In NY state you cannot refuse. It has its own penalties for refusing. However, I guess you can ask for the one at the station too. OR don't drive drunk in the first place.

APPLE TV: Spectrum and AT&T are trying to make VPN’s ILLEGAL BECAUSE APPLE TV recently released an update to Apple TV which allows VPN. I added one and my streaming speeds vastly improved. I pay 300$ a month to SPECTRUM for 1 gig high speed data and they still slow down streaming data. It’s so obvious on screen it looks like 720p. Lip sync issues. But VPN solved all that. Now my picture is beautiful. Basically long story short, SPECTRUM INTERNET & AT&T haven’t upgraded the wires and infrastructure in over half a century even though they’ve received billions of tax dollars to do it. 4K streaming is hitting bottlenecks and clogging the network and thier solutions were to slow down certain websites which they can no longer see sknce I added a vpn to my Apple TV. Which pisses them off because now they’ll have to spend that money to upgrade the network. OR maybe bribe a SENATOR to change the laws so they can keep the network shitty, I mean keep the billions of tax dollars. Makes you wonder how much power your ISP really has over our government. ISP’s like SPECTRUM & ATT take billions of your tax dollars because they are considered infrastructure. BIDEN sent them this money, then he took a nap and forgot to check and see if they were actually using it correctly m, they just pocketed it. Things like 4K streaming are stressing thier networks because the wire that data is running over hasn’t been upgraded in over half a century. That’s called theft ladies and gents😂. Where do you think all that money went if no work was performed to upgrade the network??? That’s right. CEOs gettin rich by bending you, us, over!😢 We should be kicking in thier front door. Think about it. Internet is life, now, almost as much as water, air, food.

Question! How would you argue a ticket this isn’t possible? I got pulled over for running a red light allegedly. The officer told me “it was back there.” On the ticket, it says the intersection I committed the violation was an intersection that doesn’t have a stoplight.Sonic say in court “I didn’t run a red light bc there’s no red light even here” how could an officer argue that?

I bet people don’t know that SPECTRUM intentionally slows down certain data like Netflix or any other type of streaming service. Once I added a VPN to my Apple TV, suddenly my streaming became smoother and lip sync issues stopped. I pay for 1gig high speed data which should be insanely fast. Even speedtest showed my speeds were normal. But LG TVs show you the data stream. If the government and ISPS demand to see inside our internet traffic we should be able to transparently see theirs too. I currently have one single device running on my network my Apple TV and I pay close to 300$ a month for gigabit speeds and they still slow down my data dropping 4K video to 720p and sometimes even 420p if it’s an old show. That’s what should be illegal. I’m paying for one thing and being given only 3.2% of the product I’m paying for. VPN solved that.

Me as a "lay person" knows that § 19.2-59 Search without warrant prohibited always applies when traveling in your car. (at least in Virginia) What will the LEO do when you are pulled over? Ask to see your drivers license, registration and proof of insurance. Hmmm, isn't that a warrantless search? He just broke one of his laws, he is now guilty of the crime of malfeasance in office and subject to punitive and compensatory damages. That is just the beginning of the crimes the LEO is about to commit, they add up from there!

That's a good question. I think the law is that they need probable cause to pull you over. So, reasonable suspicion of speeding or breaking any other law would be enough. But then they would need proof of some kind before you could be convicted of anything. I don't know if they could even write you a ticket without some kind of evidence. Whether that be a reading, you being dumb enough to confess to something, or some other piece of evidence their investigation revealed. Although, if they were driving the speed limit, and you blew past them, that might be good enough.

Some states allow them to pull you over based on suspicion, but it can probably be fought and won in court.

@@KeyshawnJenkins That's what I'm thinking. They can stop you, but that doesn't mean you are going to be convicted of anything. They might not even bother with the ticket and just give you a verbal warning. And then tickets can be fought in court. So, I'm not thinking the legal standard is all that high for writing them. But once you get to court, that's a whole different situation.

Court File No.: [Insert Court File Number] IN THE COURT OF QUEEN'S BENCH OF NEW BRUNSWICK JUDICIAL DISTRICT OF [Insert Judicial District] BETWEEN: ***** ******* Applicant AND: THE CITY OF BATHURST AND THE BATHURST POLICE DEPARTMENT Respondents AFFIDAVIT OF **** ******* I, ***** *******, of the City of Bathurst, in the Province of New Brunswick, MAKE OATH AND SAY AS FOLLOWS: Introduction: I am the Applicant in this matter and, as such, have personal knowledge of the matters hereinafter deposed to, except where stated to be on information and belief, in which case I verily believe the same to be true. I am a disabled and homeless veteran without proper medical support or pharmacare coverage. Purpose of Protest: On or about June 27, 2024, I began a peaceful protest at a public pavilion in Bathurst, New Brunswick, to highlight systemic failures in the support and care for homeless individuals, particularly those with disabilities. My protest aims to address broader systemic issues at all levels of government, focusing on inadequate support systems and barriers to accessing healthcare and disability benefits. Forced Relocation: I was unlawfully arrested, evicted, and issued a trespass order from my initial protest location at the waterfront pavilion. This action forced me to relocate my protest to Youghall Beach, which, while providing access to basic amenities, does not meet all my basic needs as the waterfront location did. It is far from the city centre, limiting access to food, community support, and essential services. Legal Basis for Protest: My protest is protected under Sections 2(b) and 2(c) of the Canadian Charter of Rights and Freedoms, which guarantee freedom of thought, belief, opinion, expression, and peaceful assembly. Section 7 of the Charter protects my right to life, liberty, and security of the person. Events Leading to Arrest: Despite my peaceful actions and attempts to negotiate with city officials, I have faced harassment, coercion, and intimidation by the Bathurst Police Department. This letter seeks to inform you of my legal rights and request your cooperation in allowing my protest to continue without further interference. Harassment and Intimidation by Police: The Bathurst Police Department engaged in coercion, intimidation, and harassment, pressuring me to leave the protest site despite my peaceful actions and lack of disturbance to others. This included repeated threats of arrest and accusations of faking a medical emergency. Assault and Lack of Proper Investigation: I was assaulted by a city contractor, witnessed by a store employee who called the police and provided a statement. Despite this, the police refused to issue a peace bond against the assailant and did not conduct a proper investigation into the assault. Fabricated Charges and Trespass Order: The police, relying on false testimony from a business owner who was displeased with my presence, fabricated charges of mischief to justify a trespass order against me. This was an unlawful attempt to remove me from the protest site and silence my voice. The police conducted a lackluster investigation confined to a single interaction between the officer, the waterfront city manager, and the displeased business owner. They did not interview any other witnesses or business owners, despite my having video evidence disproving the claims of mischief. I extend my accusation that it was planted evidence and a conspiracy among these three individuals. Denial of Urgent Medical Care: Upon my arrest, I experienced sudden chest pains and requested urgent medical care. I insisted that the ambulance be sent to my location immediately due to the seriousness of my condition and my history of heart issues. The police ignored my requests and directed the ambulance to meet us at the police station instead. This was not only distressing but also dangerous, as the ambulance attendant later confirmed that I had previously suffered a heart attack, a condition I was unaware of but which underscores the seriousness of my health issues. Unnecessary Punitive Actions: Upon my arrest, the police fingerprinted and ID'd me, issuing a firearms ban. This was unnecessary and punitive given the peaceful nature of my protest. As an unregistered Aboriginal individual, survival tools, including firearms, are essential for my safety and sustenance, and this restriction may violate treaties with Aboriginal peoples. Correspondence and Legal Precedents: Prior to my arrest, I sent letters to both the City of Bathurst and the Bathurst Police Department quoting relevant case law, including Victoria (City) v. Adams [2009 BCCA 563] and Abbotsford (City) v. Shantz [2015 BCSC 1909], asserting that my actions were protected under the Charter. The police ignored these legal arguments and charged me with mischief to justify the trespass order. Health Considerations: I suffer from PTSD and severe generalized anxiety, conditions requiring privacy and stability. The shelter system is not a viable alternative due to its restrictive rules and lack of privacy, exacerbating my mental health issues. Additionally, the local shelter is over capacity, further limiting my options for safe and stable shelter. Systemic Issues and Immediate Harm: My protest highlights broader systemic failures in providing adequate support for homeless individuals, particularly those with disabilities. The enforcement of the trespass order and my arrest have caused immediate and irreparable harm to my well-being. Abuse of Authority: The city and the police department overstepped their authority by prioritizing the setup of a music stage over my lawful protest. They refused to negotiate, ignored my verbal and written requests, and fabricated claims of mischief to justify my removal. The police engaged in coercion, intimidation, and harassment, violating my Charter rights and causing undue stress that resulted in a medical emergency. The city acted with a conflict of interest, prioritizing its role as a landlord over its responsibility to protect the rights of its citizens, particularly those in the most dire situations. Request for Relief: I respectfully request that this Honourable Court grant an injunction to stay the enforcement of the trespass order, allowing me to continue my peaceful protest. I also seek to initiate civil claims against the Bathurst Police Department and the City of Bathurst for the violations of my rights and the misconduct that occurred. Additionally, I request the destruction of the fingerprinting and ID records taken during my arrest and the overturning of the firearms ban issued against me. SWORN/AFFIRMED before me at the City of Bathurst, in the Province of New Brunswick, this ___ day of ______, 2024.

I must admit, I did get lucky with one of the scenarios described. It was the moving of a court date. I had jury duty the same day as court, so they moved the date. I showed up to court, the officer didn't, and my ticket was dismissed. I got lucky.

An example of misconduct by a State Official that I experienced 10 years ago. I am an over the road truck driver. I often haul refrigerated produce imported from Mexico in the winter and have hauled refrigerated produce into the State of California in the winter before the harvest season starts in California. I have been through California Agricultural Inspection many times with enormous files of inspection and importation documents for produce from Mexico. However one night in the summer where the harvest season is in full swing I was asked to bring an empty trailer that had been sanitized and certified as sanitized by the United States Department of food and agriculture and sealed with a bolt seal and precooked with the refrigeration unit. The empty trailer was for the pickup after a super special load of specialty cheeses. At the Agricultural Inspection station for California the Agricultural Inspector became very upset that I was pulling a sealed refrigerated trailer with the refrigerator running, a sealed trailer that he could not open and no Agricultural Inspection papers other than the USDA sanitation certificat The agitated agricultural inspector immediately began shouting orders to me to get out of the truck and that I was detained and that he was calling for back up. Almost immediately large numbers of California Highway Patrol officers, with their lights on descended upon the Agricultural Inspection Station. Eventually cal trans showed up with a bolt cutter large enough to ccut the bolt seal so they could see the trailer was empty. Only then was I allowed to explain why I was bringing an empty sealed refrigerated trailer with the refrigeration unit running into Mexico. The formerly tense California Highway Patrol Officers now began laughing at the foolish Agricultural Inspection Officer. Even the supervisor for the Agricultural Inspection Station showed up and apologized to me and exthat the Agricultural Inspection Officer had been with them only 4cdays and had been watching too many cop shows and was desperate to make a big bust. I accepted the apology and was now free to go. However this could have ended differently and tragically if any of the very large number of California Highway Patrol Officers that showed up alse had been watching too many cop shows and were trigger happy and saw this as an opportunity to shoot someone. Sadly that appears to be the reason why many innocent people are shot and killed each year by trigger happy Police.

Fortunately Contra Costa County, California, recently paid 8.4 million for the false arrest of a mother and her daughter as they waited in the parking lot of a Starbucks for it to open. This is the amount that should become the standard in all 50 states of the United States of America for a false arrest without injuries and detention no more than 24 hours. Where there are injuries or detention the amount of money needs to escalate rapidly to the tens of millions and hundreds of millions of dollars to make Police misconduct so expensive that the Cities and Counties are forced to stop Police misconduct or go bankrupt.

😮crooked as hell cops there. 4 cops pulled up in a car to steal a guys car that one of them had arrested earlier that day! They all laughed and joked about it... One replied to another "oh, Nobody's going to report this car stolen because the owner I arrested earlier is probably never going to get outta jail! He is going away for a looooonnng time!" I was 2 feet away from these 4 cops on the other side of a a fence... I heard everything...

We found one on an employees car. A PI labeled with his name and phone number and asked for it to be returned if found. The Police investigated and informed the employee that the PI was hired to catch her husband with another man’s wife. Her husband would use her car when he had a rendezvous planned. She divorced her prominent Doctor husband.

Here in NC depends on the docket... If the officer doesnt show, depends on the charges if its reassigned or dismissed. You can talk to the DA, get the charges reduced or dismissed. But just bc the officer doesn't show doesnt = dismissal
