If any law is being used most inappropriately in Indian courts at present, then that law is IPC Section 498A i.e. Dowry Act. Even if there is a small issue between the married couple at home, the girl, on the advice of lawyers or on the advice of her family members, files a false case of Dowry Act against the husband and his entire family. Year after year, the husband and his family members have to face cumbersome legal process. In view of all these things, in the year 2013, the Supreme Court in one of its landmark orders said that in all the crimes in which there is a provision of punishment up to 7 years, the police Cannot arrest directly. Now, since there is a provision of only 3 years of punishment under section 498A of IPC, sections 376, 377,354 of IPC are also being deliberately added to the complaint of 498A. So that the way can be cleared for the arrest of the husband and his family.

ट्रायल कोर्ट पति पक्ष की बिल्कुल नहीं सुनती । यँहा तक कि crpc 340 का आवेदन देने पर कानून का हवाला देकर पहले 498A का प्रकरण सुनते है । 340 को बाद में सुनने के आदेश कर देते है । मजबूर होकर हाई कोर्ट जाने को मजबूर होना पड़ रहा है । ट्रायल निचली कोर्ट क्यों नहीं देखती है ।

सबसे पहले हो सके तो.. नारको टैस्ट जैसा कोई प्रावधान होना चाहिए... जिससे किसी को फर्जी केस से बचने में सहायता मिले....

आने वाले समय में शादी के कानूनी फिरौती का गलत फैसला देने वाले के लडको कों भी इसका शिकार होना पड़ेगा, पत्नी की गैर मर्द संग sex adultry कों अपराध नहीं और पत्नी कों झूठे case करने पर सजा नहीं का कानून बनाने वाले भी इसका परिणाम देखेंगे
