Dear court clerk please give these notes to the judges in this case :- My amicus brief to the court :- If I my , your honours What do we know for sure and 100 percentage right and correct . The 2 nd amendment of the bill of rights , states that America citizens have an absolute inalienable right to bear arms . This means the government agents and officers must and shall respect the right to bear arms . Just because a citizen holds a gun , bears gun in his hand does not meant he has intend to use it in action at any given moment. The appellant arguments are all based on hypothetical false assumptions ! The police put the subject in an impossible catch 22 situation, where he was going to get shoot no matter where he put his hands ! The person who shoot first is the guilt party, regardless of if he is a government official or not . In USA , the 14 th amendment, every citizens have inalienable constitution rights to be treated equally . Government citizens do not have greater rights than normal citizens ! If judges grant government employees extra rights to kill citizens bearing arms , then it become unofficial warfare against normal citizens practicing their inalienable constitutional rights ! In wars between two countries, the country that fires the first shoot over and across the boarder is the perpetrator , and therefore the same in this situation . Policeman are meant to be trained to be professional, be discipline and most importantly show maximum restraint in complex difficult situations . Unfortunately the officer did not show restraint, jumped to misguided conclusions, and end up shooting and hurting a citizen !The government must take accountability for the actions of it's employees . Therefore no qualified immunity sould be given . I rest my case ,your honours .
