हमारे देश का कानून ही गजब है कहे तलत नही होगा Divorce केस और 498 आदि केस को एक वर्ष मे कोर्ट को खत्म कर देना चाहिए न कि दस साल से भी अधिक समय तक लटकाए रखे मुझे तो यही गलत लगता है

Sir, meri wife ghar nahi aa rhe thi to maine Section 9 ka case kiya tha fir acahanak se wife aa gayi aur hamne use rakh liya. 2 din baad hi usne tamasha kar ghar se sara saaman lekar chali gyi. Aur 498a ka case kar diya. Abhi mamla chargsheet stage par hai. Wo mujhse talaaq mang rhi hai Islamic tarike se. Maine nahi diya to usne Khula ka WhatsApp kar diya. Kya mujhe iska koi benfit milega court trial me.

The judgement is wrong.the appeal period was pending when the second marriage took place. Legally the marriage was forbidden ab initio hence cannot become legal later on. The court cannot give a go by to the law. The court was actually swayed by the practical fact that the husband can be prosecuted under section 494 IPC but then the second wife will also get punished because the law makes both the newly weds a party to the bigamy offence. This the court thought would spoil the second marriage especially when the appeal of the first wife has been dismissed. The doctrine of merger has been used to give a legal clothing to the otherwise illegal judgement as this doctrine does not apply in the present case. An important legal repercussion of this judgement is that it has set aside the legal safeguard that second marriage cannot take place during the subsistence of the appeal period. This point alone makes the judgement against the law i.e. illegal . The lady could have challenged it but supreme court would then say look ma'am he is already married you also move ahead in your life. Sorry to say all this Adv m s talwar pb & hy high court
