If everyone did that, they'd be standing there guffawing around, completely helpless. Further, the U.S. Supreme Court has agreed to hear oral arguments on the matter now that the Sixth has ruled...and good luck getting that Gestapo mandate past five conservative justices. Our bodies, OUR choices -- not some unelected sock puppet and his political class.
My second brother was in a nursing home. After catching Covid19, he was sent to the hospital five times. Several time non-responsive and the nurse and cna often did not know his blood pressure or sugar levels. He has underlying HP and Diabetes. So as he was released to the nursing home; I already knew he was to weak to release him. So he was bouncing back at forward from nursing home to the hospital. The nursing home never let me talk to their doctors.
I am in Louisiana my brother worked as a city worker cutting grass. He had underlying diabetes, disability. He contacted covid19. Then he had entered the hospital 2 more times having 2 heart attacks; the hospital sent him home with a heart vest connected to a cell phone to jump start his heart. He entered the hospice and deceased on Aug. 25, 2020. This is not a law suit.
Just because you have a mental health issue doesn't mean you shouldn't be able to do things like take a vacation, which could actually be good as part of a treatment plan. If an employer has an issue with seeing a mentally ill employee having fun, that's the employer's personal issue. Are depressed people to be sentenced to house arrest? How does that help them? Even at Disneyland and posting FB updates about how much fun you're having may mean the employee is not going to share all their struggles on FB. Be careful about the assumptions you make. (Imagine being on leave and living next to your boss. It's happened. It makes it even worse.) Also, even people who are jerks may still also have mental illnesses.
I had a team once that made a game of debate politics and using me as a tiebreaker as I was the only independent. We were always careful and respectful. I appreciate that was a rare group.
