🔵 𝐌𝐚𝐣𝐨𝐫 𝐡𝐢𝐠𝐡𝐥𝐢𝐠𝐡𝐭𝐬 𝐢𝐧 𝐭𝐨𝐝𝐚𝐲𝐬' 𝐍𝐄𝐄𝐓 𝐂𝐚𝐬𝐞
There is no doubt that the National Eligibility cum Entrance Test (Undergraduate) exam (NEET ) held on May 5 was compromised by question paper leak, the Supreme Court said
1) All lawyers of petitioner seeking retest sit together and give one compilation of 10 pages. same with the respondents. SC will appoint the nodal counsel.
2) Whether retest should be there or not is based on settled parameters - the court has to see whether
a) alleged breach took place at the systemic level
b) whether the breach is of a nature which affects integrity of the entire exam process and
c) whether it is possible to segregate the beneficiaries of the fraud from the untainted students.
In a situation where breach of sanctity affects entirety of exam and if segregation is not possible then retest is needed. But if beneficiaries are identified then retest wont be needed which involves students on such a large scale.
NTA is directed to clarify on the basis on material on its possession on following issues:
1. When leak has first taken place?
2. The manner in which the question papers leaked were disseminated?
3. Time duration between occurrence of leak and the exam on May 5.
NTA shall inform -
a) steps taken to identify beneficiaries of the leak court should be apprised;
b) steps taken by NTA to identify the centres/ cities where leak took place modalities followed to identify beneficiaries of the leak;
c) how the leak was disseminated;
Union and NTA to inform whether it would be feasible to use data analytics in cyber forensics unit or any employed by government to identify suspect cases, so that modality can be formed to segregate tainted from the untainted students; then, the modalities to be followed between conclusion of the exam including retest and the counselling process. If an exercise needs to be done to deduce more beneficiaries of the leak, a policy decision needs to be taken on the status of the leak.
It would be necessary for the government to set up a multi-disciplinary team of renowned experts to ensure due measures are taken to obviate any further breach in NEET.
Affidavit by NTA, Union and the one by the CBI shall be placed on record at 5 PM on Wednesday and submitted to the counsel of the petitioners as well. Let the matter be placed for hearing on July 11.
