At 10 my Grandfather and I went Iceskating he had a heart attack he prayed for 2 weeks to get his affairs in order he passed exactly 2 weeks later. before he passed he read to me his will he was willed myself and my cousin everything right down the middle half-and-half. I was 10 so I was informed, but my aunt had power of attorney and changed it to where when she passed it would change to next of kin and never speak of it again fast forward many years she passed away. My father had 2 heart surgeries my sister informed me through my daughters hospital that she had power of attorney over his medical condition since then she has sold three properties and each of the uncles 200,000 cash I went to the courthouse to ask about the original will I really got nowhere other than I need to have an attorney. How is this fair? What do I do for my aunt to have gotten power of attorney to have to present the original to a judge and a reason to get and receive power of attorney, how can I surface the will? She even recently got a no contact against our oldest brother in the paperwork, it states she was trying to have me kidnapped and making a reason my brother went against her and she never tried thank God. This is all documented for sure that would open the subject. I’ve prayed about it. she has tricked my father into thinking he squandered all the 200,000 and night he just had to open heart surgeries, she has felony charges and has taken flight classes and is planning to leave the country. How would it work if the parents instead of giving away their home they sold it to their kid at a great deal of $30,000.00 for example. Will there be capital gains to pay since no one is “inheriting” the home? Or will there be a large capital gains that the kid will have to pay later if he/she sells the house? Assume my estate is worth 3.2 million and my home is worth 2.2 million say. So of I pass away now, I will owe estate taxes in WA on 3.2 million. If I have made a TOD on my home and it passes to my daughter on my passing. For estate tax purposes, is my estate worth 1 million or still 3.2 million after my passing?
