Hi thanks and for the video. Please could you advise me on this issue. I was left my fathers property in his Will and thus granted probate, as the beneficiary. I have yet to change the Title Deed, to my name, which I believe is not required to prove or act as the "legal owner." I now wish to give Notice to end the tenancy of the tenant. Who is being awkward and brought to question I am not the owner, having gone to CAB and spoken to his social worker/ support. To have the Title registered to myself might take 6 months or more, I need to have the property vacatated asap Thank you in advance

Brian, really good question. There a few articles online about this. Firstly, as the main executor you have rights to evict your tenant. However, before you do anything, do an MOT on the tenancy, check certificates are up to date and issued, the AST is compliant, their deposit is protected and you have given them a prescribed information document. If they are in a FIXED term tenancy, then you cannot make them leave. If they are on a rolling contract, you must give them a clear 2 months notice to leave and can evict them through the courts if the paperwork is on point. If they are going to the Citizens Advice, they could be on housing benefit, if they are then it will cost you to evict them and make them homeless so they can then be rehoused. I would be looking into the condition of the property and booking a meeting with them, have a face to face chat first and see if you can sort anything out. Failing that, go through the evictions and go through the courts, you can always increase the rent too if you wanted to.

A valid reason is that landlords pay increasing taxes, insurance, mortgages, maintenance and repairs, take all those risks and responsibilities, then bad tenants get away with all sorts of damages, from pets too, and many get to stay for 12, 14, even 18 months without paying ! And people want to stop them from trying to save their units !?

My agency is saying I can’t serve section 8 and 21 after 2 months because there is still 1 year left on the fixed contract. Is this correct?

Section 21 No! But Section 8 (Of course you can if they miss 2 months worth of rent if it is a Monthly paying AST. I would speak to a solicitor, your agent doesn't know what they're talking about.

A house came up for sale 3 months ago. We offered asking price, the EA said they are dealing with a company the family has appointed and they are useless. They send one word emails and it’s a nightmare. The family are in Australia and they have no idea what’s going on with the property. Not sure what we can do to speed this process up, the EA are about to give up on it.

You can usually check a status of probate online, but it does take a while at the moment for probates to go through. My advice is put a time deadline on it and keep your eyes open for other properties in the meantime. Poor communication is usually the main thing that breaks a deal.

I was given the key to a property i rented, that same day i went to assess the place thoroughly and found out there were broken pipes in the kitchen which i couldn't have noticed during the viewing, the house was not cleaned by the landlord and there was a naked life wire attached to the bathtub. I immediately sent an email to the agent and landlord and called them but they busied my call through out that day. The next day my wife called them and they claimed not to receive any email from either of us. And that there js nothing they can do. I just signed the contract and i haven't moved in. What can i do about his situation.

Ok, lets look at this step by step: Broken Pipes - Landlord may not have known this, so if they are spurting out water, then get the agent to get someone within 24hours, if they are not spurting out water, take a photo and email the agent, if they do not send someone, then it is not really your problem, but send the photo and cover yourself. Ideally the agent should get this fixed within a reasonable amount of time, 3-4 days tops. Livewire - EICR? Did you receive a copy of this upon move in? If so, call the agent and email them, give them 24 hours to respond and then call the Electrician, WhatsApp him a message with a photo and see if it is dangerous, if he put his name to it and missed it and it is dangerous, he will be back round (trust me as he could go to prison). His details will be on the EICR. Clean - you would have viewed it and if you requested a clean and they said that they would clean it, then this is bad. However, you have a right to give the property back and it was given to you, I would advise, pay for a cleaner yourself as you and your family are living there anyway, so make it clean. There is not much you can do unless the agent has broken the law, technically you took the property as seen. If you are really concerned, then speak to a lawyer in Landlord and Tenant Law. @@keystonesproperty I wasn't given an EICR. About the leaking pipes the water drains into the kitchen and there's no way I would have noticed it upon viewing. Also I have taken pictures and videos which I attached to the mail I sent to them although they've said they haven't received any email from myself or my wife.. which is a lie. Cleaning the apartment is not a big deal for me and I can fix the wire myself yes. But the leaking pipe is the main issue and I've not even moved in. So I can be sure every other thing would be in good condition like the heaters boilers and all. But you know they laid emphasis on the fact that no repair must be carried out in the apartment without their express approval. That puts me in a tight corner as if I get fixing they may say I did the damage. I don't know if you understand. If they acknowledge my email and say I can fix it then I don't have any problem doing it. But if I do it without them approving that may be a tricky case. Anyways I'm so grateful for your advice mate. Thanks

There are some greedy landlords out there, but I think it goes back to Supply vs Demand in the main areas of work such as London, Birmingham, Liverpool and Manchester, etc... If there was a larger supply, then they wouldnt be able to charge such high rents. The government has taxed landlords meaning a lot have left the market, there has been a lot of immigration over the years and people are living longer too, therefore, there is not a lot of housing available in these areas meaning rents increase due to supply.

@@scottjay1465 yes I understand supply and demand very well. Landlords don’t have to rent it up to the max that’s the point. If I rented out If be reasonable not the highest bidder. I certainly wouldn’t want people struggling and stressed about paying the rent every month. The rental sector is everywhere, not just the cities. It’s worldwide also. I’m about to be homeless at 58 as used to care for mum full time and she died. I live in a small village in Kent. There are multiple factors contributing. The main one is the Airbnb scenario, yes they make people more money but it’s taken away millions of rentals in a world where people can’t afford to buy their own house so there’s less rentals for an ever growing number of people. There’s no social housing or very little and like me it’s impossible to get one. Utilities have shot up. The buy to rent places if they’re still paying off the mortgage the interest rates have rocketed and I was informed the government changed the way this is taxed which is a loss to the landlord and the costs passed down to the renter. Just because there is a lack of supply as said they don’t have to charge the max possible somebody is willing to pay. As a professional carer who is single, not being able to buy or afford even a room in a house share is frightening. Single people are having the worse time because people with children they ensure you at least get a house over your head but for singletons they don’t. There’s now loads of single working people living and working from dorms or working from a tent. No wonder there’s no carers and they’re struggling to fill low paid workers in this country as obviously they need somewhere to live.

How will they inforce that? I give my estate agent my criteria which usually involves working young mothers or working families. I then pay my estate agent to source and vet these types of tenants. Can I be fined for reflecting young working mothers?

They will try to, but they can only advise it, impossible to enforce. Landlords and Agents will have pay lip service to it though. An agent is like an Accountant, The Landlord/Tax Payer will get the fine, not the agent/accountant.

I started two years in advance of my anticipated move: I began to research condo living (I had always lived in a single-family home all of my life and felt I should understand the differences) and I began to get my home and property in tip top shape prior to listing. I researched the general area where I wanted to move (I was looking for improved senior services for my husband, a great library, a good health food store, a good senior center, a bus system (for when we no longer could drive) as well as a property that would significantly increase in value as I knew that our IRA savings were not going to last as long as we were expected to live.) At some point I know that we will sell our condo and supplement our single pension and Social Security with the income from the sale of our condo investment. We have a lot riding on this choice. I choose a luxury condo in a busy tourist town just two miles from fresh-water Lake Michigan. This is a much sought after condo community and geographic area. The area I selected has a vibrant downtown with wonderful stores, heated sidewalks, is extremely well-maintained, has many parks, natural areas, many job opportunities and great restaurants. People flock here for summer vacations and weekend get-aways. Many people want to move here to raise their families (good schools) and the property values continue to rise.

@rabj2834 thank you for your comment. There are a few options, if you are legally serving the rent increase (either anniversary of fixed term or periodic tenancy agreement) then you have to give your tenants a clear 2 months notice. If they don't to pay the increase (which after the 2 months would actually be not paying enough rent), then you can serve a Section 8 notice (once they do not pay the increase) or an easier way is a Section 21 or Section 21(b) notice as they cannot defend it but then you cannot claim for arrears using a S21. However, seek correct legal advice and be aware that the courts are taking their time at the moment. I would always advise trying to finding a way with the tenants first via good communication and negotiation.
