My mother passed away and owned the house she lived in. My sister lived in the same town as my mother. We have a younger brother. I asked to see the will, so did my brother but we never saw it. I asked what she was going to ask for the house and she said, seriously the house has mold in it and we wouldn't get anything from it. It's been years now, neither my brother nor I could obtain a lawyer, we trusted our sister. Somehow she has had her daughter, my niece living in my mom's house since her death. I've done satellite images of the property and it's immaculate and increased in value. I don't want to cause any family issues but frankly, it's down to self worth and to stop someone who's apparently so selfish. She presently has a large beautiful home herself, while I had a house fire, nothing but social security and living in an unfinished little house. I'm not playing the victim role, I've carried my weight and made my life work. However sparce it may seem. My vehicle has died and I'm shopping around for something reliable but cheap. If my mother was here, she'd certainly see to it that none of us would be left out of her will. Especially when some are in need of just the basics. I don't know how to go about approaching her. Maybe I should just let it go, as I have been.
The representative comes out on top. Especially if there is only the two of you. The beneficiary can't afford an attorney. Better to have sold it to make sure you get your true market half
I know it's off topic, but can you do a CA intestate video where heirs can say keep a hous but split ownership unequally? As far as I know this is done through an Agreement Letter and the filed with the court. Then you get a hearing so the judge can approve it. The finally a Final account and Distribution hearing. Thanks The only website I've seen with this is Hackard Law.
My xperience, an executor, my own family sibling, he turned out to be a thieving criminal, ev en lying that there was a will, basically he wanted everything for himself. quite nasty really. terrible experience, reminds me not to make such mistake.
Executors and Trustees can be very cruel. They have complete control over the estate and can keep all assets entirely to themselves if they choose to do so. Beneficiaries are powerless against a Trustee and should be aware of that before challenging a Trustee.
The first vultures that have planned to make all else involved look like an undeserving pos and then make false allegations or defamation of character. to demolish anybody in their way!! The same vulture became POA 12 years before the deceased retired. The same vulture forged public notary signatures to buy and sell properties of the unsuspecting victim. And then caretake to hide all this abuse. This is how realtors take advantage and think it is legal and they are so deserving to sell properties that were not supposed to be sold.. These vultures are thieves and narcissists and feel entitled. Your voice speaks a lot of wicked property heist for self profit and very little to say on fairness to all involved.
I have one of the family saying I messed up my inheritance time the other half saying that there’s nothing there for me and none of it is making sense and I don’t even know where to begin to work. I’ve never doubt with this and I just know that everyone is either trying to cause confusion or trying to cause me to react and it’s been quite some time…. It’s not about things to me. It’s about principle and not being misled especially by people I’m supposed to turn to or should be able to.
Hi this was a very well informed video. I ran into this same issue on my rental property as tenants vacated. Very strong odor and lot of pet stains noticed under the UV light. Now I removed the carpet & pad completely. I bought Kilz Restoration Max stain&odor blocker. Question- Can I simply apply this primer straight on subfloor Or do I need to do any baking sode/vinegar/enzyme type treatments to subfloor first before paint? Would really appreciate a prompt response. Thanks
It is foolish for people to put offers on houses that they, themselves have not done the detailed inspections on. Why put an offer and then hire someone else to do the inspection. Waste of time and money.
My tips are: The owners need to be there when the inspector is there. There are many things that the inspector has no idea about the whys and the hows of the house. The inspector will make uninformed decisions and opinions. The inspector said the hot water was only 96 degrees and it should be over 110 degrees. But he didn't know that after I moved out I turned the breaker to the hot water heater off so ambient air would heat it and it would save electricity. No one is taking showers. But he didn't know that because he didn't consult with the owner. Also water temperature is an opinion. 96 is good for washing dishes, but 110 is too hot to wash dishes, unless you use a dishwasher.
California does not have a state-level death tax or estate tax. The state abolished its inheritance tax in 1982 and has not imposed an estate tax since 2005. However, residents may still be subject to federal estate taxes if the estate's value exceeds $13.61 million in 2024. While California does not tax the transfer of estates, the probate process can be costly and complex, potentially incurring significant fees.
Shut down the IRS. Clear all the 😢 fees and debt that IRS is harrassing citizens for. Do tax reform and create a new system where there is a state contribution and a national contribution where each is capped at 5%. The 10% total will be withheld from employees pay and there will be no filing required. 2. Eliminate mandatory car insurance in all states or create a permanant cap of $50 per month. 3. Scrap that food price control and focus on home and land price control. Grant an automatic 15 year building permit to every individual purchasing a minimum of a quater acre land, so that individuals can gradually build their home over time without having to take out large unwanted high interest loans. 4.Capbproperty tax at 0.5%
My brother bought me out, he wanted my parents' house. It wasn't hard. He paid me half of what the house appraised for. It was written in the papers that went to probate. My dads will stated that we were to split everything 50/50.
People make this sooooo complicated. Without a buyer, or excepted offer, there is no commission. The buyer ultimately controls everything. In the agreement the buyer needs to make sure the verbiage indicates “X commission to be paid to (buyer agent) by seller out of sellers proceeds at closing of X house and be sure the agreement expiration provides only the time needed to make the offer. Let the agents hash it out. Make your offer, stick to it, if the seller counters, you either want the house or you don’t. The agents either want the sale or they don’t. If not, move on. The problem with commission isn’t that they’re to high, it’s that consumers allow it. 🤷♂️
All compensation is determined by the buyer and seller. If a seller doesn't like the offer they receive due to the buyers agent compensation then they can counter it or reject it. Previously, the compensation to agents was predetermined by the seller when they signed a listing document with their agent. Now, the buyers have to make an agreement with their agent, and the sellers have to make an agreement with their agent, and if the sellers agreement states "no compensation" to the buyers agent then the buyers have to pay their agent what they agreed upon. Unfortunately many buyers are already struggling to cover all the other costs associated with purchasing a home, so many wont be able to afford to buy a house without seller agreed upon buyer agent compensation.
Hi Dolores, good question, this depends on the area you live and what the guidelines are for that location. Here in San Diego a will is not required for going through probate, but the beneficiaries would be determined by or local intestate succession laws as there is no will to determine who inherits. When a property is in a trust probate is usually not required. You could determine if probate is required by speaking with an estate attorney in your area, good luck to you!
Here’s my situation. Mom gives ownership of house to middle son. Middle son passes away 3 weeks before Mom passes. No wills for both and no executor for both. Younger son wants to come stay in the house for few months and was welcomed by middle son. Older son has changed locks and will not give up the key. House is paid for and dad passed away first. Any ideas??? Thanks
If a buyer is not able to afford to pay their own agent at all then they probably should not be buying a house. We have to start getting out of the mindset that it is the seller's responsibility.
This is all giggery-pokery nonsense, designed by PG&E and other big land owners to keep their taxes low. We should tax land, not people and houses. en.wikipedia.org/wiki/Land_value_tax
In my experience the sellers realtor was a referee trying to convince both parties that It was a good deal for both. It is called' bid and offer' and always has been.
Not leaving my home to my kids. Reverse mortgage and when I'm gone it will go to whoever. Why give CA anything more. Newsom and Brown truly ruined this state. Oh yes, that action actor of predator too. All idiots of the NWO.
the way I am hearing (as a CA resident and home owner) prop 19 did exactly what it was supposed to do. Limit inherited benefits, trying to fix distorted market. Good.
