney General stated it would still be enforced as it was.
With all due respect, even pro-2A people are missing the point. Violent or not, a right is a right. The biggest problem with pro-2A folks is that they bought into the idea that ONLY upstanding people should have rights, which seems odd when our nation was founded by a pack of gun toting, rebellious, treasonous, criminals. The problem here is not gun ownership at all. The problem is that there are too many laws that dictate and punish good people that are forced to make a decision on when to use lethal force. Hell, Alexander Hamilton & Burr had a legal duel in 1804 and dueling was still legal into the 20th century. Two grown men, deciding mutually, to settle their differences man to man. Today? Can't even go out in the parking lot to square off in a fist fight and "men" have bought into this "softer, gentler, feminized, masculinity" nonsense. Citing the case of Bruen, all of this should still be perfectly acceptable behavior but 2A behaviors are never addresses, only possession of firearm rypes, and licensing are on the menu. You want to cut down on crime? Roll back the self defense laws. If you're wounded or deceased in the commision of a crime, too damned bad. As it stands now, the ownership of a firearm is a very highly risky topic. Even if you CAN own a firearm, you stand to lose everything if you exercise that right. Lawyers on both sides of the argument are off the mark here. AND, if your argument is that we living in a "more civilized time", just watch the news and read the police blotters. We ARE NOT "safer" with the current laws in place. The criminals have the clear advantage and know damned well that honest Americans have their hands tied in a confrontation. You pro-2A lawyers need to just stop with the bargaining and compromising already.
I started the process before the bruin decision. Not too long after I was denied my pistol permit in New York, because of ( multiple arrests) But they were all more than 20 years old and no convictions. Couple more years my wife and I can move out of New York.
@@ronules1It wasn't vacated, it was just returned to Second Circuit litigation. So as far as I know the previous ruling and sensitive locations still stand. Though obviously its on local LEO to enforce it and I know many are opting to ignore large parts of CCIA. Particularly several sheriff departments. There was a self defense shooting in an Applebees (serves alcohol) out towards Utica and best I can find he was never charged, as an example.
That's funny because I don't recall seeing anything about "sensitive places" in the 2A. And any decision that is made to INFRINGE upon our 2A right is, to me, an illegality, not a legality. Let's get that cleared up right now.
@@patrickgarrison7640 Sure, tell that to the police as they are slapping the cuffs on you for a felony charge. The Democrat politicians do whatever they want in New York, without regard to the constitution.
Amazing yes, amazing how he was able to turn his Supreme Court position into personal $$$$. He might ‘look’ like he’s on our side but the only side he’s on is the side that brings him the most $$$$$$.
@@Xploit66it’s not the crime rate, it’s the Democrats who have instituted laws that encourage and protect criminals. Remove the Democrats and any politician who protects criminals and opposes your ability to protect yourself and your family and the problem will be solved. It starts by the state senate overwriting the bail reform act which has empowered criminals and prosecuted law abiding citizens.
