Hey I was sideswiped on the highway (my vehicle was totaled). Defendant (no injuries) & their insurance company has made me see two different IME doctors and denies liability. There policy limit is 250/500k. The accident caused me to have a herniated disc in lumbar L5-S1, 1 epidural shot and percutaneous discectomy operation. 2 herniated discs in cervical spine, 3 epidural shots. Then last week my pain management doctor had me do a discogram procedure to help locate the exact damage discs. Come to find out I need 2 disc replacements at C4-5 & C5-6. The case is going on a year and half and insurance company still hasn’t offered a reasonable settlement amount & still not taking responsibility. Can I have my lawyer file a “bad faith” complaint against them for claiming I wasn’t really injured that severely and not offering me reasonable compensation. And if so, can I receive more than the 250k since medical expenses will exceed that??
it isn't wise to see a doctor that is in your own insurance plan? I know from my own experience my attorney doctor quit taking insurance. To sum it up, if i am in the courtroom, I will say its my body and I have insurance. You have a doctor that doesn't take insurance. we all know its money game though right? lol
I wish I had known an attorney, as knowledgeable as you are, in my area, in 2010. I was hurt at work and required neck surgery to correct the injury. Because work comp wanted to try everything before surgery, I ended up with permanent nerve damage in my left arm and daily headaches. I was unable to lie down or even lean back from April until September, when my surgery finally happened. I still in a tremendous amount of pain and will see a pain clinic on a bi monthly basis for the rest of my life. I had an attorney and 5 doctors that wrote letters, detailed my injuries and was still denied disability. My husband is now the sole supporter of the family and our youngest child is in college. I have so many medical bills that I can’t afford and have no idea where to turn or what to do. Do you have any advice for me? Anything is appreciated.
What if you had to remind the Defense of them not taking your deposition through your lawyer that the days were running out before the deadline passed according to scheduling order...They cancelled mine last year, after that I did a IME with their Psychiatrist and then they almost let the time run out before eventually completing my deposition.

A deposition seems like they are forcing you to testify against yourself. I see some of these deposition videos where it goes on for days. 6 hours a day. It seems like torture. Why can't a person refuse to attend a deposition?

Here is the best way to handle any deposition. When being sworn in, you are asked if you are going to tell the truth, say NO. there is no law requiring you to swear to tell the truth. Wait for trial to tell your story.

How different is a wrongful death case and 1983 case. I have a lawyer on the case but he keeps talking about insurance policy demand and how we have to give the insurance a way out which is around 2 million is what he is going to ask for in the demand. But say the case goes to trial it's up to 10 million. I'm just sicken by how a jail can be so neglectful and get away with low balling a family that they have already wronged in so many ways.

I’m a truck driver and pulled a muscle in my lower back. It happened cranking up the landing gear on the trailer most excruciating pain that it crippled me couldn’t get up and still can’t stand very long. Employer still doesn’t want to pay me even though my case hasn’t hit trial. I’m scared I’m not getting any remedy because I couldn’t move or drive my semi without my leg going numb.
