The police are trying to build a case against you and anything you say can and will be used against you. I exercise my 5th amendment right to remain silent.
I agree with everything. However, my friend was pulled over in November 2023 and charged with DUI. He was initially pulled over for swerving, and the cop said he smelled alcohol. He refused everything, even the breathalyzer at the police station. They told him he would lose his license for a year and would get other charges for refusing the breathalyzer, but he still refused. He went to court in May of 2024, and his DUI was dropped. He got his license back that day and had work privileges the entire time from the stop. I know the implied concent laws, but the cop was telling him all kinds of BS trying to get him to blow. I can't imagine it was because he didn't want to see him lose his license for a year. Like you said, the police are liars and will do anything to get you to incriminate yourself. This was in Ohio for what it's worth.

This happened in NH after many years ago. A man was drinking at a bar. After about 1 0r 2 blocks he legally parked the truck he was driving. He had his ten speed bike in the back of the truck. He thought it would be better to take the bike home. The police stop him & asked him whit he was doing . He said he was going home after he left the bar. He told the offer at the was at a bar & did not want to go after he had a few drinks. He was given a DWI & was arrested.
You also have to make sure that you verbally state you are staying silent and invoking your fifth amendment. Don’t just stay silent and not say anything as that can also be used against you.
After submitting to a breathalyzer in the police station burp every couple of minutes. They have to observe you not burping for 15 minutes prior to submitting at breath test. If you keep burping it will prevent them from doing an accurate test.
So I definitely don’t know how I got off but I was pulled over in Michigan in Auburn Hills. The officer said I blew a red light, speeding and swerving. He asked me to perform FSTs I did and then he asked me to take a breath test I also consented I blew a .073 but then he said I could drive home which was like 2 mins away and he would follow me. He didn’t even follow me all the way back to my apartment. But what was weird is that he had a 2nd officer there because I assume that’s policy of DUI stops but I’m just confused why I got off
What if you haven't been drinking? It seems like invoking you're right to remain silent will just escalate a normal traffic ticket into suspicion of DUI. I've been pulled over dozens of times and don't drink and drive, but never once was asked if I had anything to drink, but I did talk to them politely and honestly, and was let go for speeding offenses more often than not.
Traffic crimes are a tax on the poor and working class. Every jurisdiction has a quota of how much each officer has to rake in and officers face dismissal if they don't make their quota. If it's your turn to get screwed over, you better have a money tree in your back yard. Judges don't come cheap. If you can't afford to bribe the judge, you are toast. Putting up a defense only makes it worse. Remember this is America. You have no rights, but the cop do - along with qualified immunity for any blatant wrongdoing.
WITHOUT A FIELD SOBRIETY TEST. POLICE WILL HAVE TO BE SURE YOU ARE OR THEY WILL B LIABLE FOR REIMBURSEMENT OF YOUR TOWED VEHICLE IF YOU PASS THE TEST AT THE STATION.
I got pulled over luck was on my side for i got a good cop. We did the test but the breathylizer blew .05. The cop told me my cooperation would go a long way. He made an arrest and told me to take a cab home and pick the car up tomorrow. The cop didn't help the prosecutor. The cop never showed up in court to where the judge grew annoyed with the prosecutor he dismissed the case with prejudice. I never got a chance to thank that cop.
If you are strong enough to resist talking ur ride will suck and they qill probably blast the heater or ac on u to be jerks but they wont have anything on u when u see the judge
I never drink and drive. Hence, my answer always has been and will be, "Officer, I haven't been drinking; I don't drink." Regarding FST's, my answer will be, "I am refusing these tests based on my 5th amendment rights. Those tests are too subjective and unreliable anyway. If you have a roadside breathalyzer test, I am willing to submit to that."
My ex-wife developed (very) late onset schizophrenia in her mid to late forties which to this day is relatively untreated. About five years of trying to get her to help herself left me at my wits end & we got divorced which on some level she accepted and understood. I stay in contact with her because of our son. Glad you included the caveat about both parties needing to be willing to work on a marriage but in my case I’d say that both need to be ABLE to work on it.
