Q) Sexual harassment at the workplace remains a persistent challenge in India's quest for gender equality and inclusive workplaces. In light of this, explain how the provisions of the PoSH Act 2013 ensure a safer workplace. Also, highlight the associated challenges. Answer) The Supreme Court in a judgment, said there are “serious lapses” and “uncertainty” in the implementation of the Protection of Women from Sexual Harassment (PoSH) Act, leaving many working women no choice but to leave their jobs. The Prevention of Sexual Harassment of Women at Workplace Act, 2013 (PoSH Act 2013) lays down a comprehensive legal framework for addressing and preventing sexual harassment in workplaces to ensure a safer workplace - 1) Defines an Employee - All women employees can seek redressal to sexual harassment in the workplace. 2) Expands the definition of Workplace: It applies to all public and private sector organisations throughout India. 3) Defines sexual harassment: a demand or request for sexual favours, making sexually coloured remarks, showing pornography, and any other unwelcome physical, verbal, or non-verbal conduct of a sexual nature. 4) Internal Complaints Committee (ICC): mandates that all workplaces must set up an ICC to receive complaints of sexual harassment and ensure timely resolution. 5) The Act also mandates Local Committees (LC) in every district in the country to receive complaints from women working in Firms with less than 10 employees and from the informal sector. Challenges in the implementation of the law: 1) The law is largely inaccessible to women workers in the informal sector as 80% of India's women work in informal sector. 2) Huge Underreporting due to fear of loss of employment. 3) Lacunae in the constitution of ICCs 4) Improper composition of ICCs 5) Lack of clarity in the law about who to approach in case of facing harrassment. Way forward: • comprehensive awareness campaigns • mandatory training programs for employees and employers • stricter enforcement of the POSH Act • simplification of complaint procedures and • extending the Act's coverage to informal sectors.

• Sexual harassment at a workplace is considered a violation of women’s right to equality, life, and liberty - Article 21. • fundamental rights of a woman, under Article 19 (1)(g) of the Constitution of India to practice any profession or to carry out any occupation, trade or business; it erodes equality and puts the dignity and the physical and psychological well-being of workers at risk. • Visaka vs State of Rajasthan: The Supreme Court through this landmark judgment stated that every instance of sexual harassment is a violation of fundamental rights guaranteed under Articles 14, 15 and 21 of the Constitution of India. It also amounts to violation of the “Right to freedom” under Article 19.

Sexual harrasment violates article 19(1)g and article 21. Article 19(1)g - citizen of India to practice any profession / occupation..sexual harrasment violating this.
