Dear Khan Sahib, I really admire you for your educational style. Everybody criticizes Encounter. I recommend a law to formulate the encounter in legal way. If this is promulgated then there would be no problem to Police or even ordinary man to eliminate dreaded criminals against whom nobody gives evidence in the court of law. My article is as below :- SAVE “POLICE” FROM CRIMINALS - "ENCOUNTER LAW" THE MOST NEEDED LAW OF TODAY If and when the security of the state is threatened by activities of terrorists, militants, insurgents or organized crime groups, the dedicated and loyal Police Officers always played devoted role and even sacrificed themselves for the safety of people. I am not going deep into the so called encounter of Soharabuddin / his wife or Tulsiram. The arrest of Senior IPS officers of Gujrat and probability of arrest of Andhra Pradesh Policemen, would definitely cause a havoc in the Police channel and the day would not be far away when criminals would over-power police which they have done up to some extent through Politicians today. You may believe it or not but it is true that Police is handicapped against the Mafia, Organized Criminal Gangs, Dreaded and White color criminals. Terrorist activities have also erupted and created a new horizon in our country. It is another burden on Police when the criminals become Member of Parliament or Minister and make the Police force subservient to their needs. Dreaded criminals, outlaw, smugglers, terrorists etc. are the real danger instead of petty criminals who involved into criminal field to quench their thrust and hunger. Police cannot find witnesses in such offences and if it can find, nobody will be ready to go to the Court of Law for evidence, against these types of criminals.. Almost all Policemen, you talk to, will provide lists of criminals who have been granted bail by the courts, even though they stand accused of murder and other non-bailable offences. For example Dawood Ibrahim was arrested by the Bombay Police on a murder charge in the year 1980, later on the court released him on bail, now he is said to live in Dubai or Pakistan and could not be arrested ? Senior Police officers accept in private that there is no alternate to 'Encounter', although they don't want cold blood killing and are well aware that this makes lower-level Policemen unaccountable and open to corruption. The case of Sub-Inspector Police, Daya Nayak is not old for Indian People who has been charged for allegedly accumulation of huge property through illegal means of corruption and fake encounter and also known tobe ‘encounter specialist’ in Mumbai. Police officers also feel the tacit support of Indian society for 'Encounters'. These encounters are the way of guaranteeing law and order situation when there is pressure from society to solve problems through resort to encounters. In some cases it has been observed that the courts are also enthusiastic accomplice in this effort because they also feel ‘encounter’ as the only remedy left with police. Principal Judge A.S. Aguir of the Bombay Sessions court submitted a 223 pages report on the deaths of two gangsters and a peanut - man who had been killed by the Bombay Police in encounters. This report erupts staged encounter, which was not done in self-defense. Actually there is now no law for encounter of criminals and Police don’t find any other solution of such problems. Generally police has to stage encounters on the basis of self-defense and controversies do erupt like encounter of Delhi Police at Barakhambha when Police opened fire over the mistaken identity and killed two businessmen, though there are no foolproof mechanism to prevent such incidents. Fake encounter is not only an aberration of a deviant and trigger-happy Police Officer; it shows an institutional disregard for human rights. No doubt that encounters are dangerous because it creats a blur distinction between the Police and criminals. Police force is basically for maintenance of law and order, arresting criminals and is suppose to be guardian of society. A Police force that shots first and asks questions later, is no guardian of the law and forfeits the trust of those, to whom he is supposed to protect. The weakness of law and order machinery, the crumbling nature of judicial system and atrocities of criminals on citizen warrants need of a special law to deal with the dreaded criminals and outlaws. As per provision of Section 273 of Cr. P.C. 1973 trial of proceedings shall be taken in the presence of the accused and personal attendance of accused or his pleader is must but in real field work it could be easily perceived that who is going to arrest the Mafia, Organized Criminal Gangs, Dreaded and White color criminals, outlaw and who is going to deposit evidence against these criminals in the court of law ? Article 20 of The Indian Constitution deals with criminal's right guaranteed by Constitution and restricts any law like "Encounter". Many fake encounter have jolted the nation into taking a fresh look at the extra-judicial killings. Police argue that it is virtually impossible for them to fight organized criminals but society recognizes the encounters so the criminals may be eliminated without any effort from the society. Fighting terrorism is one thing but to support encounters against criminals is quite another. Nobody bothers to examine the deed of Police after encounter, hence it is not safe and so a complete process of law is a must and should be made for encounters to avoid fake encounters and action like Barakhambha at New Delhi. A new enactment is must. A simple format may include following points :- Procedure :- I have chalked out a simple framework and accordingly an act may be promulgated in this regard. This may be as follows :- • The article 20 of Indian Constitution may be added with new amendment and a procedure like "Camera trial" may be initiated under section 273 Cr.P.C. with necessary amendments in Evidence act also, so the witness may remain without identity. • There may be video tap evidence before the competent Distt. and Sessions Judge. • When there is an appropriate evidence (without declaring names of witness) the judge must be authorized to issue "Surrender-Cum -Encounter" warrant with the approval of High Court. • No evidence will fear of consequences to say truth before the court of Law and there may be prompt and solid action against such dreaded criminals. • Property of such criminals may also be attached and action for confiscation may be done, so they may surrender. • Provisions may be made to take strict actions against helper / family members of such notorious criminals to pressurize them. • Thus it is a new legal procedure and could be initiated to curb menace of criminals against whom nobody is willing to give evidence. • All expenses incurred by the Govt. Machinery must be charged upon the property of such criminals. • Relatives and near family members may also be held responsible if criminals do not surrender and they must also be taken to task and must remain in severe fear of legal action. The chalked out format of the "Encounter Act" will have to deal with such cases. It may contain definition of dreaded criminals / outlaws, procedure of Police action, trial before the competent authority, approval by High-Court, action plan by executive authority after issuance of "Surrender-Cum-Encounter" warrants, so the Police officer or people in general may not hesitate for encounter with the criminals and this is the need of time. The laws will also safe-guard Police to face trial under section 302 IPC or other provisions of IPC for his legal work. This law will also provide timely action as once the trials commences, within few days all the witness would be completed and warrant may be issued with the approval of the High-Court. This may stop access to control the particular Judge also. Such law will also solve problem of long-lasting actions in the court of law, replacement of prosecutors, damage of the case due to transfer of investigating Police officers or given up of brave witnesses and failure of law at that juncture.An early action in this regard is a must for the safety and welfare of society from dreaded criminals and it shall open new horizon for flourishing human society.
