Hi Sir, i have withdrawn the cheque bounce case since accused agreed to settle money over a period of time out of court. Also taken mutually signed agreement of payment and terms on stamp paper. Respectively sir MERE against mein radhey shyam Rai ne paise de dene ke baad bhi do cheque bounce case lagaye they . Out of court hum logon ka ek laakh mein settlement ho gaya tha. Ek ek laakh bees hazaar ka. Aur ek ek laakh 25 hazaar ka. Maine thoda thoda karke kareeb 55 hazaar de diye they. Feb 2023 mein ek case khatam karwa diya tha. Aur ek case mein amount unhone badhakar 75 hazaar kar diya.jo ki 7500- hae mahine dena tha Lekin mein do date par kewal 3hazaar 3 hazaar he de paaya. Magistrate ne 26_6_2023 ko comprime bhi khatam kar diya. Aur cross aur baaki right khatam kar diye they. Ab 6july matalab kal ki date hae. Kya kiya ja sakta hae. Maine opposition koclear bola tha ki jab registry hogi mein tabhi paise de paunga. Unke advocate ka kehna tha ki case puraana hae court is condition par court compromise accept. Nahin karega PLEASE KINDLY HELP ME Maine unko clear

चेक देने वाले व्यक्ति के पास यदि कोई संपत्ति ना हो उसके पास कुछ ना हो और पत्नी के नाम पर एक छोटा सा प्लॉट हो और वो बेच कर पति की help न करे लेकिन जिसने चेक दिया है उसके नाम कुछ भी नही है तब ऐसे में कोर्ट क्या करेगा यदि चेक बाउंस होता है तब sir जरूर बताएं please

Sir maney cheqe stop payment करवाया था क्योंकि पार्टी ने as a सिकोर्टी चेक लिया था maal baad main adhik ब मेरे ऑर्डर का नहीं था भेज दिया बाद में जब झगड़ा पड़ा तो चेक वीना बताए दो साल बाद अगली डेट का लगा दिया इसे केस में किया होगा

The reasen for bouncing of cheqes is neccesary ( issufi ient fundin the a/c.what about the other reasions 1. Refer to drawer; signeture of drawer not tally; cheques writen in different ink and different hand writing; dates and amount are over writing and any alterations are signed at the place by the drawer . Any partners or director are not authority to issue cheques.complaint be in the name of company of institutions thruogh it director or partners and company be tried before the trial court.Becsuse the cplaint u/s 138 N. I.act is summary trial.pl.elaborate .thaks for giving the legal advice to citizens.

I signed in indemnity bond that i would serve in that company for 2years .if i discontinue before then they would encash the 2lakh cheque+training costs.and i also gave a 2lakhs undated cheque leaf.its been almost 3months,now i want to leave the company!! Does 'compounding' makes consent of both the parties compulsory? Or the Court can impose at its own?

Compounding means a type of compromise. So, both have to agree on that matter. If one denies it cannot be compromised and as a result it cannot be made compoundable.

@@klverma1534 SC has inheriting powers so it didn't make any mistake. SC can make any rule at any time. And in aforesaid case Honable SC made it compoundable without consent of party. Because SC is also remarked that offence under section of N.I act 138 is a civil wrong primarily.

हमें देनदार ने चैक पुर्ण रूप से अपने ही hand writing में दिए 1300000रुपये के,तीन महीने बाद समस्या बताते हुए फ़िर दिये साथ ही स्टाम्प पेपर पर अग्रीमेंट पूर्ण रूप से उसके ही hand writing में दिये,,फ़िर भी रकम देने में असमर्थता बताते हुए तीसरी बार चैक दिये साथ ही स्टाम्प पेपर पर अग्रीमेंट लिखकर दिया,तीसरी बार दिये चैक भी बाऊन्स हो गए ।यानी तीन बार चैक दिये तीन तीन महीने के अन्तराल में ।अब ni act के अन्तर्गत केस दर्ज कराना ही पड़ा ।पहले सम्बन्ध अच्छे थे जो अब खराब हो गए ।रकम नकद और चैक दोनों माध्यम से दी गई थी ।सब कुछ उसके ही hand writing में लिखा है यहाँ तक कि date भी ।क्या सम्भावना है ।

Hi sir...I was so very concerned to a case filed by loan company lending plate against ecs bounce NI act section 25 in delhi saket district court...if the settlement amount is paid...will the case is going to be lifted off before the first hearing?...As per the summon it is mentioned that hearing can be done digitally if so then do that person needed to hire a lawyer? Since the person is really very worried about imagining the situation and don't sleep at nights.....just a matter of rs25k which was scheduled into 3emis and bounced on which 10k payment was made for settlement they are asking for another 20k which doesn't appear to be a settlement...the person is going through hardship time staying in a room rent and married with a kid....being a person before anything I hope u can understand the state of mind and provide your best solution...thank u kindly

हम रूपये देते हैं पहले चैक के ऊपर ओर दूसरी बार कोर्ट में केस लड़ने के लिए,,, ओर रूपये लेने वाले का कुछ भी नहीं करता कोर्ट,,, क्या बकवास नियम है कोर्ट का,,,, 4 से 5 साल लगा देते हैं जज साहब,, पता नहीं ये अनपढ़ होते हैं क्या इनको केस को समझने में 5 साल लग जाते हैं योगी आदित्यनाथ वाला रूल लाओ, जिसने चैक दिया वो जहा रहता हैं वो रूपये वापिस नहीं करता तो,, उसके घर को बेच दे कोर्ट

Sir as far as I know...after bouncing memo, we get 30 days to send notice. If notice is sent within 30 days then from that day to 30 more days we get time to file case in court. Let me know if I am wrong.

Urgent!!! The same thing happened to me. I have paid a cheque of 5.1L from Hdfc to Sbi last month and the entire amount deducted from hdfc but in payee SBI account its not credited. 1st credited then immediately debited stating OUT CHEQUE RETURN 88. How to handle this. How to get my money back. Hdfc is saying no issue it's cleared. I don't have an account with sbi. Payee is saying your cheque is returned to us please cheque with your bank.
