फिल्मों में आपने अक्सर देखा होगा कि जब भी पुलिस किसी अपराधी को गिरफ्तार करने पहुंचती है तो अपराधी पूरे आक्रोश में कहता है कि "जाओ पहले वारंट लेके आओ..." पुलिस के पास अगर वारंट होता है तो उसे गिरफ्तार कर लेती है लेकिन अगर वारंट नहीं होता है तो उसके खाली हाथ वहां से जाना पड़ता है... लेकिन अब आप सोचेंगे की भला पुलिस के पास वारंट क्यों नहीं होगा.... सवाल करेंगे कि आखिर इसे जारी कौन और कब करता है.... दरअसल गिरफ्तारी का वारंट जारी करने का अधिकार पुलिस के पास नहीं होता है. हमेशा किसी अदालत या फिर सेमी ज्यूडिशियल कोर्ट (Semi-Judicial Court) जैसे कलेक्टर, एसडीएम जैसे कोर्ट से जारी किया जाता है. इनके अलावा किसी भी व्यक्ति के पास गिरफ्तारी वारंट जारी करने का अधिकार नहीं है. ये खासकर तब जारी किया जाता है जब किसी पर आरोप है और वो अदालत के सामने नहीं आ रहा है ऐसे में अदालत गिरफ्तारी का वारंट जारी कर उस संबंधित व्यक्ति को अदालत के सामने पेश होने के लिए बुलाती है.
