Thanks, A question can a company have two bid bond to cover two parts of the project from the total cost of a project, due a company limited bonding capacity.?

Hi Edgard, We cannot give legal advice or advice specific to surety underwriting. There may be several factors that would impact the answer to this question, including the specific nature and terms of the project solicitation, including whether or not there are any statutory or other legal requirements that might preclude a multiple-bid bond situation. The answer may also depend on the nature and underwriting practices of the Surety(ies) being asked to provide the bid bond(s). If the company has limited bonding capacity, it may be difficult to get a licensed surety to underwrite the excess capacity (undercapitalized liability). This is something that requires legal analysis and specific input from the putative bonding companies. You might want to reach out to competent legal counsel and also inquire with a surety bond producer Home - National Association of Surety Bond Producers (nasbp.org). All the best, The ACD Team

Hi, first of all thank you for your great job, the video is really helpful! I have a question, do I need to proceed with the next number of the CO if the last was declined or I need to keep it with the same number and what about the amount for previously authorized COs? Is that only for previously signed and approved or whatever initiated CO amounts? Thank you in advance!/Liudmyla

Hi Liudmyla, We cannot give specific recommendations, but we can explain how the forms work. So, you may number the change orders however you want. That said, the change orders generally go in sequence from first to second and so on. A change order is also for changes to which all the parties agree, so if a change order is declined then that may throw the rest of the forms out of sequence. Again, it is up to you to decide how best to deal with this issue. Our program allows you to import data from the previous change order when creating a new change order. So if you are creating your second change order, you may import from the first and that will bring the numbers forward. You may have to adjust for situations where a change order gets declined for some reason. Hope this helps! This is torture. I'm not five, I don't need the irritating voice at the start reading some nonsense disclaimer, assuming anyone watched it for credit, that doesn't need to be included as it should be documented, a whole lot of bs and filler, and the banter at the onset, awful jokes, deary.

unfortunate that the discounted new system cost almost 3 times as much for common contracts. I didn't know that filling out PDF's was so difficult that we had to create a system that makes it more difficult and more expensive.

While the non-editable purchase option has been a staple offering for quite some time, the platform that supports it does not render an ideal user experience, which is the primary factor driving this change. When using G701 change orders, do they need to be listed on continuation and treated as another division within the continuation ? adding to the grand totals that are then transferred to g702?

Hi@@melanieortega9560, You may list each change order as a line item on the Continuation Sheet (G703, G703S, etc.), and then fill out the “Change Order Summary” table at the bottom of the payment application (G702, G702S, etc.). So, the idea is that you treat a change order just like any other line item of work, putting it on its own row and filling it out appropriately for that item (Scheduled Value, Work Completed, etc.). It will add into the grand totals that go into your payment application as well. Cheers!

We review over 100 projects per year (over a billion in hard costs residential design), and the biggest problem I see in the contracts is the complete failure to fill out the Enumerations section and the issuance date of the contract documents that are part of the project and scope. And we see many versions of plans for the same project, but then the version by issuance date is often missing. Please educate owners and architects to fill out the Enumerations section. (I also see a lot of strip mall lawyers poo poo filling out that section.)

Great point. Yes, most (if not all) owner/contractor agreements in the AIA Contract Documents library have prompts where the parties can (and should) enumerate the drawings and specifications that will be part of the Contract Documents.

AIA Contract Documents, you've taken away easy to use "non editable" contracts and replaced them with this convoluted user interface. For small practices like mine the simple "non editable" B102-2017 was perfect, now you've made it 10x harder to complete what used to be a simple task. Fix this issue, as an AIA member it is infuriating to see my dues wasted in this manner. Besides trying to data harvest and grow your email lists, what does bumbling user interface actually accomplish?

Hi Rick, You can edit a contact in the “Contacts” tab. Keep in mind that if you add a Contact to the Project Team and then edit that Contact, those changes are not retroactive. You will have to go to the Project Team, delete, and re-add that Contact to get the information to update. Hi Operation Hotshot, You can request a deposit just like any other line item. While there is not a specific area in the payment application/continuation sheet forms for a deposit, you may list it as a separate line item/row in the Continuation Sheet. You could, for example, use the “Stored Material” column on that row for a deposit (instead of using the Work Completed columns). Then the totals will go into the payment application. Does a contractor have to hire subcontractors that the owner wants on the job?

Thank you for your comment. Under the A201-2017 framework, the topic of subcontractors is largely covered in Article 5. Generally, a Contractor may choose their subcontractors; however, those choices are subject to review and approval by the Owner and the Architect and the Contractor “shall not contract with a proposed [subcontractor] to whom the Owner or Architect has made reasonable and timely objection.” Likewise, the “Contractor shall not be required to contract with anyone to whom the Contractor has made reasonable objection.” (A201-2017, Section 5.2.2). What happens when you dont have a choice to finalize and it states that the document cannot be finalized due to it being retired. The document is B305-2021 and is the latest version.

Under Construction: would you put the construction company name followed by the person signing the documents to be notarized. I have see the llc name listed but not the person signing at the notarization that is presenting their identification. Normally the BY: would be the signers name ( should that be followed by the construction LLC name as well?

Hi Abril, Could you please provide a little more information? For example, to what specific document and area are you referring? Generally, the party identified could be a person or a company, but that is up to the parties to decide how they want that information to appear on the document; we cannot give business or legal advice. There are other areas where the document may ask things like “Contract For,” and that is simply for a brief description of the job (like “General Construction” or similar). Thanks!
