Even though the Lawyer addressed a lot of the issues intelligently and convincingly , may I express my 'reservations on the interpretational approach to VDMs remark. When VDM said "which I do not believe", he simply gave Bobrisky the benefit of the doubt until otherwise proven. Thus, even though he had nothing to rely upon at the material particular other than evidence of the voice note, he assumed, on the 'balance of probability," that the voice note he listened to was indeed that of Bobrisky conversing with another party. It doesn't mean he, knowingly, published the tape recording knowing it to be false. Rather he beleived it to be true at that material particular. Again, you failed to emphasise the public interest element' which made disclosure of such information of utmost importance at the material particular. Suppose, for example, the allegations made by VDM turned out to be true: is it right to jettison an obligation to the wider public for the sake of vested interests? No convicted Nigerian deserves standards of treatment any less than that afforded to Bobrisky.
You aren't the Court. Thank God you acknowledge that by saying: " If the Court agrees...." The onus is on the plaintiff and the defendants to produce evidence to the judge(s). Let the case begin!

Look this lawyer quote law as if law exist in Nigeria. In Nigeria law is meant for the poor to obey. The rich are above the law. What the lawyer is saying now is like a car had accident. The law left the reckless driver to go free and arrest the passengers. VDM is the passenger in this context
