It is not about discipline because of a “IEP” but rather protection from a suspension when the behavior that is suspended for, is a direct manifestation of their disability. I understand the school has the right to discipline anybody for any reason, but what about a child’s right to be protected from suspension if it is manifestation of their disability? Who gets to decide whether it is or isn’t? And can it be advocated to have that applied to the IEP? Knowing that it’s case by case but a general idea would be helpful!

Thank you so much Ms Pam! This was an eye opener for me.My child will be a Senior in August and I am so scared for her.I am not that familiar with an IEP.I never thought to compare an IEP maybe that is why my child is not doing so well.

What if I had to fight the school to even do the evaluation, even though I had my son evaluated privately and they determined that he more than qualifies for an iep. So what do I do if the school says he's not eligable

Where does a parent get the evidence that the child was picked up due to school calling if those sign out sheets are discarded? The reasons/early dismissal are not stored in the child ESE file. There are only two reasons "unexcused" and "excused" that are logged into the computer does not go into further detail. So essentially the parent has no proof.

In addition, if the parent asks to write up an incident report, the principal denies to write up an incident report because that is up to the discretion of the teacher and principal and no law says they have to.

What should a parent do when a younger elementary child has an IEP and Behavior Plan but the school is hiding the behavior problems/being disciplined at school and not calling the parent or sending the child home? Child complains multiple times per week when they get home, and teacher denies it happened. Child continues to be disciplined in harsh ways (according to the child) and again teacher denies it. Data is not collected because teacher does not log the data. District BCBA, Psychologists, other professionals observations discipline is not logged because the teacher does not do it in front of them or they don't capture the behavior at the time of their observations. Child begins to suffer silently, anxiety, shuts down, refuses school eventually. During future IEP meetings with district staff involved and parent expresses concerns, supports are denied because the teacher acts like everything is fine and there never any data to support the need or add supports.
