$2K fine in crash that killed 2 at BC wedding "outrageous," family says

The woman who was behind the wheel in a West Vancouver crash that left two people dead will not be criminally charged.
Hong Xu was charged with one count of driving a motor vehicle without due care and attention in connection with the Aug. 20, 2022, crash. A wedding reception was taking place at the time and a large crowd had gathered.
Xu reportedly mistook the gas pedal for the brake, smashing through a fence and a gate, killing two women and injuring nine others, including herself.
Xu pleaded guilty to one count of driving without due care and attention under the Motor Vehicle Act. Crown counsel and defence have jointly requested a $2,000 fine and a five-year driving prohibition.
For the Kong family, that is not close to enough.

no-fault insurance is a type of insurance under which each insured party is indemnified by their own insurer irrespective of who's at fault. Although injured party cannot sue in a civil court, they can sue in a criminal court. Listen to what the lawyers says at 1:33.

​@@Arif_PAKIn order to sue in a criminal court, the driver must be charged with a crime. Even then, the victim is not likely to receive adequate monetary compensation. I am currently dealing with icbc, a lawyer, and a lawyer's aide. Even prior to this no-fault nonsense, icbc has tried very hard to short change victims. Insurance companies hate paying out, and to make matters worse, the former liberal and conservative provincial governments were using icbc like a private bank account, so they were literally in a deficit. That is the real reason for the claim thresholds and subsequent move to no-fault insurance.

Its a common excuse that makes no sense. One pedal makes the vehicle move. One makes it stop. You can feel when the vehicle is moving. If you start moving, that is not the brake pedal. If you keep building up speed and plow into a crowd of people, that was DEFINATELY not the brake pedal. I can't understand how accidents like this could happen if you have any sensation of the world around you, or control of your body.

All immigrants should have to take driving exams in their adopted country. My father moved to England from Canada and they made him. He failed the test. He had been driving for 35 years with no lessons or knowledge, and no natural talent. (At least he was a cautious person). He had to take classes and at 65 finally became a good driver. All people should be required to take both tests every 5 years.

So let me get this straight....we are expecting the increase in 'car insurance premiums' to be the only penalty this woman takes on? Did anyone CHECK to see if she even makes Car insurance payments? If she knew even ONE person at that wedding or was found somewhere she had no business being (no errand, no regular shopping trip) she should have been guilty.

That's what you get when you allow foreign citizens of certain countries to drive in Canada using their original driver's licences and never taking a test here. Anyone who has ever been to China knows how absurd it is that Chinese driver's licences are recognized as valid in BC. As for no-fault insurance, it was adopted by the NDP government in 2020 and went into effect in mid-2021. You get what you vote for.
