you explain to me why j dilla (and estate) shouldnt be able to legally claim this to be a protected new musical work (his shi in other words). keep in mind section 107 (fair use) and music theory in making your argument. in other words simply saying that it's made from sounds found on another recording and that makes it unavailable for copyright protection and also open to copyright claims against it is not sufficient. it's biased. that's saying that j dilla as a sampling musician has a different standard applied to him than say prince or mtume as non-sampling musicians. allowing non-sampling musicians to claim a song as original (and therefore copyrightable) even when their song is less unique in melodic lines, chord progression, tonic note, scale, arrangement, tempo, instrumentation, rhythm and often even meter than what dilla composed. in plain speak, how is what dilla ended up with here even remotely like the song give it to me baby? if your only answer is well he used give it to me baby than i ask why is that not the criteria for every other type of music? all other music (and music composers) can use parts of melodies, chords, rhythms, instrumentation, arrangement and other musical concepts as starting points when building their 'original' work. all but dilla and sampling musicians. it's crazy. ima conclude this. follow me: so current interpretation is saying thaf if u were to make a song using this (dilla's work) as a backing track dilla's estate would have no legal claim? that's fkd up. somehow this is interpreted as still, in essence, rick james' song. that's a flawed interpretation of section 107. it's actually worse than flawed ...it's criminal.
