This is not an open and shut case, and making that claim shows how little you know about New York's Civil Statutes. Further, there is no guilty plea in civil in civil matters. Your overuse of this terminology in your argument indicates your absolute ignorance of the US system of Laws. Now the drug found in Ryan's system is not Federally or Locally prohibitive by law. An abstract contract with a Boxing Commission conditions its use. This same Boxing commission argues that it is prohibitive for a fighter to hydrate to a certain weight level after weigh-in. In at least 3 of Devin's fights, he is observed mouthing "you are too small" to his opponents, which suggests his consciousness or admission of "guilt" using the terminology in the same context you did, that he is in breach of the Commission's recommendations on weight rehydration. Since no Federal or State Law prohibits the use of the substance found in Ryan's body, the compelling authority resides in the Boxing Commission under whose auspices the fight is arranged. That body has already sanctioned Ryan financially, so any further sanction will amount to Double Jeopardy. There is a feature in civil law called the "Unclean Hands Principle". It is interpreted as someone seeking redress before a court in an issue the person had engaged in. In this instant, the Plaintiff's appeal to the court is one of redress for unfairness. I believe that Ryan's Attorneys can legitimately argue that Devin comes before the Court with "Unclean Hands" To wit, that he has previously engaged in the same conduct of unfairness in fights, for which he now seeks redress from the Court. Finally, Akhi you need to stop masquerading as an Attorney because of your misconception that Allah provides you with the gift of unearned wisdom. Any matter over which Federal or State Law does not have jurisdiction has to be decided based on an organizational contract to which both parties are beholden. In this instant, the Boxing Commission's rules and authority become the prism through which fault is decided.
