thank you so much for this info, i have a question my mom came to visit 2 yrs ago and stayed i file her last year when i became a citizen she got a social ,work permit but the denied the green card, should i file a I-601 for her? I ask this because a friend told me i should've file the I-601 with the I-485 adjustment of status,

Has this changed yet? My husband is now able to come to the States with me on his regular tourist visa as an unvaccinated individual. So does that mean this also no longer a requirement if we want to move back to the US and apply for a change of status for him to join me in the US permanently?

Is there a realistic chance of approval? Also, my DS 2019 mentions being subject to the 2-year home residency rule. Would love your thoughts on this!
If a program is sponsored by the US government the no objection waiver will most likely be denied with some exceptions. The Hardship or Persecution Waiver may be good alternatives.

Hi, My first visit to the USA was at NASA as a government scholar funded by the US Department of Agriculture, specifically the US Forest Service International Program under the SilvaCarbon program, which is funded by USAID. On my DS-2019 form and visa stamp, it was indicated that 212(e) is applicable to me, even though I have never served as a government employee in Bangladesh or held any private job there when I got the fellowship. At that time, I was in the initial year of my PhD program at Kyoto University in Japan. I have applied for an EB2 NIW (National Interest Waiver), which may be approved soon. Additionally, I have a pending job offer in PDF format from Purdue University, which is currently on hold due to the aforementioned issue. Elis Porter mentioned that there is no chance for me to avoid the 2-year residency requirement in Bangladesh, while Chen suggested that it would be very difficult for me to obtain the waiver. Was their assessment correct, or do I still have some hope? I am currently living in Hong Kong. In total I have stayed in Bangladesh around 4 months. Do you think I can get waiver on the ground of No Objection Statment from Bangladesh.
My friend came here on a k1 fiancé visa and got a divorce before receiving his 2 year green card, this was back in 2012 or so. So technically he has overstayed until now. But in 2020, he got married to USC and have a 3 year old child together. So, in your opinion, is there a way to help him stay in USA? (for example, filing 601A waiver?, filing hardship for his wife and child if he is deported?) Are there any avenues that he can try to get his green card?
You can start with evaluating whether you are subject to the two year rule by reviewing your DS 2019 and your J1 Visa Stamp. What country are you from?

Quick question, the no-objection waiver, I am presently on my 3rd year as a J1-visa holder. I have confirmed that I am not sponsored by government branch or agency. Which organization or branch of government is best for me to get the no objection letter from? Is it Ministry of foreign Affairs, Ministry of Education, or the teacher licensing agency in my country Nigeria?
