So how do you deal with walis that are upon bid'a and shirk? Many of us have to deal with sufi walis that reject a great guy who is upon the correct manhaj, based on the fact that there is conflict in aqeedah and ironically the daughter is upon the correct manhaj whilst her wali isn't. The wali wants her to marry a person of bid'a and shirk and won't accept otherwise. How do you navigate around this? It's very difficult and draining, and many righteous sisters suffer.
Rulings with regards to the Wali summarised: Firstly: I don’t think I need to establish the walis presence at the contract and consent is obligatory. All the evidences point towards this. The small amount of scholars that differed with this such as Imam Abu Hanifa is not valid because it goes against clear evidence and its not permitted to follow scholars in mistakes which contradict the Quran and Sunnah. We respect and love him and the other scholars who mentioned other than this opinion however blind following that which isn’t backed by evidence isn’t allowed. Just so it’s known what the conditions are , I will make it known through a statement of Imam ash-Shafii in his kitab ar-Risala (all of which are agreed upon and not specific to him): “If you want to do the nikah... 4 conditions must be met: 1. Consent of the man 2. Consent of the woman 3. Wali 4. Two other witnesses If one of these conditions is not met, then that nikah is false and not come with what the Messenger of Allah صلى الله عليه وسلم legislated.” Secondly: What is the order of which the wali is passed on according to the scholars of the sunnah? 1. Her father 2. Her paternal grandfather 3. Her full brother 4. Her half brother from the same father 5. Her nephew from her full brother 6. Her nephew from her half brother 7. Her fathers full brother 8. Her fathers half brother 9. Her fathers full brothers son 10. Her fathers half brothers son If non of these aren’t present then it is: 1. The Muslim leader 2. A man known to be righteous, noble and trustworthy in the Muslim community - These occur in 2 main situations; if someone is a revert or if they were born out of wedlock. This list is an Ijma by the scholars of Ahlul Sunnah. This Ijma has been transmitted by imam ibn Abdil barr in his book al-Istidhkar. Please check it yourselves by all means. Thirdly: Types of absence of the wali: 1. Temporary absence This means that the wali may not be physically be present, but he’s still contactable, and can be present in a future situation, and so him being the wali is obligatory. Examples may include living in or being in a different country, or a different part of the country, or fighting in war but will be back soon and similar. 2. Complete absence This means there is no way of the him being the wali, even if you were to exert all efforts. Examples include death, abandonment so he cannot be contacted and similar. In the case of complete absence, efforts must be exerted to find the wali. If they can’t be reached, it moves on to the next in line and they may sign the contract. Just to emphasise the seriousness of not using the correct wali I will narrate a story from the great Tabi’ Hasan al-Basri. There was an incident narrated in kitab al Muhalla by Ibn Hazm about a man who came to Hasan al-Basri enquiring about a man who wanted to marry a girl but the father was absent. Upon hearing this Hasan al-Basri commanded letters must be wrote and they must be patient until the father responds. A man from the crowd heard this and asked Hasan al-Basri how long they must wait for? He responded by saying, “Be patient, just as the people of the cave were patient”. He didn’t literally mean wait over 300 hundreds to get married, but what it means is that the woman must be diligent in making sure her nikah is valid by doing everything possible to access the father. Hasan al-Basri was just emphasising this point because he knew the seriousness of it. The Scholars generally speaking mentioned that a waiting time of 1 year should be left in situations of absence (apart from death of course) to leave to for the wali to return or in situations where the wali is stopping you getting married. If a year has passed but it’s not happening or they can’t be found she may marry with the next in line.

salam aleykoum do you perhaps know the ruling if the dad of the bride and his entire family are non-muslims. he isn’t familiar with islamic ruling and may love his daughter and want the best for her, but not know what would be the best for her islamcly speaking, whilst marrying her of to the groom. he would maybe let a brother pass which isn’t on his deen, not praying, drinking etc. also during the nikah he may not even know the process, the rulings which must take place and would just follow what he is being told by the present people at the nikah…

A man who sells drugs is not a person of good character for aslong as he is continuing this, and therefore does not meet the conditions of a valid wali. Same with an alcoholic or drug addict. Until and unless they leave this addiction they cannot islamically act as a wali in marriage. Various scholars lay down this condition that his character must be sound
