Drug sniffing dogs don't provide much reliability. According to NPR, citing the Chicago Tribune, a study in Chicago determined that officers found drugs or paraphernalia in 44% of the cases in which a dog alerted - and just 27% of the time when the driver was Latino. I get that the handlers argue that the dogs are picking up residue from drugs that are no longer there, but even if that's true, how can a methodology that is worse than flipping a coin possibly be justification for infringing someone's rights?

The idea of "residue from drugs no longer there" is obviously bogus as I'm sure you can tell. The way dogs smell things is the chemical is constantly streaming out of the source and escaping into the environment, when the source is GONE it's like closing off the dam from a river, the chemicals the dog can detect disappear, the very nature of them radiating causes them to dissipate extremely quickly. You can see this in how dogs are trained, they do NOT signal in containers that previously held drugs, they go straight to the source. The problem with these tests is dogs are NOT trained for "are there drugs or are there no drugs" they are trained for "where are the drugs" the dogs just do NOT have the instinct to accept failure they are very VERY keen to please their handlers who are happy with a signal and sullen when there's no signal. Whatever their training, in practice cops condition dogs to signal. On a tragic note, after the 9-11 attacks the rescue dogs became morose and agitated when they could no longer find anyone alive in the rubble, the dogs were trained to find people alive, they were not trained to find bodies. To get the dogs to keep looking the firemen would bury themselves alive under a bit of rubble to let the dogs "find" someone and the dogs would be able to go on functioning. It seems it just isn't in a dog's nature to accept negative results. We are PAST the point of needing dogs, we have chemical analysis which can directly detect chemical particles, this is what the US postal service has been using for decades in response to the Anthrax attacks. But cops don't want to use this precisely BECAUSE it is reliable, they like the false positives.

Question.... when the officer says they smell Marijuana, have the officers noses been certified by the state as a certified measurement device? And if so, how often are thier noses checked and calibrated?

Not just that but can the officer prove that he smelt drugs other than hearsay. We all know that cops commit more perjury than politicians.

@Paul Pritchard• I totally agree with you on that point because the damn dog is bearing false witness against the vehicle not the driver. And most cops are actually looking to steal cash in these bogus stops under the civil forfeiture scam.

@@fransmith8992 It did happen to me when I was 19 Y/O on the side of a highway when a state trooper asked me to search my vehicle and I didn't know any better. Nothing was in my vehicle but I learned over time that I can say no to searches. I never give consent for a law enforcement officer to search my property and if they try to play games I will call my lawyer on the spot. Just say no

If a cop is asking for a drug dog to go over your vehicle it's because he DOESN'T have probable cause to search the vehicle yet. It's that simple!

If a police drug sniffing dog signals the presence of Drug-A in a vehicle and Drug-A is not found in the vehicle then said police dog should be de-commissioned and/or put-down as defective in the interest of the common good.

The "Free Air Sniff" around your property/vehicle is still a violation of your fourth amendment because the canine is still searching (the outside of) your property/vehicle. It's doesn't matter from what location the dog is searching from, the point is that it's still SEARCHING without your consent. A reasonable distance to compromise would be 15 feet away, 10 at the minimum.

If you wish to be technical, the dog is actually (supposedly) searching the air around your car, and not the car itself. This is a bit of a stupid problem in the first place, trying to fight drugs by searching individual vehicles to seize a few grams at a time.

Nope. And because theres no breath test if you’re a medical user they can take your blood to determine if you’re impaired. But smart people don’t smoke a blunt when they’re driving. People are so stupid. Just like drinking go home first 🤷‍♀️

What about US versus Rodriguez where it says that Anything that prolongs are stopped It's a 4th amendment violation no matter what when they bring a drug dog out on seeing it automatically makes the time longer so how isn't that a 4th amendment rights violation if there was no reason why to give a suspicion?

The problem with the dog is that they false alert by the handlers demand. I don't use any type of substance and have had them bring the dog, because I wouldn't waive my rights.

In order to smell marijuana doesn’t there have to be hard evidence to support the odor? If nothing was found, especially with a dog test, isn’t that grounds to prove an illegal search, thus proving the detainee was innocent?

Presumably no charges will be pressed if nothing is found in the search, so there'd be no need to prove innocense. It was still an illegal search (with no reason to do it), and as far as I understand it's up to the victim to sue the police for that.

It perfectly understandable that young men and boys are terrified of what these police will do to them and human nature when your being attacked is fight or flight so some of these people aren't even making a conscious decision to run it's a natural physical response to there environment and we all know what happens if you do stand your ground, you will face the chance of spending the rest of your life in prison for defending yourself from an attack, which by the way to fight is another of the bodies natural responses to a dangerous environment and not necessarily a conscious decision.👍✌️

You can prove an officer is lying about smelling cannabis if you in fact have not smoked weed and a drugs test proves it since that drug persists so long in the body. If there's only your DNA in the car that leaves there being no way the cop could honestly smell weed.

2:11 - Sorry but you are not thinking very creatively here. Did the officer complete the K9 training where he had to sniff out and find drugs with his nose? Is he trained to detect the odor of cannibis? Does he have any qualifications to that effect? No? Is the possession of cannibis an offense that is serious enough to warrant the search of a vehicle? My understanding is that it's just a ticketable offense. Surely doesn't rise to the level of searching one's car. I think you are maybe not doing a very good job here of representing your clients. There are also experts that can come in and point out that the officer got the dog to "false alert". Man. Get better at doing your job.

if a cop dog doing a drug hit and no hit were found, that dog need to be fired on the spot. Is the dog looking for drug or for food?

most of the time they just hit because the cop eggs them on to hit. usually you will see on the body cam the k9 handler will point and encourage the dog, then the dog will "hit" it's complete bs and they use it all the time as justification for a search
