I have a question, if someone is appointed as the executor and if the executor doesn’t follow through with paying the debts, will the debts fall back on the legal surviving spouse to pay off? Like medical bills debt that was left by the deceased

Courtney, First off, Thank you for doing what you are doing for people like me trying to handle a loved ones' estate! I've read that if I needed money to pay back creditors and needed to sell the house, I would need to go to the Clerk of Court to get permission, and I'm sure another form. Is that how you understand it, too? It seems like if I am allowed to sell the house during probate, like your video states, and I wanted to use some of that profit to pay creditors, it shouldn't matter. I dont get how I'm allowed to sell, but if I need to use some of the profits from the house, then I have to get the court involved. I hope my question makes sense. Thank u!
Hi, from my understanding anyone with a vested interest can petition to reopen if the following: The estate's personal representative did not perform the necessary acts or wishes of the deceased. Additional financial assets or estate assets have come to light. Someone wishes to contest the validity of the deceased's will (if they had one).

Do I need any special paperwork or form from the clerk of court to sell my Dads house? Ive read about "Special proceedings". What is that exactly. Listening to your videos, it sould like i need this pyramid layout, showing who gets what from the selling of the home, and thats it. The money goes to the estate account. Bills are paid, taxes paid ( but i tgought inheritance tax would exempt me from paying out tax). Distribute the remaining money to heirs. Now im at 0 balance, so i close the case. What did I miss?
This is great and helped me a lot! I did list a house under form 505 part II (can be added to estate if needed) but based on your video I didn't put that on the 506 line 1. Also if it helps anyone else, I listed a car on 505 as worth $5,000 (as if) but ended up donating it to the NPR car donation site, so I put that in box 2 and attached the receipt for the donation.
