Please help... I was never officially served anything. And I thought my ex was lying as she always does. And so I disregarded the paperwork seeing how nothing I received ever came from the court. So I blew it off. Then I had a notice for a hearing by phone but that notice came In late and that hearing was vacated and reset then I didn't recieve that notice until the Monday after the hearing (that previous friday) what can I do now. Do I file a petition against the final decree or something else. Please help I am running out of time

My wife's sister and her husband are currently in Family Court and this week my wife and I have been subpoenaed by the husbands attorney. What obligation do we have to appear? I was told because it's not a criminal case for a felony or misdemeanor that if we no showed there would be no consequences. Any advice would be appreciated.

I am curious of what the steps are, would a lawyer first request the documents by sobpoena, to opposing council and if it is objected would the lawyer then file a motion for documents to be provided by sobpoena (with relation to financial documents) ???
Depending on the nature of the documents being sought and provided that they are relevant to the issues in dispute, the general process would be to first request documents by way of disclosure. If the requested documents are not provided to a satisfactory level, then it may be necessary to file a subpoena with the Court.

Do you only look at the gain of an asset growth during the marriage to put into the asset pool? For example, if you own an investment rental home years before marriage, marriage of 20 years, valued at time of marriage of $100K and valued at separation as $250K, is $150K considered as part of pool?
Yes, the increased value is taken into account in the calculation of the total property pool but the initial contribution of that asset will receive a percentage adjustment in favour of that spouse .
How do you account for situation where the househusband is a legal owner of investment property on behalf of others (i.e he is acting purely as trustee and benefits nothing from this investment asset). By Trust laws, the househusband does not really own it and I believe it should be excluded from the asset pool. Am I right? Thanks.
Being the registered legal owner is a significant and relevant issue . in the context of what you have raised ultimately how the law will treat it is largely a question of evidence , every case will be different.
