If it is a cat back it's not modified, its a direct replacement of the OEM exhaust. If you are driving down the road and bend the OEM exhaust and you get an aftermarket, dose that make it illegal? No, its a direct replacement. Now the decibels are another hurdle LOL Modified implies you took the OEM exhaust and cut it and welded some other parts to it. Ive used this many times, no ticket. I'm still to fiend out if they can search your hood with out your consent. I think its an illegal search
A catback is commonly used to describe an aftermarket "performance" exhaust system, usually mandrel bent, with a larger inner diameter pipe, and less restrictive muffler. This qualifies as "modified". If you replaced a damaged exhaust component/system with a original manufacturer part, or an aftermarket copy of a manufacturer part, that is not modified, but replaced or repaired. I have received so many mechanical violation "fix it tickets" in this state (CA), over the past 29 years, and also have the legal background to understand the law and how it is applied. Yes any peace officer in the state of CA can perform a mechanical/safety inspection of your vehicle if they believe it to be modified or unsafe. The "modified" exhaust in this case, along with the IG handle sticker on the window, and likely the rest of the appearance of the vehicle, including the gauge pods on the A-pillar would give reasonable suspicion that the vehicle has other possibly illegal modifications. Now, say you had locking hood pins and didn't happen to have the key with you... I doubt many cops would forcibly open the hood and cause damage, or follow up further.
