Divine law, in the context of Islamic governance, is a system of legal and ethical guidelines believed to be ordained by Allah, as expressed through religious texts such as the Quran and Hadith. Here's how divine law works within a governance framework: 1. Foundations of Divine Law Source of Authority: Divine law is derived from the Quran and Hadith, which are considered the ultimate sources of guidance for Muslims. These texts provide comprehensive principles for both personal conduct and societal governance. Comprehensive Scope: Divine law covers all aspects of life, including personal morality, social justice, economic transactions, and criminal justice. It aims to guide individuals and communities towards justice, equity, and piety. 2. Implementation of Divine Law 1. Legal and Ethical Framework Legal Code: Divine law provides a legal code that encompasses rules and principles governing various aspects of life. This includes personal matters (e.g., marriage, inheritance), social responsibilities, and criminal offenses. Ethical Guidelines: Beyond formal laws, divine law includes ethical and moral guidelines for behavior, promoting values such as honesty, fairness, and compassion. 2. Governance Structures Judicial System: A governance system based on divine law includes courts or judicial bodies that apply these principles in resolving disputes. These judges or scholars interpret divine law in the context of specific cases. Leadership and Rulership: Leaders are expected to govern according to divine principles, ensuring that their policies and decisions reflect the values of justice, fairness, and respect for religious obligations. 3. Social and Economic Policies Social Justice: Divine law emphasizes social justice, including the equitable distribution of resources, support for the needy, and protection of vulnerable groups. Policies based on these principles aim to create a just and compassionate society. Economic Transactions: Divine law governs economic activities, ensuring that they are conducted ethically. This includes prohibitions against exploitative practices, interest (riba), and unfair trade practices, as well as promoting fairness and transparency in transactions. 3. Practical Application 1. Dispute Resolution Resolution Mechanisms: Divine law offers mechanisms for resolving disputes, including mediation and arbitration based on religious principles. This approach aims to achieve resolution in a manner consistent with ethical and moral teachings. 2. Legislation and Policy Making Policy Formulation: When formulating policies, rulers and lawmakers refer to divine principles to ensure that laws align with religious teachings. This includes drafting legislation that reflects the values of justice, equity, and respect for individual rights as prescribed by divine law. Let's explore how divine law would be applied to traffic regulations: Incorporating divine law into traffic regulations would involve aligning the principles of traffic law with the ethical and moral guidelines derived from religious teachings. Here’s a conceptual framework of how divine law might influence traffic law: 1. Ethical and Moral Foundations Principles of Justice and Safety: Divine law emphasizes justice and the well-being of individuals. Traffic laws inspired by divine principles would prioritize safety, justice, and the prevention of harm to all road users. Accountability and Responsibility: The divine principles of accountability and responsibility would guide behavior on the road. This includes personal responsibility for one's actions and consideration for the safety and rights of others. 2. Traffic Regulations Based on Divine Law 1. Traffic Safety Avoidance of Harm: Divine law would advocate for rules that minimize harm and prevent accidents. For example, strict regulations on speed limits and the use of safety equipment like seat belts and helmets would align with the principle of protecting life and reducing harm. Safe Driving Practices: Emphasis would be placed on safe driving practices, such as not driving under the influence of alcohol or drugs, which aligns with the divine prohibition against actions that endanger oneself and others. 2. Ethical Behavior Honesty and Integrity: Divine law would promote honesty in interactions with law enforcement. This includes avoiding dishonesty when dealing with traffic citations or documentation. Respect for Others: Drivers would be encouraged to show respect and consideration for other road users. This might include regulations that promote courteous driving, such as yielding to pedestrians and respecting traffic signals. 3. Legal Framework and Enforcement Justice in Penalties: Penalties for traffic violations would be designed to be fair and just. Divine principles would guide the proportionality of penalties, ensuring they are neither excessive nor lenient but appropriate to the offense. Rehabilitation and Education: Instead of focusing solely on punitive measures, divine principles might support rehabilitation and educational programs for offenders. This could involve educational initiatives on safe driving and ethical behavior on the road. 4. Community and Social Impact 1. Promoting Public Welfare Community Programs: Divine law would encourage community-based programs to promote road safety, such as awareness campaigns and support for those affected by traffic accidents. This aligns with the principle of communal responsibility and welfare. Support for Victims: There would be provisions for supporting victims of traffic accidents and their families, reflecting the divine principle of compassion and support for those in distress. 2. Ethical Decision-Making Moral Guidance: Divine principles would guide ethical decision-making in traffic law, ensuring that regulations and enforcement practices are grounded in moral values. This might include considerations of fairness, empathy, and justice in both the creation and application of traffic laws. 5. Implementation and Adaptation 1. Scholarly Interpretation Application of Principles: Scholars would interpret divine principles in the context of modern traffic issues to ensure that traffic laws are effectively applied while staying true to religious values. This interpretation helps adapt divine teachings to contemporary traffic scenarios. 2. Integration into Legal Systems Harmonization with Existing Laws: Divine-based traffic laws would need to be harmonized with existing legal frameworks. This ensures that they complement rather than conflict with other regulations and are practically enforceable.

Afghanistan achieved its independence from British influence, rather than freedom in a broader sense. Historical Context First Anglo-Afghan War (1839-1842): Afghanistan experienced British military intervention, which ended with a British withdrawal after a disastrous campaign. Second Anglo-Afghan War (1878-1880): The British again intervened, leading to the Treaty of Gandamak, which established a British political agent in Kabul but nominally left Afghanistan under its own control. Independence (1919): Afghanistan formally achieved its independence from British control following the Third Anglo-Afghan War (1919). The Treaty of Rawalpindi, signed on August 8, 1919, recognized Afghanistan's full sovereignty and ended British influence in Afghan affairs. This treaty marked the end of British control over Afghan foreign policy and solidified Afghanistan’s status as an independent nation. While it is accurate to say that Afghanistan gained independence from British control, describing it as gaining freedom from the British can be somewhat misleading. Here's why: Independence vs. Freedom Independence: Refers specifically to the end of British political and military control over Afghanistan. This was achieved through the Treaty of Rawalpindi in 1919, which ended the British influence over Afghanistan’s foreign affairs and recognized its sovereignty. Freedom: In a broader context, freedom encompasses not only the absence of foreign control but also the ability of individuals and the nation to exercise their rights, liberties, and autonomy in various aspects of life, including political, social, and economic spheres.
