500,000 for a condo? This has to be satire, right? I bought a 1955 house in a safe area of Palmdale 6 years ago for 255,000 within 2 miles of two beautiful pools I can swim at and 2 parks. All the stores I could ever want around the corner and the other way is completely rural. Why would I live in Inglewood? This has to be a joke right? The buyer will be upside down on this very soon. Also there is probably an HOA and they are a nightmare. Can you even have pets??

While Palmdale offers great value and space, Inglewood, especially with its proximity to major developments like SoFi Stadium, has seen increased demand and appreciation. Buyers in this area are often drawn to its central location, easy access to Los Angeles, and the exciting growth happening in the community. Also, if you work at LAX, living in Palmdale may not be your best option 😉.
I'm begging anyone out there to watch out for probate attorney Lisa MacCarley. This demon here settle my father's probate court case December 12th 2019, without my permission on top of it she lied to the probate court judge and told him that I gave her permission to settle the case I never gave her permission to settle my father's probate court case but it was only by the grace of God that I ordered the court reporters transcript record and it was reveal to me that she never even entered my father's estate into the trust proceedings so now I'm able to attempt to get some type of of a relief from out of the probate matter I'm just saying hey watch out for her, if you do hire her I'm telling you watch your case watch your back. Basically you have to stay in contact with her 24/7. The sad thing about this whole incident is that she settled my father's probate court case so that she can rally for Britney Spears now look at Britney Spears. This attorney needs to mind her own business.

Question (maybe you know) So my wife's mother's trust lists my wife as beneficiary (there are no other children or husband) So my wife will receiving everything in the trust, including the house. So no issues. We live with her mother to take care of her. *been so for about 8 years to date When my wife's mother passes, we understand the DOD appraisal. When my wife goes sells the house (let's say in 1 year from DOD) if we have capital gains (difference from sale price and DOD appraisal) does the tax exclusion for capital gains ($500k for married couple) apply to us? Or does my wife actually have to be in possession of the house for the 2 year min after it's passed down to her? Make sense? Thanks :-)

Let me preface my answer by saying that I am not a tax professional, this is not tax advice, and you should consult with an expert, etc. 😉 Now that we got that out of the way, it sounds like you have a pretty good understanding of how a step-up in basis works. As of right now, the home is owned by the trustor or settlor of the trust. Once the trust "comes into effect," you would get a DOD to determine the new value, effectively resetting capital gains. Only then, your wife becomes the owner. The house is now her primary residence as an owner. The way I understand it, this is when "the clock starts ticking" for the 2-year period needed to obtain an exemption. However, in 99.9% of cases, this would be irrelevant because appreciation would not be a factor if you sell within one or two years, as you have suggested. Please keep in mind that there are a lot of moving parts involved here, namely how the trust is structured and how the property is currently vested. Vesting is key. @@matiasbroker Thanks !! Makes sense. Just wasn't sure if there was some "loophole" with regards to trusts, DOD and currently living in the house. And any profit will go by the capital gains tax chart. Even if from DOD to sale we see a $200k profit, the tax implications are FAR less then if we had to pay if we didn't get that step up in basis. I get it... and I did ...but just to keep things into context, this was in the middle of the lockdown so we were working under pretty strict restrictions. But they did get to see the house as soon as I was done recording.
