I've seen the "conversation" with Prof. Benny Morris from about a month ago. I was shocked to see the low level of some students' behaviour and their lack of ability to form coherent arguments. I hope LSE and other western institutions find ways to enable free speech without succumbing to violence and terror.
I want to express my condolences to Francisco Orrego Vicuña's family, friends, and colleagues. Despite my differing opinion of him, I recognize that he was a human being, and I wish the best for those who knew him personally. That being said, I must be honest about my views on his conduct as an arbitrator. While I do not believe that he conducted himself in a manner that was always fair or impartial, I acknowledge that his passing is a loss to the legal community.
At 6:30, one of the moderators, Prof. Nassib Ziadeis, discussed the arbitration case of SIAG & Vecchi against Egypt, and expressed dissenting opinions about both the jurisdiction and final award. However, Francisco, acting in his usual manner, favored the defendants, even when it went against the law. In this particular case, the claimant had an expert on Egyptian nationality, a professor who had collaborated in writing the Egyptian nationality law in 1975. Egypt's own experts supported the professor's claims, but Francisco dissented and claimed to know more about Egyptian nationality law than the Egyptian professor himself and the two other arbitrators who tried to convince him otherwise. Regarding the merits of the case, it was a major corruption case in Egypt that involved the president himself and his son. However, Orrego, who claimed to have high morals and honesty, turned a blind eye to this corruption and tried to assist the defendants. In the jurisdiction award, he suggested a course of action that would allow the defendants to reopen the jurisdiction phase, even though they had already lost it. Additionally, he made statements suggesting that the claimant's Lebanese and Italian nationalities were fake, despite the fact that Egypt's own lawyers had found no grounds to object. Orrego's statements directed the defendants to object on the basis of nationality, which ultimately failed when the majority of the tribunal, composed of honorable and independent arbitrators, rendered their awards.
Incidentally, when Francisco writes a dissenting opinion, he politely suggests that the other two arbitrators did not comprehend the legal nuances of the case, but that he did. In reality, he may have either misunderstood the legal aspects of the case or intentionally favored the respondents or the law firm that appointed him. His dissenting opinion sends a message that he did his utmost to assist the respondents, even if they should not have won the case. Consequently, he has been disqualified from several cases for failing to disclose all relevant information, which would have exposed a clear conflict of interest.
Francisco Orrego Vicuña was an allegedly corrupt arbitrator who was selected by certain law firms to ensure that he would deliver awards in their favor. He was known to cite incorrect facts and criticize others, including experts and lawyers, in his dissenting opinions. Despite lacking expertise in certain fields, he seemed to believe that being an arbitrator gave him more knowledge about a subject than scholars who were experts in the field. Over time, his reputation was tarnished, and he was disqualified from serving on many panels due to his bias. Additionally, since he was paid by the hour, he would drag out the arbitration process as long as possible, spending excessive amounts of time on matters that did not require such lengthy discussions. Those who have read the awards in which he participated would likely find that he contradicted himself shamelessly on the same page and even contradicted established jurisprudence without providing a logical explanation. In essence, Francisco had two faces for the same coin: as an academic, he would write one thing, and as an arbitrator, he would do the opposite to satisfy the law firm that appointed him. Overall, Francisco's conduct suggests that he was a corrupted arbitrator who prioritized the interests of law firms over justice and fairness.
Yea those Russian sanctions really are tanking the Ruble and the economy is tatters...yep, any day now. Maybe one more sanction package will do the trick and the Russians will oust Putin, yep, any day now. It appears that those sanctions have bought China, India and Russia closer together and are avoiding SWIFT all together creating a strong coalition. Will the dollar still be the world's reserve currency when over half of the population of the world don't trade in dollars? This is a big mess and there is no political will to put it in reverse gear, admit your mistakes, suck it up and end these stupid sanctions and war.

If a country want's to exclude another by sanctions then it should not result in self harm if there is any sensible approach taken regardless of the International Law which is largely defunct. This is the situation here.
No one needs to be an expert in any of this or sit through an hour and a half of people contemplating their navels to see that the sanctions have completely backfired on the EU! So an utter waste of time - done. But perhaps all these experts were a little more hopeful about the effectiveness of these ridiculous sanctions in March?
Aside from putting everyone in the room to sleep with her 17-minute inro, Anna doesn't get to the point. Each Russian entity and individual they're trying to delicately sanction, has dozens of shadow accounts, cronies and aliases in every Russian bank and already have much of their money out of Russia in many banks in many other countries. Unless you shut off all links to all Russian banks from all non-Russian banks, you're wasting your time. EU and U.N. procedure is neutralizing the effectiveness of all of the sanction effort through tons of over-engineered procedure by worrying that they might harm some innocent actor somewhere along the way. Maybe the UN should run all sanctions requests by the Russian member of the U.N. Security Council. What a blunder that was of the U.N. architects. If you can't effectively manage one bad actor on the U.N. Security Council sitting in plain sight, how can you ever hope to sanction125,000 bad Russian actors you don't even know about? This long-winded chat among well-dressed 'fellows', is proof that sanctions have a weak pulse and will continue to be without the bite they need to have to be effective.
Here we go: once "scholars" get involved in war and politics then we really have a problem. They all point out the issues and potential dangers but none of the come up with a clear practical plan and some of it is just pure nonsense, e.g: What happens if nuclear power collapses? It has happened before with the Soviet Union and besides what do you suggest we do about it right now? It is the same worry about the nuclear attack but posed in a complicated and uninformed manner. Or the other old chestnut that sanctions hurt people, not the regime. Talk about stating the obvious. But how do you stop Russia from feeding its war machines without sanctions? Do we send them humanitarian help like medicine, food and tampons? Fine let's get a list of things they want and send it to them but I don't think those things are sanctioned anyway. The best thing that can be done is to push the Russians out as quickly as possible and that is the problem with Biden and the EU. It is always too little too late; drip, drip. They are always reacting rather than leading out of fear. You can't face the same fear every day and 2nd guess yourself constantly once you decided that the alternative will have far-worse consequences. That argument is done and dusted. By reminding yourself of it you only shake your resolve. Anyone who doubts that then still hasn't understood Putin, Russian history or culture and they should read Dostoevsky. Russians (ordinary lower class outside the populated west side)don't consider other branches of Christianity as Christians. To them, they are heretics who are possessed by Satan. This is why they think NATO's Satanic system (Qanon about Democrats crap) has possessed Ukrainians through a Jew (anti-Semitism is huge in Russia). Russia has always feared the west and been jalouse of it at the same time. Before the US it was the British. The best hope is that Putin will be replaced with someone who won't gamble the way Putin did. Because he knew what he was doing. He knows that his army is corrupt. Maybe not the full extent of it but he knew capturing Kyiv would only work if the Ukrainian government decapitated. In one interview he said if you don't take risks you never drink Champagne. He is a gambler and after the last few wins like all gamblers he increased his bet and now he can't back down. If the US and the EU hadn't held back this war would have been over by Chrismas and Putin or his replacement, left or right would know that next time they have to be far more prepared and contrary to what the west thinks Russians themselves know that this will be a tall order.
In what world do these people live in? Yes, the sanctions have been extremely effective. But not on Russia. They badly backfired and it was a very foreseeable outcome... LOL
