Facts : *Must know and Check the facts* Can anyone be permitted to enter into the privacy to an extent that it suffocates? What were the aim to achieve? Avoiding honest officer from advising on Corruption files by taking advantage of the situation. Same set of Officers who were party when she was sent from Nagpur to Jodhpur with 2 year kid. *Case in Short* 1. Case where a women officer of the rank of Col with an unblemished and impeccable record of service is being harassed, illtreated and defamed by using an incident of financial dispute with a family friend of purely private and for which an FIR no 172/2023 was registered at the yol police station for the offences committed on 8 Aug 2023 of house trespass and crime against women. At present chargesheet has been filed and the issue of the process is in motion. 2. After the police complaint made by the victim on 8 Aug 2023 the saas culminated in FIR no 172/ 2023 and based on the same the Court of Inquiry was also ordered by Brig Hooda the station cdr. 3. The bone of contention started when the husband objected vide his letter dated 14 Aug 2023 for revealing the identity of his wife against the policy guidelines and her examination. After no heed was given by the Station Cdr, the same was projected to the next Superior officer informing about the illegal procedure followed and breach of privacy and insulting questions on disputed fact for which FIR was already registered. The same was also projected by the victim while she was examined in COI. 4. It was then that the women officer was made the subject of mockery by the Station cdr ( convening authority of the ongoing COI) by putting an insulting and defamatory instruction of confinement on paper which was placed at all the gates of Yol cantonment. Which was witnessed by Senior officers of the rank Brig and Col and juniors with ladies. Accordingly, a complaint was made by her husband vide 23 Aug 2023 with the detailed facts of such incident and the illegal procedure followed by presiding Officer Brig Vinay Gupta to the off GOC Lt Gen SP Singh 9 Corps. 2. It was then when the Ego of these delinquent Officials led them to follow further illegal procedures when the victim asked for all such copies of statements and exhibits for taking legal recourse of harassment faced by her 3. Since by that time all these complaints were on record which itself was evident & proof of the illegality and procedures the option was left for them to pressurise victim by misusing the COI proceedings in the garb of powers related to COI and to achieve the aim the presiding officer crossed the jurisdiction, restriction and limit beyond the specific terms of reference which were only limited to ascertain the veracity of entry of civilian on 8 Aug 2023 being legal or otherwise in the military cantonment. However, to implicate the victim and tarnish her character and reputation they blew the facts out of proportion and accordingly committed intentional illegality which makes the entire proceedings null and void and biased. 4. The victim and her husband made numerous complaints of such injustice complaints and numerous representations but no heed was given as the same was pre-planned and had the blessings of Brig Prabhu who was misguiding with advice to settle personal past scores. 5. On the contrary when no action was taken by the authorities the matter was reported to the police on 19 Sep 2023 followed by further letters on 21 Sep 23 and 23 Sep 2023. 6. During the police investigation perjury was caused by misleading the police with false information which resulted in the closing of the case. On the other side when no heed was given to complaints by the Army and police the victim approached the magistrate and the magistrate after hearing the matter pleased to direct an investigation and lodging of FIR no 33/2024 for severe offences relating to crimes against women filed against three Brigs and one LtCol. 7. It was then onwards when the said COI was misused to implicate the victim they started harassing the victim by illegal procedures, asking insulting questions in privacy. 8. Since the matter was investigated and many witnesses were being examined they tried in haste to conclude the proceedings and reassembled the court with two members dropping the lady member without any reason and against the policy of 2013 and regulations for Army para 518. 9. Once again the same illegal questions were asked to the victim for which she was well within her rights to restrict in her answers as the same was prejudiced before the ld Court of Dharamshala. 10. The respondent against whom the records were produced and their character was questioned was allowed to continue with such proceedings against the constitutional spirits by becoming Judge of his cause. 11. With all illegality, against ethics and law, made the victim noteworthy for no good reasons and substance with sheer abuse of powers. Station Cdr recommended Adm action which was increased to Disciplinary action without any additional remarks. 12. All these illegal actions were done to save themselves from the police investigation from severe charges. 13. On the other side no heed was given even though the letters were addressed to AG, JAG, the COASby both the victim and her husband. Aug 23 to May 2024. 14. Now the illegalities in COI are non-compliance with AR 180, Signatures, dates, tampering in the proceedings, and striking out to hide the letters. 15. On 17 May NCW fwd a complaint made by the husband of the victim to SP Kangra and as a result, the harassment began. Such as during bonafide leave without any exigencies asked to report to the new station within 5 days which was inhumane. 16. Due to no reply on all such representations the victim was very disturbed and the same triggered when the hope of justice diminished day by day. 17. The important hidden fact of DV Ban, the fake fabricated Disciplinary directions were not even made aware to the victim. Victim was retaining her appointment and performing duties during such periods from Jan to may. 18. All of sudden she was shocked when she received the suspension order against the policies and illegal procedures with defamatory and stereotypical thought process. The victim after prolonged humiliation from first place to new place decided to commit suicide and left the suicide note . However she was saved and is hospitalised.. 19. Thus the Illegal Court of Inquiry without jurisdictions and illegality with fake and fabricated findings were required to be set aside. FIR no 33/ 2024 is under investigation. 20. Once the Officer reported to new station where she reported in 5 days as what informed to the Ld High Court as routine posting. She wax suspended against the spirit of policies and on no moral ground. Apex court had given protection to victims of crime against women but as JAG it's not for women serving in Forces. This conclusion is because once a letter is addressed for advise on illegality he says it's is personal. And you may complaint to authorities. Regulation para 316 and 317 ( duties of an Officer to bring dishonesty or any such act to the notice of Superior)is not applicable on him. 21. The lady lost hope..No Officer can serve in such manner. *This is only a crux . Person accused of a offence of pasting a paper with confinement of dignfied lady officer and passes instructions to the said instructions is not a fault? The mistake was she had a Faith on her corp cdr who himself wax involved other what was the reasons for him to not act on such heinous offence.* As far as I'm concerned .This shall pass. We as a family stand to fight till we get justice. New COAS is not aware. If you get this message pl remove the mighty cdr and his adviser as the comment made by hid HQs that she had a superficial injury shows the concern bias for the reason known to them. Officer is in hospital from 13 july 23. No court of Inquiry ordered as he himself concluded. Abetting an attempt of suicide by her through such humiliation? 6. Using Army Info warrior fake accounts for spreading fake message against her to defame her? 7. For not following provisions of ordering mandatory court of inquiry in such case against the para 522 of regulations for Army 1987 volume 1. 8. Being medico legal case and intentional medical negligence depriving her treatment? 9.
