Rawat ji नमस्कार. अगर माल के साथ bill नहीं है तो भी officer को व्यापारी या consignee को पर्याप्त मौका देना होगा. आप उस माल को temporary ज़ब्त कर के उस से संबंधित व्यापारी या व्यक्ति को बुला कर निर्धारित समय सीमा के अंदर bill की मांग और जांच कर सकते हैं. लेकिन अवसर देना बाध्यता है. इस विषय पर कई high court की rulings भी है. अगर वो उसके बाद भी उचित documents नहीं दिखा पाए तो वो माल गैर कानूनी होगा और gst authorities के discretion पर या तो पूरा ज़ब्त किया जा सकता है या उचित valuation कर के fine penalty लगा कर छोड़ा भी जा सकता है. अगर 50 हजार से कम value का bill है तो ewaybill नहीं लगेगा. अगर officer को लगे कि bill under valued है तो वो value की स्वतंत्र जांच कर सकता है. Penalty उस माल पर लगेगी जिस माल का कागज समय सीमा के अंदर न दिखाया जा सके या जिसकी value 50000 से ज्यादा हो और उसके साथ में Ewaybill नहीं हो. या वो जो undervalued साबित हो और ewaybill ki applicability दिखे पर उपलब्ध न हो. केवल मौके पर bill साथ नहीं होने के आधार पर gst officer उस माल को शुरू से ही अवैध घोषित नहीं कर सकता. हाँ, जिस वाहन में माल आया है, उसके पास consignment note या चालान है कि नहीं, ये देख कर उस वाहन पर या उस transport operator के ऊपर उचित कार्यवाई करने का कानूनी प्रावधान है. और अगर उस वाहन के पास commercial माल ढोने का permit नहीं हो तो उसपर और उसके मालिक पर भी CMVR के अंतर्गत कार्यवाई की जा सकती है. धन्यवाद और हार्दिक सराहना स्वीकार करें.
Good point. He clearly don't know this and ignores other person's plea to bring bill. This is just for fame. These are small traders may be falling below 10 lakh per Annum slab. This is just harassment. Indian Retailers are merely surviving because of high competition from online portals

ऐसे ऑफिसरों की दादा गिरी बंद होनी चाहिए। आप अपने नियम कानून नही चला सकते जब कोई बिल दिखा रहा हैं उसे देखने के लिए मना नहीं कर सकते हो, संविधान आपको से आपको 24 घंटे का समय मिलता हैं 24 बाद बिल नहीं देता तो ही माल जब्ती बना सकते हो।
आपका मतलब है कि पोलोथीन, रेहड़ी पटरी वाले के नाम पर टैक्स चोरी करने की खुली छूट देंदे इन चोरों को हमारे देश का बेडागरक कर रखा है इन कर चोरों को व इनके हिमायतियों को सख्त से सख्त सजा होनी चाहिए

Sir, if it’s inter-state trade without GST bill then it will be considered illegal, but if the trade happening within the same trade, then it will not be considered illegal. Inside trade, without GST bill is legal. - Excise Inspector
Sir with due respect I would like to inform you that this illegal trade practice is running from the past few years especially after the covid pandemic this has been increased a lot. The reason is eCommerce has damaged so many retail businesses and now to compete the market they are trying to reduce the shipping cost.

Hello Sir, Namashkar🙏 I watch most of your videos, your work is commendable. But for this video I want to express my view to you. The Indian retail market is in a lot of crisis, due to online shopping platforms. Local shopkeepers have to come through many hands to bring some goods. But the country's big business is connected with the online platform. They probably purchase products from direct company, due to which their costing is less. Their market is the entire world, but a retail shopkeeper has to depend only on the local public. Nowadays, due to the low rate in online, the reason of the peoples increasing towards online shopping. Perhaps the local shopkeeper is forced to go into the wrong path due to his desire to reach the customer at low prices. Keeping in mind the small traders of the country, there must be a solution to this situation. Thanks

I strongly feel that the 1st person whom you called for the gst consultation or the gst realted inquiry didn't want to help. he took the side of the doubious shopkeepers so that they could reclaim back their goods.
What if some innocent new businessman send item through bus and pay all the GST and E-Way bill amount but, the transporter only send the GOODs exclude the BILL.. Then the penalty should apply on the transporter,,, isme bechara businessman penalty kyu bhare,,
Nice Sir.....sir first try to understand the basic problem of small retailers...For transportation they are not using proper transporter....also there is no any proper means of transport in India, which are reliable and trustable.....so small business person uses Bus for transporting goods.....since they are getting proper Gst bill on WhatsApp....and not providing E way bill because customer need goods fast and safe..... because of the tranport system in India....

Dear Sir, Appreciate your efforts and understand this issue and doing the correct tings, since in the spot the Purchase invoice and e-way bills were not there. The only way to stop these practice through out India to provide incentives to the people who travels by same busses to the concerned authorities so that these practices by bus operators and vendors and customers can be stopped in future.

Koi bhi goods ho agar beja ja rha hai to bill hona chahiye nahi to goods ko black samjha jayega...or o bhi bill uspar chipka hona chahiye.....sath hi jis transport ka use huaa o bhi bill chipka huaa hona chahiye gadi no ke sath ...sir ne to sirf bill manga . E-way bill rules according to gst act 2017 - 1.In case of intrastate supply of goods(it means supply of goods in same state)- e- way bill तब जारी किया जाता है जब माल की कीमत ₹50000 से ऊपर हो और distance of destination of goods 50 km. से ज्यादा हो।e-way bill इन तीनों में से कोई भी बना सकता है 1. consignor 2.consignee 3.transporter 2.In case of interstate supply of goods(it means supply of goods in other state) - e-way bill जारी करना जरूरी होता है चाहे दूरी 50 km. से कम हो और माल की कीमत चाहे कुछ भी हो
हर एक काम के लिए सरकार ने एक specific department बनाया है!!हर एक department कि जिम्मेदारी है, उसके अधिन विभाग मे हो रही अनियमितता पर रोक लगाये. Dist collector सारे विभागो का head होता है. आशा है इस तरह कि अनियमितता के लिए उन विभागो पर उचित कार्रवाई हो.

व्यापारियों को किसी भी प्रकार की सहूलियत नही दी जाती है उल्टा उनसे कैसे पैसे निकालने इस बाबत सरकार पूरा जोर लगती है। व्यापारियों के प्रति शासन प्रशासन निराकुंश ही दिखती है किसी भी राज्य की बात हो। ऐसे में जो युवा है उनका रुझान व्यापार करने पे आता ही नहीं है और और सरकारी नौकरी के पीछे भागते रहते है।
