So i got my first and only ovi 2years ago.....i had a previous charge years before but was notban ovi...but it did inform me of laws...when i did get my ovi...it was at night....cars flying by...when the cop asked about tests i said just give me the breathalyzer...i had zero interest of performing these tests on the side of the road...i knew i was guilty...so i was compliant when they arrested me and later did a blood test..worked out for me a little...a little was something....just comply with law enforcement...life is so much easier
agreed. got pulled over for my license plate light being out. I had a couple drinks. Cop asked me to do breathalyzer and fst, i complied, i blew a .08, and i was issued a paper arrest. the officer parked my car in a parking lot for me, and then drove me home. He also didn't show up to the dmv hearing, and my charge was dropped therafter. I am certain that if I had refused or gave him a hard time, i wouldn't have been so lucky. That was the last time I ever drove even after a sip of alcohol.
It is the DEFENSE attorney to get the defendant from getting convicted PERIOD ! do not say this crap about the constitution , I have seen lawyers get up in front of a seated jury and try his best to convince the jury . that the FACE in the video of the drug deal . where his client was seen making a drug transaction with a undercover narcotics agent WITH AUDIO , where his client is called by NAME. That lawyer smiled at the jury and said that was not his client, Other than public defenders who would have not taken a case like that to trial BUT A PAID lawyer will make false claims and lie , They are in it for the money the more wins the more clients he or she will get , so stop with the morality crap nobody buys it . 30 yrs in law enforcement ( retired ) last 18 as Detective . I saw it too many times.
I just don't trust them.... I feel like they're just going to legalize it but figure out a way to have control over it and just because we all want it to be legal so bad we're going to give them way more control than they ever should have. This is what they do they have something that people want and then they attach a bunch of stuff that nobody wants to the back end of it so when we all vote Yes to legalize marijuana because we want that we end up also having a whole bunch of other stuff come through the back door and I guess I'm just trying to learn if there's other stuff attached to this or if it is just what it appears to be at face value and nothing more. I really really want to support this and see it get past I just do not trust the government to be forthright and open about everything. If I could have it the way I want it I would just have it completely decriminalized and leave it at that. Let people grow their own. And if they want to share it with their friends it's up to them just like if you're growing cucumbers or anything you grow in a garden this is the problem they try to control everything they hate giving us freedom
You *DO NOT* have to be polite to the cops. All you should usually be is *matter-of-fact* & calm. They *don't deserve* politeness -- no matter the rayce or gender of the cop -- especially if you are Blk or Brn. I have *never* been polite to a cop. I don't say, "Hello Officer", or "Good-day", or "Thank you", or "Sir", or nothing like that. Do not volunteer *ANY* information, no matter how casual. You don't know how it can be used or twisted against you -- especially to falsely "justify" further detainment, or ramping-up false pretexts, or in a false police report. Do not let the cop(s) *bait* you into a chit-chat, or verbal back-&-forth, or "cop-splainin'", or argument (that's what happened to Sandra Bland). Explicitly invoke the 5th, & 4th, & 6th, as necessary. Other than that I literally don't say *anything* over a simple traffic stop. If the cop does not immediately say why they stopped me, I do ask the cop -- for the record -- so I can have what the cop *initially claimed* -- if I later challenge the case in court. Even if I have to sign a citation I just take it, sign it, & hand it back silently. And -- *for your own safety* -- *especially if you're Blk or Brn* -- limit your exposure to the cops, when pulled over, by having all your required driving documents ready, if asked, for a simple traffic stop, so that -- *again for your own safety & to get yourself & those in your vehicle out of danger* -- you can be done with the cops & on your way as soon as possible.
I got arrested for a DUI in April for an accident that happened in September of last year via blood test. But my license is still valid and I already completed the DUI school as a precaution and Care classes.. it was a felony DUI bc someone got hurt and I haven't been convicted yet going to try for PTI. Was weren't my license suspended.

I have no experience with any of this, but am wondering: Does a defendant have the right to appear in person for any/all hearings rather than using ZOOM? It's hard for me to imagine that using a certain piece of private software is required or codified in law, but I don't really know. By extension, does this mean that having and using a cell phone is now required by law?

This is the category tied to Vanessa Rita Wilkomm and her mom Olga Jansen now in Fayetteville GA and ATL previously in Gainesville, Jonesville, Jacksonville FL selling weight and using state government resources to silence and or abuse their minor children as a organized crime. I do not know exactly how they are doing it but her mom is tied to DCF and Vanessa is a drug dealer who sells weight in fancy neighborhoods such as hail plantation and Hamilton heights and the greens at west end and NW 16 near Westwood Middle School and Westside Park. So the sales are larger amounts and less policed areas. I guess kinda have to know a person who knows a person. Well Vanessa was my drug dealer from 2009-2010 while the guy who was abusing me and had abused me from age 13/14 to my mid 20s was in prison. He was extremely controlling and I started picked up my drugs from Vanessa during that time because he was not there to control me and or get them for me. Vanessa was jealous of my babies and me and the small apartment and jewelry I had. I guess she was also fucking who was abusing me??? What else would it be?? Her trying to take over another drug area??? Idk But she lied to Robert Rush that I sell drugs to her when she was busted. Robert Rush sent her up to ATL and my babies were taken from me. Vanessa been a drug dealer who has never gotten charged yet people loose their families who either rent hotels from her or who have met her or people she knows. What do they use her to gather names and numbers and then make hits as to who is going to give them the most controls and money or “best move”? I lost my kids because she lied. That is anything but protections of children and legal conduct that protects and serves the community it is intended too. I don’t care what her address is on her ID she is thee from selling drugs and making social ties from having extra money to have a nicer position while people are struggling to get out of those positions and also being abused and trying to go to school or work to eventually get away from those matters and who are getting framed in all those government corruption and rich kids privilege ENOUGH IS ENOUGH.

John Morgan is pushing the lies about legal pot cause he has big money invested in growing pot, not because he cares about people. Only 24 states have legal recreational pot not most states like the lies in the commercials. Morgan would be happy with more people high and causing crashes to boost his law firms business

1 referendum can’t address everything because of single-subject rule, 75-word summary limit, & need for clear language. That’s why the referendum is limited. A previous referendum that included personal cultivation was rejected by the Florida Supreme Court. In South Dakota, their referendum was overturned after passing because of single subject rule. If you’re waiting for 1 referendum that does everything, you will be waiting for eternity because it’s not going to happen, because if referendum rules. And if you’re waiting for the Republican legislature to do it, that’s also not going to happen. Best of luck with your unrealistic expectations. 3 is a step in the right direction. “No home grow no vote” is like saying you wouldn’t vote for medical because it’s not recreational.
No it’s not. Existing stores have a head start because they already have licenses. Additional licenses would be up to the legislature. The referendum has to do with legalizing cannabis sale and possession for adults 21 and older. It has nothing to do with eliminating competition.
I am voting NO on this amendment. And, I will rush to the poles to vote AGAINST it. Pot Stinks. End of discussion. And anyone who smokes it is disgusting & gross.

Great question. It depends on the State you are in and what statutes govern as well as the facts surrounding the answer. In Florida, 837.05 govern, false reports to law enforcement authorities. Also, a prosecutor is who would be the one to decide to prosecute if there was a potential violation of the law.
Any answer to that question other than a firm "No" will mean that the officer has to assume you have indeed been drinking and he will start the procedures for sobriety test, etc. If you sit there and refuse to answer, the officer will take that as a "Yes."

It's not up to the defendant's counsel to assess his "guilt". The COURT does that, IAW due process. The defendant's counsel is there to ensure that due process is scrupulously observed, so that their client get as favorable an outcome to the matter as his advocacy can render. No attorney should feel any hesitancy to represent clients they "know" are probably guilty to some degree of what they're accused of; if they do, then they ought to recuse themselves and have their client represented by another attorney.
Hold on a second, even if a police is recording, NEVER ASSUME IT IS PRESERVED, this was terrible advice from this lawyer. Many times in the USA police officers dump the recording data or pieces go missing. NEVER RELY ON THE POLICE CAPTURED VIDEO. 1st amendment protects recording police in public settings (if its you or someone else being arrested). Keep in mind you can not interfear (Which is defined as a PHYSICAL act, not a verbal act)
