Excellent presentation by Mary Kathryn Nagle. The Poarch Band attorney was pathetic. The court seems to understand they lack cultural identification with the site. I would hope that at some point, pending the outcome of this case, Federal recognition of the Poarch Band as a tribe would be withdrawn and Hickory Ground returned to Muscogee (Creek) Nation as the lawful descendants.

The defense attorney for Porch did not understand jurisdiction nor NAGPRA. It was unclear if she knew who she represents. The APA is an agency of the federal government. Porch apparently has no sovereignty.

Poarch Council's failure to abide by Federal Law and adopt an appropriate Tribal Constitution suitable for approval by the Secretary of Interior in its Organic State that was NOT held at a Secretarial Election does NOT Qualify Poarch Council to have Authority at all for Anything yet the Council has presumed Authority based on BIA's Bill Ott's Temperary acceptance until such time that the Secretary does approve the Constitution. Poarch Council marked ALL the IRA approved Title holder children on the Federal Base Roll as DEAD, these Indians are NOT part of the Tribe today. THESE children are connected to the Oklahoma Muscogee Creek Indians through the Indian Claims Commission Docket 272. Again.. THESE Docket 272 Tribal Member children are NOT on Today's Poarch Tribal Roll. The Children were suppose to be the Protectors of Hickory Grounds but NO ONE Protected the Children from being removed from the Tribal Roll by Council retro acting a Blood Quantum requirement that the BIA and Interior's Solicitors repeatedly told Poarch that they could NOT do because it was against the IRA Regulations. The Docket 21 holders under Lynn McGhee ARE however members on the current Tribal Roll but are Unaware of WHY their children who are on the Federal Base Roll are NOT on today's Tribal Roll due to their lack of Education training and being lied to by Poarch Council. Those found in the Tribe today that do NOT hold a Creek Docket 21 or Docket 272 can only be linked to adoptions made by Poarch Council who do not Hold any ICC Docket Award or only hold a Creek Docket 275 under an Ancestor who was to Remove from Georgia and Northern Alabama lands. Notice that Poarch claims are that they Migrated to the Lynn McGhee reservation lands and claims that Anyone in the Community can use the Reservation lands. HELLO??? POARCH is NOT the Tribe, they are the Successor Entity who has FAILED to Uphold the distribution of the IRA to those Indians who Qualify for it. Not only has Poarch Council disregarded the agreement to uphold the Trust Responsibility but has used Rico by placing individuals in BIA, Department of Interior and Office of Special Trustee to carry out their distructive plans to destroy the Creek Docket 272 documentation of the living children connected to the 1955 PL 202 Ch 444 that instructs the Secretary of Interior to Create the IRA Tribal Roll which IS listed in the Federal Register as Eastern Creek Descendants one day After Federal Recognition was approved. Poarch NEVER adopted an IRA approved Tribal Constitution for their OWN benefit.. NOT for the Benefit of those who are suppose to be Protected! DO YOU UNDERSTAND Micco Thompson? To be CLEAR, the attorney representing Oklahoma in this case turned Deaf ears to this Information when presented with it. Poarch doesn't represent the Tribe, they are Sqwatters who have NO connections to Hickory Grounds or to the Reservation of Lynn McGhee but are Claiming to be Community Members who are allowed to use the communal lands, migrants from North Alabama and Georgia who were to be removed from their lands. The Government Relations, Loreal Ironcloud, has been using a Constitution submitted by Poarch's Council that does NOT have the Secretary of Interior's signature on it. If you read Thomas Tureen's 1975 letter in reference to Federal Recognition it will show you that the IRA Indians weren't receiving services or benefits and we needed someone to distribute it for us..... Eddie Tullis's Non Profit, Poarch Band of Creek Indians just wanted their hands on OUR Accounts which they do NOT maintain because Cobell pulled us out being marked as DEAD. WE ARE NOT DEAD. WE are NOT be properly represented nor has Anyone LISTENED! WAKE THE HELL UP!.

6:16 "This one is some kind of thistle. I'm not sure which one." That's a Liatris! I'm not sure which exact species it is, but Liatris is one of my favorite wildflowers. They're commonly called "blazing-stars" or "gayfeathers" in English. I don't know the Mvskoke word for it, but I agree that they're really pretty :D Also, it's interesting that you called it a thistle. I've never heard Liatris called a thistle before, but I'm guessing it's a local difference. They do look very similar to "true thistles" (for lack of a better term) like _Carduus_ and _Cirsium,_ and they are in the same family, so it's not surprising that some folks call them by the same name.

Truly about time the mention about Alabama and Georgia Creeks, the original home lands as well as Florida. We were displaced to Oklahoma it's not our homeland. I and my family never left Alabama we lived at Oneonta not making the deadly walk on the trail of tears.

As an African American I can understand not claiming someone who has less than 25% blood, and no direct lineage. However, the economic impact must be considered. It can be argued that had the original "Freedmen" been given what they were owed that their descendants would be better off today. I think that maybe they should stop fighting for citizenship and seek some other way to be made whole. Don't go where you aren't wanted.

The photo of the family in this vid is my actual family!!! I am a part of the Grierson clan…(came from Scotland). Greyson county (Sherman & Denison Tx) is named after my 6th great grandpa. He came from Scotland and married Sinnugee, a runaway from Florida of Mexican, Native American & Black descent. My dad’s paternal side can be traced all the way back to the 1500s in Scotland, it literally goes through this whole era of history! ❤❤❤

I watched and listened and there was some very good points on the side of blood quantum, whether how much, if any , shows up as Native blood (dna ?), as far as blood quantum/dna, shouldn't that scientifically prove those two points, or disprove ? Dna, however, doesn't show which tribe you originated with though, so I'm guessing that's where the paper trail might add a little credence to it all too ? The last guy with the bandana also had some good insights too though and brought up the problems with blood quantum. I know of Tribal members today that have grandchildren who don't meet the blood quantum because through outside intermarriage , the blood quantum wasn't enough for her grandkids to qualify. Their families live on the Rez, they go to the Tribal school, attend the functions, know the history, some learning the language, not good enough. I read a book by a Mohawk author in NY State back around the very early 2000's addressing the bq problem and that the tribes were going to have to deal with a solution quickly before it became the controversy it is today. No one wanted to hear it, it was only starting then so not many families in that area really took it serious enough to even discuss it. So, here we are today.

They bought it before they were a federally recognized tribe. Immediately after the 20 yr covenant they began horrifying excavations. PBCI is not descended from Ocevpofv and should not have been granted this land in trust. No historical connection. This was such a planned purposeful coup against Ocevpofv over 40 yr in the making. And PBCI has made enormous amounts of money and have used it to get their way in Alabama. I have heard alabamans brag about how much contributions have been made.

I respect the sentiment of the MCN Citizen. The treaty is not a bilateral document as believed by this MCN Citizen; it is a treaty dominated by the U.S. government to solve the Freedmen problem. The Indians present were mostly witnesses, not equally positioned with the gov't. The gov't implicitly states the rights of the Freedmen - "Freedmen have the same rights as the full-bloods." Justice delayed is justice denied. 140-plus years delayed? Go figure.

Thanks for uploading these, I had thought our family were mostly Choctaw and/or Cherokee, but come to find out the only relative we have on the dawes rolls was Muscogee. So, I am trying to learn all that I can about my relatives that until a few months ago I had no clue about.
