Police officers have zero training in self defense this results in the police force using guns and weapons .. now their vehicals- can the police be required to train in martial arts or some type of defense to retain the potential criminal too many innocent deaths

First off I love that you used that song on the Intro. from the Deja Entendu album. #2 on the CD If I remember correctly. Anyhow that's the only thing I like about this video haha. 8:13 Absolutely NOT, The Key is NOT Reasonable Suspicion, the key is Criminal Activity. Without a specific crime to attach the suspicious behavior too, any and all actions or movements will raise endless numbers of different suspicions. Remember the "Scientific Method" you form a Hypothesis (the end result) then do experiments(brief investigation) to see if your right. If not then your suspicion is unreasonable. Scientifically and Legally that is. OK not a science person, remember 8th grade math? Solve for X or (reasonableness of your suspicion) 2+X=4 see how you have to have the crime.. I mean answer (the number 4) FIRST. to get the correct answer. If you have reasonable suspicion but no crime...I mean answer 2+X=__ which ever number or level of suspicious you have at the time and act on will give you the wrong crime.. I mean answer. Making your suspicion UNreasonable. Legally and Mathematically. Now in your assertion the KEY being Reasonable Suspicion, this Scenario should help explain what Im trying to convey. A cop is in a parking lot on lunch and Hears a voice say "OMG I dont wanna break the door, maybe me can get this in there and pull up on the automatic lock." the other voice says "ok well do it quick, I dont wanna draw attention to this, We will be in a whole lotta trouble if our Boss found out...... REASONABLE TO BELIEVE THEY ARE CAR JACKERS? 100% yes valid suspicion Ignore everything else now you can touch his inner leg area legally. Upon walking up to these 2 fellas would see a Mcdonalds shirt on both of them, Mcdonalds hats, a togo bag on the hood of the car Mcdonalds, The car they were trying to gain access to has Mcdonalds logos all over it. Sure enough they are in the Mcdonalds parking lot. Did the arrest stop a possible car jacking? or DId the cops arrest and innocent man with a job and no record infront of his bosses for trying to save 80$ for a locksmith to take forever

What about national guards or police firing upon you when there are no state of emergencies or protests going on and youre sitting on your porch and they demand you go inside and holler out "light em up" and shoot paintball guns at you? This happened in harris' vp picks state.

What if they live in the city and have front steps and front porch. Can we go around back to the alley and inspect a vehicle thats parked behind the house. If it was suspected of a hit and run? There was no fence but car was parked right next to back of house. Can we open the door to get the vin number and arrest the suspect if they are sitting in it. Probable cause right? This is in Missouri

Getting a “call” about something where the caller identifies a crime like trespass or criminal damaging etc. officers don’t see the crime but get called. Is that hearsay or is it enough to detain and id?

The Supreme court ruled that the 4th ammendment is all fine and everything, unless it inconveniences any police. So for example, they can use a fake doggy sniff test to say that there are drugs, and that serves as probable cause, so no warrant is needed. Note that dogs cannot be cross examined, and they can't be tested to see how often they are wrong (or how often the handlers can encourage a certain outcome).

Can a cop use, that you look like the suspect they're looking for but turns out you're not the person who committed the crime but arrested you because of a search and found a gun, mind you he was profiled as the person who committed the crime but he wasn't the guy ...my son got hit wit this...he didn't commit a crime...cops lied that he looked like the suspect but can prove that he wasn't the person who committed that particular crime...can my son win this case....or get it thrown out ..can cops do this?? My son was only walking near a area that a shooting g took place....thanks

Stop military style policing. Our streets aren't a war zone. Cops should be a friend to the public, we shouldn't have to fear you. Not everyone you encounter is a criminal. Criminals often grow out of it. Stop assuming. You don't have to catch everyone. Just get those that harm us. No more more policing for tax revenue. (i.e. any ticket you can give)

If you get called for let’s say someone making threats or jaywalking or trespassing. Is a call with no evidence enough to detain on reasonable suspicion because you didn’t see it?

But with a misdemeanor crime committed. That criminal fleeing, wouldn’t it fit into the 3 exception. So i get the minor stuff so traffic violation. But what if it’s a theft that was committed and that’s an m-1 in Ohio.

@@MrMackey9 The Court held that the exception is not automatic. If additional exigent circumstances existed then the entry would be lawful. However, as the court mentioned in it's opinion, most misdemeanors will not rise to that level so officers should be cautioned against it unless they can clearly articulate those additional exigent circumstances. A question , how is it that The Livestock cops can make stops without Probable Cause?? Also you mentioned the New Mexico Constitution taking preference over over the US Constitution! How does that work did we succeed from the Union and I didn't notice?

@@randym7961 Thanks for the comment. This is a question that comes up quite a bit. First, in order for an officer to make a Terry stop in general they only need reasonable suspicion. PC is a higher burden of proof that applies to arrests. In New Mexico, only certified salaried and commissioned officers can make traffic stops. As to your 2nd question regarding New Mexico's constitutional interpretation, New Mexico may give greater protections under the state constitution than the federal constitution provides but it cannot take away any rights the federal constitution provides. So for example, the federal constitution allows officers to search a car without a warrant if they have PC and it's readily mobile. New Mexico, under its state constitution, has decided that a vehicle is an extension of the home and provides greater protections therefore an officer must have a warrant. In Bullcoming v. New Mexico the Supreme Court found that New Mexico courts were violating the 6th Amendment by allowing substitute lab analysts to testify (violation of the right to confront witnesses). It can be confusing. I hope this helps.

You’re not doing a very good job and training offices to do a good job at police officers. So many will and are being sued now and cost citizens around the country millions of dollars, if not billions of dollars now and lawsuits. Don’t you think your training is gone haywire and bad?

@@mikemcc5155 Thanks for the comment. I can understand why the general public may feel this way. I see this type of comment on the channel quite frequently. However, nothing could be further from the truth. I work with law enforcement every day and I can tell you that not only is there not some sense of being above the law, it's the exact opposite. Officers feel that they are walking on egg shells, they are constantly under scrutiny, state legislation is continuing to create more ways to allow them to be sued and in many instances they feel public officials will throw them under the bus. Legal education has never been prioritized. With my client agencies I am seeing an overwhelming response to the legal training. While there will always be those who refuse to do their jobs, the overwhelming majority of officers are welcoming legal training with open arms. They want to catch the bad guys while doing it the right way.

@@tacticalattorney so here's how I see it, if indeed there are all these good cops out there why do we see so many bad ones. One would think if there is only a few bad apples all of the good ones would bend over backwards to get them out because it reflects on them all. Time and time again they prove this not to be the case by way of how they handle themselves vs as you put it "the general public". How many times do you see cops able to retire or resign without charges, how many deferred charges because of a badge? They get slapped on the wrist for something we would go to prison for. As far as them getting sued it seems to me the city, town, or county they work for picks up the tab, or in other words the cops steal from the people by way of tickets, then when they overstep their so called authority they steal from the people again to pay for it. I'm not saying we don't need law enforcement but it comes with enormous responsibility that most can't seem to handle. I'm sorry if I think the people that are supposed to be protecting my rights as an American should be held to an exceptional standard. Ask your students about the constitution, I'd bet the only thing they know is it was mentioned in their oath.

What if you're charged with a misdemeanor, and they tell you that misdemeanors don't typically get a jury trial? If that's a problem, then we can probably sue before the case is litigated, because if they're trying to tell me I cannot demand a jury, or trick me into taking a bench trial, I'd like to file suit. If you want to represent me, I'll take it to trial, and we'll split the winnings right down the middle.

Take a look at (1) Terry v Ohio itself, (2) Minnesota v. Dickerson and (3) Ybarra v. Illinois. These are the big supreme court cases. If you use Google Scholar, you will be able to narrow your search down to whatever Circuit you live in. Take a look and let me know if you have any questions.

I know police officers don't have to abide by no trespassing signs since they are the ones who enforce them. But if a sign was posted that was specifically created and placed there for law enforcement itself would it be valid? Let's say if it was a sign that stated " All law enforcement and government officials must have in possession a sign and dated warrant to proceed further. And that all rights it can be applied are officially being invoked the moment you come on to this property." Wood and could something like that have legal standing in a court of law? If it was properly stated in a legal format And placed at the border of the cartilage and the location that makes it difficult not to notice if not impossible. Would it have standing and give the owners a legal argument in court?

I just love how people watch a 16 minute video about how the details in case can make a stop and frisk legal, but then go on to claim cops never ever are allowed to do what Terry V Ohio says they can. It's almost like they have no idea what they are talking about. Someone being belligerent to a lawful order is a danger. Cause if they aren't going to listen to, "give me your ID so I can write a ticket," then why would it be reasonable to think that person will comply with orders like, "step back," or "don't reach for that gun." I also find it hilarious that everyone that claims "reasonable articulate suspicion" has no idea what that means. You were speeding, RAS to pull you over and detain you, you cause a violation. If you refuse to comply with lawful orders such as "get out of the car" or "show me your ID," then you are obstructing and breaking another law, RAS.
