I don’t like what he started saying at five minutes in that once you transfer your deed, “it’s over”. Although everything he started talking about after that was gold! Never thought about what would happen if they filed for bankruptcy. Good in-depth questions and knowledge. I had to watch it like three times over just to get all those nuggets of information.! 😄

Can this be done on a property if a deceased person who has no beneficiaries? I would never steal from anyone but are there circumstances where it’s legal and ethical? For example: if a person died in 1999, no one claimed it, no family members can be found, the city lost or mishandled the files or something happened where the city didn’t acquire the property… can a person legally and ethically claim or possess the vacant property/ land?

IMPORTANT! I am a New Subscriber.. my wife and me divorced. With a son, 2-5 months after the divorce, she was being forclosed. She was behind 3-4 months.. she said to me,I don’t want to pay this house anymore, I will not pay it no more; so if you want to keep it try to save it from the bank and keep it. I will move in with mom that has cancer. 2 months after she is attack by a fulminant cancer and passed after only 8 months which I spend each day of them with her. When the judge ask her on the divorce; Do you two have any assets or properties to divide, she said no. All o want is my single last name back. Judge said okay you could leave yous have been legally divorced. When she died I were closing a sale on the house when my attorney said to me me: your son appears like owner of half because his mother which you divorced from passed so the 50% is his. I ask and got the living recording of the divorce case in preceded by the Judge. But my attorney saids that it is not valid so I had to back off the deal and still as a disabled senior paying with a SSA check a higher payment. My question; I have a live recording of her answering the judge questions as if we had any property or house to divide ; she expressed NO!!why my attorney saids that with the live recording and judge and witnesses in court names, legitimately presented.. why they will not honor the verdict? If you recently purchased or refinanced the home and your wife wasn’t added to the warranty deed, reach out to the title or escrow company that assisted you with the transaction and see if they can assist. If they can’t assist, you can contact a local real estate attorney to draft the necessary document to add your spouse to the deed to the home.

@@kellyzitlow hi is in California lake Elsinore unfortunately I contact 3 lawyers already but no one take the case cuz the property worth around 70k and they charge per hour around 300 and unfortunately I don't have money to cover the expenses a lawyer a this time that land was the heritage to build a house for my special needs kid

Good video. Sub 2 deals are becoming increasingly popular due to social media influencers. But in some states these deals are heavily scrutinized or regulated. Doing one of these deals improperly can result in heavy civil or criminal penalties. Never see the influencers talk about that aspect.

There is no way to provide absolute protection against someone who wants to commit fraud. Those committing fraud will come up with new and innovative ways to steal real estate. That said, the goal for homeowners concerned about this issue should be to make things more difficult for the fraudsters and have them go elsewhere. Having a recorded document, title in the name of a trust, a loan secured by the property, or an LLC may require more effort to commit fraud and more involvement from lenders and title companies, which will hopefully deter someone from targeting your property.

If you reduce the purchase price, doesn't that help Property tax also, opposed to not reducing overall purchase price

Great comment! Property tax valuations vary across the country. Understanding how market values are driven from your local county assessor will help you evaluate which option brings the best solution!

Bell County TX - In 2019 Whitney Benson forged a document making it appear that my father signed it, in fact he was deceased before she filed the document and filed it against my parents home in Bell County Texas. The house is in Killeen, TX. In 2020 she was arrested with her mother while they attempt to sell it at a title company. She was charged and found guilty, judge gave her probation. In October 2023, Bell County filed a lawsuit against her and her mother for tax delinquency. She just recently retained a lawyer to help her sell the house and wanting to negotiate with me by giving me 50% of the money. First of all, I am not selling my parents' home knowing all of this was fraud. Second, I just want my home back that I inherited from my father, who was a Vietnam veteran. All she needs to do is remove her name off the property and change it back to mine. Simple as that. It is sad there are people who can easily steal your home with a stroke of a pen.

Response from Attorney Patrick MacQueen: That’s a great question. Basically, why isn’t my title insurance company paying to defend my property from title fraud/title theft? Title companies have come up with policies that provide coverage for title fraud/title theft, but these policies cannot be purchased in all instances and in all states. I think the reason that title companies don’t regularly insure these claims is because the title companies have the potential to lose a lot of money by defending the claims. There’s no real avenue to collect from the criminals after the title company pays out a loss.

My fiances mom recently passed, and we discovered a deed that from my fiances grandfather towards my fiances mom. The deed stated that when he passed, she would get his land and rights to sell the oil on its property in Texas, and she gave him $10 in exchange. Unfortunately, my fiances mom and her grandfather had a falling out. She hadn't spoken to him in years. When we went to see on the property after she passed, we learned that he had passed some years earlier, and my fiances mom was never informed. After my fiances mom and her dad became estranged, a special warranty deed was created for a woman her grandfather was dating to get his land and oil with no exchange of funds involed and no notification to my fiances mom who had a deed prior to the special warranty deed. Which deed would hold up as the true deed in court?

Response from Arizona Attorney Patrick MacQueen: Unfortunately, this sounds like it occurred in Texas and would require application of the laws of Texas. Best to speak with a Texas attorney and ask whether written notice of revocation of a deed is required and whether the recording of a new deed somehow defeats and existing, un-recorded deed.

The elderly should always have a close family member help them with selling and buying things after they’re over the age of Seventy!!!!!! So many things have changed which can easily be a huge problem for senior Citizens! Even Insurance companies take advantage of seniors!!!

In most cases, buyers pay their own closing costs associated with financing, title fees, appraisal, etc. The strategy proposed here would be before a seller considers a price reduction, to instead offer buyers incentives toward closing costs or rate buydown scenarios to entice an offer. The net is the same to the seller (price reduction or closing cost contribution), but you may have more buying interest with this strategy as it offers affordable solutions, especially in a high interest rate environment.

By using a Mortgage Service to pay and monitor monthly payments, the lender won't be able to call the Due on Sale, especially if the buyer has the property under an Land Trust. By using a mortgage servicer, with in 12 months buyer can wipe out the DTI, and seller will be able to obtain a loan, because a 3rd party service provider is in hand.

Response from Attorney Patrick MacQueen: These are really 2 different things and serve 2 different purposes. One is a monitoring service; the other is a deterrent. A living trust may deter someone from stealing property or forging documents, whereas title lock will let you know when it occurs.

lol we are solving problems that's what you guys are leaving out, investors that know how to navigate these waters should be the only ones doing these types of transactions. a "regular buyer" isn't typically buying a property this way. and the seller can get the property back with a performance deed and even if you did a wrap around mortgage you still give them recourse. thats not to say all investors do this, some don't have integrity, the only thing you guys are harping is the negative. thumbs down on this video for me.

Im 21 just got my realestate license i’m trying to learn as much about realestate and make comission to buy value add multi family and commercial property’s this video was great because I don’t understand why most realestate agents don’t own any property it’s like working on wall street but never investing in the stock market😂💯

Response from Attorney Patrick Macqueen: An LLC or a Living Trust may be enough of a deterrent to a criminal wanting to steal property. Either of these options requires more “checks” on the ownership of a property and more eyes on a transaction, which may result in someone moving on from your property to another.

That is why a national registry by the federal government is a must. It can have sophisticated software that can scan documents for fraud and forgery. It then can identify the person who provides a special ID that can't be forged when they sign into their account. The special ID can be used at the local recorder's office who have access to the national registry for the purposes of scanning documents into the system.
