I remember this specifically from my business law class in college. Agency Law in Federal Code. A principle (the broker) is responsible for the actions of its agent (after hours team) if it can be perceived that the agent was acting in the scope of his or her duties. The after hours team answered the phone, qualified the carrier, sent the ratecon and dispatched the load. Whether the after hours team was actually authorized to carry out these duties is IRRELEVANT. That contradiction is an issue between the broker and the after hours team. The fact is that the carrier had a reasonable cause to BELIEVE that the after hours team WAS acting in the scope of his or her duties. The reason that the law was passed is precisely because of BS like this, where the principle claims ignorance. This is an easy a SLAM DUNK for the carrier. And SHAME on that broker. Hands down the biggest scam in this industry. Lumper fee inflation is out of control, 75$ is unheard of now. It's more like 250-500$ for a full trailer. How the **** do you justify this? Last I checked forklift drivers make around 25$/hour. Seems to be more of a problem in California, and I don't understand why shippers and carriers put up with this garbage

I work with them often and he is right they will always tell me before hand who the carrier will be and if they change the carrier they give me a heads up and will ask me to assign ot to the correct MC number!

This is not just a customer service issue. It is a matter of safety I think that facts matter. I think it is reasonable to dig a little deeper What was the intent of the carrier at time of pickup? Was the intent for a solo to run as a team. What did the Carrier tell the driver about the load when dispatched? Would running this load with a solo violate hours of service regulations? If so, did the driver alert his company that taking the load would violate HOS regulations? Why are these important elements to consider? I think former FMCSA Acting Administrator Scott Darling said it best: “Any time a motor carrier, shipper, receiver, freight-forwarder, or broker demands that a schedule be met, one that the driver says would be impossible without violating hours-of-service restrictions or other safety regulations, that is coercion” No shipper, broker or driver should ever feel compelled to bypass important federal safety regulations and potentially endanger the lives of all travelers on the road. So, to properly ascertain a fair decision in the matter in my opinion, we must determine whether any of the acts of the motor carrier violated 49 CFR para 386, 390.6 or other regs www.federalregister.gov/documents/2015/11/30/2015-30237/prohibiting-coercion-of-commercial-motor-vehicle-drivers

As one broker said : I will not wait for a repair receipt even 30 mins , I leaved a report on carrier 411 because I love when the people are moving … where is a platform for carriers to report that kind of dirt ? As Denis said , at your platform at least you have a chance to text/talk with someone regarding reports . Thanks for that and good luck )

The only critical document that a broker needs after a load is complete is the POD. The invoice should be up to the carrier's discretion on when he wants to send it. After all, the carrier is the most interested party when it comes to the invoice. What if the carrier doesn't feel like billing the broker yet? The shipper doesn't receive the invoice; the broker does.

I personally don't care when or if the carrier will submit their invoice. As long as I get a clean POD, you can be sure that I won't bother any carrier. Especially when there are owner-operators that are on the road all the time and don't have time to get it submitted. Must be a crooked broker.

I would like a little clarification. Do the carrier terms or ratecon indicate when the invoice is to be provided? You need a starting point to actually know if he’s late because they are suggesting then that the invoice is due the day you deliver. That would be unusual and so you need that information

@@carrierassure I am still not in agreement with your statement. I listened and watched again. She stated that the carrier may be charged 150 per day for late invoices from the date of delivery. I go back to my earlier question. What was the date the invoice was due? Saying “from the date of delivery does not mean that is the date it is due. It needs to be stipulated correctly, or they have no leg to stand on. Especially since if they are implying that the invoice was due on the date of delivery, that is out of the ordinary and unusual, therefore it needs to be clearly noted. If you really are carrier assure as your name tag says then I believe you should pay more attention to these details before posting results of your analysis for carriers to see. You can’t go to court with an ethical argument. I am offering you a legal argument which is what is required to show these brokers are playing fast and loose.

READ WHAT YOU SIGN. If you can't comply talk to your broker BEFORE you sign the ratecon and GET A WAIVER BY EMAIL. Cassandra there are large companies out there that do this AND with the advent of same day pay or many of the quick pay programs IT COSTS MONEY TO GET MONEY that quickly and some of the carriers will blow it off for a week or two and sometimes longer. Part of being in business is getting things done in a timely manner. If you can't then you need to fix your business or get out of business.

Is Florida required for brokerages to check for safety carriers that started new less that 3 months ago and hired a family friend as opposed to do interviews and hiring the most experienced drivers with safety history.? Is it required to do preemployment drug testing. Also he had his girlfriend as a passenger without the owner knowing. He is married. They committed perjury in their depositions. The owner stated the trailer was empty while the policy office said the truck was fully loaded. I have suffered traumatic injuries requiring surgeries. After enduring pain and suffering I suffered mentally requiring intervention. My life has been altered forever and I will never be the person I once was. I have to succumb to my physical limitations and have had to adapt. It has impeded my personal life and most certainly my NICU career.😮

Tql is not good I won’t recommend it. We have a Lotta issues with them. They find a way to not pay you the rate, make sure you read the bol and the conditions do not deliver somewhere else if the bill of landing it’s not correct you’re not obligated to deliver different places if the bill of landing don’t have the correct address

Cassandra, My dispatch and myself have tried to reach you since may. We are being blocked by over 10 brokers and not getting any work from them because there is something on my account. I have been in logistics since 10 years and opened my trucking company with my father 3 years ago. we have 12 units and specalize in US mail and fedex Freight. We are based out of Fishers, IN. Please let me know how we can get in touch with someone at carrier assure because no one is responding to us since last 5 months attempt. I would like to clarify any issues and prove that we are a legit company, you are welcome to come check out our operation anytime and we would love to work with you to fight against double brokers as I have also been burnt by it many times in last 2 years. can you help me . i was acting as the load broker sold load . carrier picked up load for me then called next day load was stolen from carriers yard i present them official claim for $19000 customer send me . i did not get single email from the carrier so i send claim documentation to carriers insurance carriers insurance responded that carrier is not communicated with insurance and adjustor will close the claim if carrier will not respond what to do now . i do not have they call that contingent insurance .

TQL is taking our money for "Claims" that product was damaged and our drivers are not allowed to touch the product or be on the dock. So, we do not even know the product was damaged. But according the TQL Contract, they can just take our money and NOT Pay us. When will there be a class action against TQL with them not paying??? If you are aware of one, I surely would like to know about it.

TQL is cheating me out of a 871 miles of a back haul that was supposed to be a drop off power only. In that load they also have decided there are 16 pages of missing BOL when it was actually the load manifest. Only one page was the BOL. It was signed and factored by Truckstop. Truckstop is now saying I am agreeing to retrieve paperwork that doesn't exist. I can't even call them as they won't answer their phones. Home Depot, the shipper, is the only one who answers and has said I did everything correctly. Happy trucking y'all!!

Hello, I am relatively a newbie in Freight Claims. I wanted to sign up for a training program Claims Assistance Program: But they charge about 10k(as a freelancer thats my yearly salary) This is the letter I wrote them… by chance can you help me with anything like this? “ I am only a freelancer promoted into a Claims Manager position because of my positive work product and the company can pay freelancers at 1/3 the salary. I dont think the company will pay for me to take a course for $10k. By chance do you sell portions of your course for example I was interested in the response letters to carriers, the 12 response to declinations and the 72 precedence's to help rebut declinations. If you could give me a price I might be able to pay out of pocket.”. Please, if you could guide me in the right directions or if you have anything like what that course offers, i would gladly pay for any expense within reason. Thanks for your time. Love your videos.
