Atty regarding on your examples in Art 41, What if two instances po: (1) the child was completely delivered from the mother's womb (7 mos and 10 days) and the child was dead hours later, should the mother inherent the donations of Joven? .... (2) the child had an intra-utirine life of less than 7 mos, ex. 6 mos and 1 day and the child was completely delivered from the mothers womb and survived and died after 36hrs, should the mother inherent the donation of Joven?
1.) Yes, the mother would inherent the donations of Joven. In Article 41 of the Civil code states that, if the foetus had an intra-uterine life of less than seven months, it is not deemed born if it dies within 24hrs. In this case, the child was born 7mos and 10 days which is more than the Provision has stated. therefore, the mother should inherent the donations of Joven. 2) Yes, the mother should inherent the donation of Joven. In Article 41 of the Civil code states that if the intra-uterine life of less than 7mos, it is not deemed born if it dies within 24hrs after its complete delivery. In this case, the child was less than seven months delivered, but, lived for more than 24hrs which the provisions has stated, Therefore, the mother will inherit the donation.
In other words, the infidelity must be committed in the Philippines. If the husband cheats lets say in England or Australia, the Pinoy court does not have any jurisdiction and therefore charges cannot be presented or brought againts the husband. If the act is committed in the Philippines yes, it can be prosecuted.
