A consultation in the GDPR is not the same as a notification and informing staff end users under AI act. It is not an overlap. Similar but the outcomes are distinct. In the consultation, it is necessary to determine the risks and issues with the data processing. Under the AI act it is a communication for the purpose to inform the staff. It isn’t the same. The issue with lawyers talking about this is that they rarely if ever go through the motions of carrying this out and from their perspective it is an overlap. It is not.

Marvelous! The Data Act does not get any attention at all. Even the "big" IT-Players in Germany do not realise that they are affected by the regulation with their online services. Same and even worse with the Digital Service Act. The latter is at least somewhat implementable in comparison to the Data Act.

If agreement is signed bw EU entities but data is processed in third country, is SCC required to be signed as data is flowing from eu service provider to its third country entry
if I understand your question correctly, then the SCC would be required between the EU entity doing the exporting (exporter) and its sub-provider (importer) located in third country.
