CASE
Enrolled with Rao IIT Academy
Boards + JEE (Mains) + JEE Advanced (2014-2016)
Tuition fee of Rs. 50,000/- was paid by cheque
At the time of admission, the Complainant was not informed that the admission was granted on a scholarship basis.
Attended only 2-3 classes
Found the teaching unsatisfactory
Request cancellation of admission
Coaching center instructed submit a Written application for refund
Complainant submitted application for refund
Despite regular follow-ups, Rao IIT Academy allegedly failed to refund the amount.
Feeling aggrieved, the Complainant filed a consumer complaint in the District Consumer Disputes Redressal Commission, Mumbai, Maharashtra (“District Commission”) against Rao IIT Academy.
Rao IIT Academy REPLY
Total course fee = Rs. 2,25,000/-
Scholarship deduction of 32.75%
Net amount payable = Rs. 1,52,189/-
Acknowledged receiving Rs. 50,000/- as part of payment
It referred to terms and conditions attached to the admission form and argued that refund rules applied only to admissions made on full payment and not those under scholarship
letter mentioned a change in educational stream as the reason for refund
However in the complaint the Complainant stated dissatisfaction with teaching quality
It contended that such contradictory positions should lead to the dismissal of the complaint
Observations by the District Commission
Complainants has not given the scholarship test during the admission process and that her admission is not on the basis of the scholarship test.
The Complainant's case that the terms and conditions mentioned on the admission form of the Opposite party were not explained to them and
The Rao IIT Academy has also not denied the fact that the terms and conditions of the admission for the coaching class was explained to the Complainants.
Not Informing the Complainants that the admission has been allotted on the basis of scholarship test as well as not explaining the terms in related thereof before accepting the advance amount and Non refunding the amount of fees amounts to unfair trade practice on part of the opposite party.
Regarding the admission form clauses, the District Commission noted that students and parents have limited bargaining power and should not be unduly penalized by terms they might not fully understand or agree with. Given that the Complainant attended only a few days of coaching despite a significant fee payment, the District Commission found the demand for a refund justified.
JUDGEMENT OF DISTRICT COMMISSION
Rao IIT Academy to refund Rs. 50,000/- to the Complainants along with 6% interest per annum.
Rs. 10,000/- to the Complainants for physical harassment and mental agony
