No In fact it was a legal move since tuningwares effect on the field is negated. His level changing condition happens during synchro summoning which means it isn’t negated!

@Jesse Quarnstrom the mechanic is actually that you set the scarecrow after using it again. You can't activate traps and quick-play spells the turn you set them, so you (normally) can't use them more than once per turn.
