Omg I never thought about the 5%.... dealing with a TBI myself... my % is unknown. I have to push every day... for me I have a mental block where i cant finish job applications. It's weird AF... it's like i feel ppl will notice my injury...
@@reginaldwilliams617 it’s not a matter of hands free. It’s focus. Driving is a baseline stress on the mind why would you add other factors and variables to something that requires constant awareness and attention. Your reaction goes down and your decision making.
Yes... i complained for 2 weeks about my head hurt... my doctor finally documented it. Glad she did because turned out i had a brain herniation and finally got care.... you have to keep telling doctors over and over sometimes to get proper care... I wasn't going to let it die...
I went into the ER for an anxiety attack and the ER nurse wrote that I was an alcoholic with bipolar disorder. I had some alcohol in my system from earlier that day but I am neither an alcoholic or have bipolar disorder. I spoke to a psychiatrist and I am ok now but it’s still upsetting to see that on my record. Like you said though she could have mixed me up with the guy next to me. Can I still fix it?
Are lawyers biased towards a lump sum payment since their contingency payment will be higher? Do lawyers have a duty to uphold objectivity to what is best for the client?
First answer is yes, that can be an iisue but even if you get paid over time, so does the lawyer or in the case of a third party case, even if you are being paid out over time, the lawyer's fee is the same and based on the total value of the settlement including the payments over time. I was just discussing this with a client: YES, a lawyer is supposed to focus the settlement on the best interests of the client.
I have a case in NY. I tore the meniscus in my right knee. My left knee is damaged as well. The event that caused the right knee to be evident was the swelling, but the left knee experienced the repeated experience. I had orthoscopic surgery in February. I most certainly contacted a lawyer to establish and protect my rights. The journey to trying to help me has been difficult. It all happened at work. I enjoy my job. I like my boss. I have a decent report with Human resources. But my case is getting much more complicated. I was repeatedly denied by the insurance company. After eight months of my condition getting worse they then accepted surgery and therapy. After the surgery I did the physical therapy. Things felt pretty good. But as soon as went back it pretty much reversed everything. Since then. I had a fall due to my knees that created a whole new set of problems. I had acute pain my neck and right shoulder. I have been following up with orthopedics, and primary care doctor to figure out the issues. It is a very deep but sincere situation that needs a good lawyer. I am waiting on the one that I have. But, he may either be overloaded or to connected to the local companies. I don't know. Anyway my fall caused shoulder problems, neck problems, and numbness in my left hand.
Hi Scott, I am currently looking for a good plaintiff lawyer in northern California (i.e. in Sonoma County, or nearby?) for an auto collision the other party is 100% liable for, and I sustained multiple lasting (spinal, impinged or worse nerve, sternum, hip, leg, foot, arm, hand, etc. injuries from the approx. 35mph impact, that did $15k. in vehicular damage, the steering wheel airbag deployed and my hand and opposing forearm broke the front windshield... while the left foot to low back took most of the lower impact, upward... into, the spine.) If you know of anyone respected and feared by Geico (the ins. brokerage) and/ or Travelers (apparently the underwriter, of both policies!) I have plenty witnesses, and this might ultimately prove to be a fairly LARGE trial award. (Because I WANT to go to trial, as they are indifferent, not paying ANY medical expenses... and this is a "conflict of interest" when they are duly, 100%, liable.) Any input would be greatly, appreciated. Thank you, sir 😃
Generally, pretty close. There can be variations in the surgeries, but mainly what it’s going to come down to is what you’re outcome is. A good outcome is going to be worthless and a bad outcome will be worth more because if you have to walk around with pain and numbness down leg for example for the rest of your life, that’s worth a heck of a lot more than somebody who has the surgery and is healthy Afterwards
If you have an ongoing WC case that hasn't settled and then are in a no-fault car accident, does this compromise or have a conflict of interest with your WC case before it settles?

Not necessarily, but it might if the same parts of the body were hurt. COmplex situations like that require a lawyer. GIve me a call if you need help! 312-500-4500
Ideally, your medical care should be approved to be paid for by Workers Comp. If your company didn't fire you, they shouldn't cut off your health insurance. How that works is State specific, so you need to talk to your lawyer about it. If you need help give us a call at 312-500-4500.
I’m in chicago and currently have a lawyer on my injury case . Commercial van rear ended me on 10/12/22. Went to ER same day , chiropractic care for 4 months .. 5 months later pain was too severe , got spinal epidural shot .. didn’t work . Ultimately had a spinal fusion surgery. We got all the medical bills and records . Only issue , the Dr that did the surgery did not put in his notes that I advised him that i was in read end accident 6 months prior that totaled my car . I’ve recorded my initial consultation with him and he still refusing to update his notes .
I'm from Oklahoma and com across your videos thank you for the way You explain the scenarios i'm having hard time because not getting My weekly pay after surgery but hopefuly My lawyer know what is he doing i need to pay bill😢
I would LOVE to hear your opinion on my Fathers case. You are so knowledgeable, great experience , but also that you seem laid back to speak with, I feel I could trust you & feel that you'd give honest feedback -
i also want to study law , but its little complicated for me because i cant do public speaking and i cant win any argument , please suggest me how can i be a confident person and strong personality
My husband obtained a TBI at work back in January and we still don't know if he had a seizure, stroke or blockage. Fired original attorney and now this new attorney is way better. Advised us to make an appointment with the neurologist (didn't know we could do that) to go over the test results, the only tests that wc would approve approve. Neurologist ordered more tests such as neck scans, physical therapy, speech therapy, ear nose and throat back in January and still nothing. My husband is a totally different person now and we are so frustrated. Thank God we have a third party suit and hopefully when released, I can get him in with Dr. Ross Hauser down in Fort Myers to actually fix him. Worker's comp is a total scam!! Thank you so much for the info❤
My first MRI with contrast showed (Gliosis) I got from my personal dr. At Kaiser because workers comp is taking so long. I gave worker’s comp the CD 💿 But now they had me do another MRI without contrast which showed T2-Flair. What ball park settlement can I expect. I also had multiple other injuries. L4-5 fusion Plate and screws in my elbow 5 fractured ribs 3 healed wrong and I have discomfort. 5 certified surgeries to go but I have high blood pressure, so Dr’s can’t do the surgeries. Thank you 🙏🏼
No way I can tell you that with info provided. I need to know State, whether WC or third party or both, liability, and we need to know what your medical outcome is. Also, need to know what insurance limits are, since that can have a big effect on case value. From an injury standpoint, it wounds like a big case. Call if you need help: 312-500-4500.
Do you think that the example you gave with 500k and the $250k was a settlement, is that with a surgery or can you get that without a surgery? but medical bills are about $70k as of current?
A person that ran into me and admitted that the accident was her fault to the police, her insurance company kept saying it was my fault. My insurance company would do nothing because I had liability . Their insurance company had the idea that because I didn't violate federal law that I was at fault. Well she was in good hands, the lying scum company.
Hello, thank you for taking out your time to make these videos. I would like any information i can get. Back in March of 2023 there was a ball bearing in my food and I ended up damaging my teeth and jaw. The teeth part is about $6000 to fix. At the time i was working in a building supply warehouse doing hard labor unloading semi's. For about a month i was given the run around from a huge company and my face and jaw got so swollen trying to continue my job just to survive. I ended up hiring an attorney, about a month after hiring my attorney i ended up getting a letter from the healthcare company my job has been paying for, for 2 years and in the letter it stated there has been an event "reduction in hours" that resulted to me losing my medical, dental and vision insurance and I was also paying out of pocket for my fiancees insurance, almost $1000 a month. But i couldn't do the same hours because of my injury and completely lost everything. About 3 weeks after that my boss sent 2 workers to the truck and fired me. Before I got hurt i was up for a promotion and the best worker for years. I've been in severe pain to the point I couldn't eat to the point of being full. After i was fired i told my attorney what happened. Me and my fiancee had to move from Airbnb to Airbnb every few days doing little side jobs for survival. My attorney gave me the greenlight to send in the evidence of what injured me and after weeks they contacted my attorney saying they're liable for what happened to me that it came from their company. By the end of July my fiancee broke down and said she can't do this anymore and we broke up. I was homeless for a week and in severe pain to the point I can't focus on anything else. I ended up moving in with my grandma. In September I was told I need to see the dentist to get monetary offers. I had to borrow money and was told that we can close the case before 2024 starts. I was told by the dentist that i need to see a specialist and im not working, i can't even sleep until the sun comes up the next day out of exhaustion, I started to get really bad migraines after the times i attempted to eat. It took me until January to get enough money to see the specialist and once I did it took the specialist 2 months to send my attorney the official records of my estimate to the adjuster. About a month after my attorney sent the demand letter i got an offer that wouldn't even cover my treatment and I refused the offer in March 2024. On may 29th i was contacted by my attorney saying 2-3 weeks to hear another offer. Im on week 4 of that and sent my attorney 6 messages this month. My jaw is swollen to the point I can't even open it, the last time I tried eating was 3 days ago and my jaw cracked / popped. I have a big abscess infection on my whole jawline to the point I need antibiotics but i have no insurance, no job and no updates from my attorney this month. The problem is that i was only able to come up with money to check my broken teeth, i still never got my jaw looked at. I need to make sure i have enough for my treatments. I also looked up healing times and for the jaw it's possible I would need surgery and they say that after a surgery that the patient will have to spend 4 days in a hospital. Also I wouldn't have loss my job / career, my wages and benefits. They offered me $10,000 4 months ago. Saying $2500 for pain and suffering. I lost my love for eating food, i went from a healthy strong 144lb man to 89lbs. I lost $44000 in loss of wages, my teeth treatment is $6000, possibly jaw surgery is up to $20000. My pain and suffering is off the charts. This global company destroyed my smile, my life. Things weren't perfect before I got hurt but i had an amazing career, years in with great benefits. I had an amazing woman, i had an amazing social life. I took so much pride in my hard work and providing / being a man for myself and my little world. I lost everything, i can't focus on anything else but not screaming in pain to relieve. My attorney is my only voice to them and more than anything I just want what I'm entitled to going through this nightmare. I don't know what else to do or how to move forward and would really appreciate any advice. Thank you for your time and attention
Hello, keep being a voice. From what you said, I think you might be interested in this channel 👉 #drjohnaking. I find him informative, yet down to earth.
Depends on what State you are in. In many States (like Illinois) you get to pick who your treating doctor is, and you have the right to a second opinion doctor of your choosing. Not all States are this way. Sounds like you need a lawyer. Call if you need help 312-500-4500
I have to prioritize my phone calls. If you are out of State without a current case, it becomes harder for me to make time to call everyone back. Is your name Sylvan Dobbs? My notes indicate that your have a out of state case and you already have a lawyer. I do not like to interfere with your relationship with your lawyer or second guess a lawyer when they know your case details and I do not. There is no way for me to evaluate your case or tewll you whether your lawyer is right or wrong under those circumstances. Call Alicia my assistant and give her your questions and I will answer them fro you. 312-895-0545 ext 103.
In what situations does the client have to pay multiple lawyers on a case? I thought it was always the fact that lawyers have to split the one fee regardless of how many lawyers the client gets
Yes, usually the way it works. Is there is more or less one attorneys fee and then the lawyers have to split it. Some lawyers put different provisions in their contract. They have the client sign but the courts don’t like that.
People saying they “just want to be nice to the insurance company”……..damn near fell out of my chair laughing at that one. Every day of the week a good attorney is worth it. Plus people need to understand it way have only taken seven minutes to write the document, but it took seven years to get the knowledge of what to put in it.
First, because the law requires you to be examined by their doctor. Second, it is usually purely an attempt to get a doctor to be their witness at trial who examined you. Usually, they pick a Doctor Who does all of their examinations and they know they can rely on to say bad things about your case.
Attorney DeSalvo, we appreciate your hard work and integrity that are clearly exhibited in the videos. Your legal information is valuable to us. Thank you!
I co-counsel with local attys, so yes., If you already have a lawyer, I do not want you to switch because you liked my videos. My friend out there might reject your case, and I do not want to put you behind the 8 ball.
